HomeMy WebLinkAboutR-2015-146 Approving variance (VA-103-15) & waiver (OT-111-15) requests by Clovermint Cafe & Market for owner Griffin Investment Realty, LLC from Ch. 28, Sec. 110-50 for property at 3433 Griffin Road RESOLUTION NO. 2015-146 A RESOLUTION OF THE CITY COMMISISON OF THE CITY OF DANIA BEACH,FLORIDA,APPROVING VARIANCE(VA-103-15)AND WAIVER(OT- 111-15) REQUESTS SUBMITTED BY CLOVERMINT CAFE & MARKET ON BEHALF OF THE PROPERTY OWNER GRIFFIN INVESTMENT REALTY, LLC, FROM CHAPTER 28, "ZONING", SECTION 110-50 "PROXIMITY OF BEVERAGE ESTABLISHMENTS TO OTHER ESTABLISHMENTS AND USES", FOR PROPERTY LOCATED AT 3433 GRIFFIN ROAD IN THE CITY OF DANIA BEACH FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28 (the City's Land Development Code,the"LDC"),"Zoning",Section 110-50,"Proximity of Beverage Establishments to Other Establishment and Uses",prescribes the separation requirements for the sale of alcohol for businesses located within the City of Dania Beach; and WHEREAS,pursuant to article 625, "Variances",of the LDC,Clovermint Cafe&Market on behalf of the property owner, Griffin Investment Realty, LLC, is requesting a variance from Section 110-50 of the LDC for separation of uses for property located at 3433 Griffin Road in the City of Dania Beach as legally described in Exhibit"A"; and WHEREAS,the proposed restaurant which proposes to sell alcohol would be approximately 866 feet from a place of worship (Nahar Shalom Jewish Temple), and 75 feet from a meeting hall (The Jewish Center) as identified on the Site Distance Survey attached in Exhibit`B'; and WHEREAS,the applicant is also requesting a waiver(OT-I I 1-15)from section 110-50 of the LDC, to allow the sale of alcohol less than 1,000 feet from other alcoholic beverage establishments; and WHEREAS,the proposed restaurant and market will be located within 636 feet from the Big Fat Greek Restaurant,940 feet away from Rookies Ale House,and approximately 166 feet from the Express gas station as identified on the Site Distance Survey attached in Exhibit`B'; and WHEREAS, the applicant has provided in its application sufficient justification demonstrating compliance with the approval criteria to meet the requirements of the Code; and WHEREAS, public notice was provided in accordance with law; and WHEREAS, the City Planning and Zoning Advisory Board finds that approval of the requested variance is consistent with the City's Code and Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. The foregoing"WHEREAS" clauses are ratified and confirmed as being true and correct and are made a specific part of this Resolution. Section 2. That those certain applications VA-103-15 and OT-111-15 requesting a variance and wavier from the requirements in Chapter 28 (LDC), "Zoning", Section 110-50, "Proximity of beverage establishments to other establishments and uses" of the City Code of Ordinances are approved to allow the sale of liquor within 866 feet from a place of worship(Mahar Shalom Jewish Temple), 75 feet from a meeting hall (The Jewish Center), 636 feet from the Big Fat Greek Restaurant, 940 feet away from Rookies Ale House, and approximately 166 feet from the Express gas station as identified on the Site Distance Survey attached in Exhibit`B". Section 3. Issuance of a development permit by a municipality does not in any way create any right on the part of an applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the municipality for issuance of the permit if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. Section 4. That pursuant to LDC Section 110-50 (E)(6) entitled Waiver of distance requirements for establishments licensed to serve liquor on premises, the waiver (OT-II1-15) approval shall expire and become null and void if a building permit to implement the improvements for the approval is not secured within one hundred and eighty(180) days. Section 5. That pursuant to LDC Section 625-50 entitled Expiration of Variances, The Variance (VA-103-15) approval shall expire and become null and void and shall expire unless the applicant obtains a building permit to implement the improvements for which the approval is secured within one hundred and eighty (180) days and submits all applications for any additional required development permits including construction drawings(if applicable)within eighteen(18)months of the date of approval. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. 2 RESOLUTION#2015-146 Section 7.
