A RESOLUTION OF THE CITY COMMISSION OF DANIA BEACH,
FLORIDA AUTHORIZING THE CITY ADMINISTRATION TO PURCHASE
SHADE SHELTERS FOR THE S.E. LINEAR PARK FITNESS ZONE AND
CHESTER BYRD PARK PLAYGROUND, IN AN AMOUNT NOT TO
EXCEED NINETY THOUSAND EIGHT HUNDRED TWENTY ONE
DOLLARS AND EIGHTY CENTS ($90,821.80) FROM SHADE SYSTEMS
INC., USING AVAILABLE PRICING PROVIDED BY SCHOOL DISTRICT OF
PALM BEACH COUNTY CONTRACT BID NO. #15C-32B, DATED MAY 27,
2015; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4,
Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and
materials for the city government in amounts in excess of the established monetary threshold
without competitive bidding and without advertisement for bids if he is authorized to do so in
advance by a resolution adopted by the City Commission and if such purchases are made
pursuant to a competitive bid obtained within the last twelve (18) months or as extended by other
governmental agencies such as the federal government, State of Florida or a Florida county or
municipality; and
WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10,
"Monetary thresholds for certain purchases and payment disbursement authorizations",
Subsection(a), sets the monetary threshold or limitation at$25,000.00; and
WHEREAS, the City Parks and Recreation Director has determined that it is appropriate
to purchase shade shelters for improvements of the existing playground at Chester Byrd Park and
the S.E. Linear Park Fitness Zone; and
WHEREAS, the City Parks and Recreation Director has determined that such purchases
can be made at the least cost to the City by purchasing such items from Shade Systems Inc., using
available pricing from School District of Palm Beach County Contract Bid No. 15C-32B, a copy
of which is attached to this Resolution and made a part of it as Exhibit"A";
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. That the above whereas clauses are approved and incorporated into this
Resolution by reference.
Section 2. That the City Manager is authorized to pay Shade Systems Inc. an amount
not to exceed $90,821.80 for delivery, installation and warranty of shade shelters for the Chester
Byrd Park playground and S.E. Linear Park Fitness Zone.
Section 3. That the funding appropriations were planned for and are available in the
City General Fund, Parks and Recreation Department, Administrative Division in the
Infastructure Improvements Account, No. 001 7201 572 63 10.
Section 4. That all resolutions or parts of resolutions in conflict with this Resolution
shall be repealed to the extent of such conflict.
Section 5. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

FINANCIAL IMPACT
The annual financial impact to the District's budget is not to exceed $2,000,000. The source of funds
is the various schools and departments.
Items to be purchased include playground equipment, playground surfacing, fabric shade structures,
outdoor fitness equipment and fitness trails, site prep and installations.
The bid establishes a pool of pre-qualified vendors who are notified when there is a funded project and
are given the opportunity to submit proposals.
The equipment is bid at a firm percentage discount off list price plus freight and installation.
Surfacing, surfacing installation and all site prep is bid at a firm rate.
All equipment and surfacing are approved by Risk Management and must comply with ADA (Americans
with Disabilities Act), ASTM (The American Society for Testing and Materials), CPSC (Consumer Product
Safety Council) and IPEMA (International Playground Equipment Manufacturers Association and all
District standards.

RECOMMENDATION: It is recommended that the award be made to all responsive and
responsible bidders in order to meet the needs of the School District.

BID PROTEST
Failure to Me a protest within the time prescribed in§120.57(3),Florida Statutes, shall constitute a waiver of proceedings under
Chapter 120, Florida Statutes and applicable Board rules,regulations and policies. Offers from the vendors listed herein are the
only offers received timely as of the above opening date and time. All other offers submitted in response to this solicitation, if
any,are hereby rejected as late.
If a bidder wishes to protest a bid,they must do so in strict accordance with the procedures outlined in FS 120.57(3).Any person
who files an action protesting a decision or intended decision pertaining to this bid pursuant to FS 120.57(3)(b), shall post with
the Purchasing Department, at the time of filing the formal written protest, a bond secured by an acceptable surety company in
Florida payable to the School District of Palm Beach County in an amount equal to 1 percent(1%)of the total estimated contract
value, but not less than $500 nor more than $5,000. Bond shall be conditioned upon the payment of all costs that may be

adjudged against the protester in the administrative hearing in which the action is brought and in any subsequent appellate court
proceeding. In lieu of a bond, a cashiers check, certified bank check, bank certified company check or money order will be
acceptable form of security. If, after completion of the administrative hearing process and any appellate court proceedings, the
District prevails, it shall recover all costs and charges included in the final order of judgment,including charges by the Division of
Administrative Hearings. Upon payment,of such costs and charges by the protester,the protest security shall be returned. If the
protest prevails, he or she shall recover from the District all costs and charges, which shall be included in the final order of
judgment.
DISQUALIFYING CRIMES
The bidder certifies by submission of this bid, that neither it nor its principals is presently debarred, suspended, proposed for
debarment, declared ineligible or voluntarily excluded from participation in this transaction by the State of Florida or Federal
Government. Further, bidder certifies that it has divulged, in its bid response, information regarding any of these actions or
proposed actions with other governmental agencies.
