Home My WebLink AboutR-2015-143 Authorizing purchase of one (1) John Deere 524K wheel loader for Public Services not to exceed $151,020.80 from Nortrax, Inc. under Florida Sheriffs' Association Contract No. 15-13-0904 RESOLUTION NO. 2015-143 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO PURCHASE ONE (1) JOHN DEERE 524K WHEEL LOADER FOR THE PUBLIC SERVICES DEPARTMENT, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED FIFTY-ONE THOUSAND TWENTY DOLLARS AND EIGHTY CENTS ($151,020.80) FROM NORTRAX, INC. UTILIZING PRICING UNDER THE FLORIDA SHERIFFS' ASSOCIATION CONTRACT NO. 15-13-0904 WITH AN EFFECTIVE DATE BEGINNING OCTOBER 1, 2015, UP TO AND THROUGH SEPTEMBER 30, 2016, WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and materials for the City government in amounts in excess of the established monetary threshold without competitive bidding and without advertisement for bids if he is authorized to do so in advance by a resolution adopted by the City Commission and if such purchases are made pursuant to a competitive bid obtained within the last eighteen (18) months by other government agencies such as the federal government, State of Florida or a Florida municipality or county; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10, "Monetary thresholds for certain purchases and payment disbursement authorizations", Subsection(a), sets the monetary threshold or limitation at $25,000.00; and WHEREAS, the City has an existing loader which is a 1998 Case 621 B; this equipment is seventeen years old and the cost of its maintenance is now exceeding its market value; and WHEREAS, the primary function of the loader is to move dirt, as well as clearing operations and various grounds maintenance and earthmoving works, and is, therefore, an essential machine that is needed for operational efficiency; and WHEREAS, the Director of the Public Services Department has determined that such equipment can be purchased at the least cost to the City from Nortrax, Inc. utilizing pricing and terms obtained under the Florida Sheriffs' Association No. 15-13-0904, and is made a part of and incorporated into this Resolution by this reference; NOW,THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "Whereas" clauses are ratified and confirmed as being true and correct and they are made a specific part of and incorporated into this Resolution by this reference. Section 2. That the proper City officials are authorized to execute a purchase order with Nortrax, Inc. in an amount not to exceed One Hundred Fifty One Thousand Twenty Dollars and Eighty Cents ($151,020.80). Section 3. That funding for this purchase is available and appropriated in the approved FY 2015-2016 Public Services Fleet Management Machinery & Equipment Account #001-3 9-03-5 3 9-64-3 0. Section 4. That the City Manager and City Attorney are authorized to make minor revisions to the purchasing documents that are deemed necessary and proper and in the best interests of the City. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6.
