Call to Order/Roll Call Mayor Salvino called the meeting to order at 7:00 p.m. Present: Mayor: Marco A. Salvino, Sr. Vice-Mayor: Albert C. Jones Commissioners: Chickie Brandimarte Walter B. Duke, III Bobbie H. Grace Assistant City Manager: Colin Donnelly City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Moment of Silence and Pledge of Allegiance Mayor Salvino called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Class One ISO Rating—John Quitoni, Division Chief, BSO Fire Rescue Fire Chief Anthony Stravino, Department of Fire Rescue and Emergency Services, presented the City with the official Class One ISO Rating report; there are only 19 cities with this rating in the State of Florida. He noted this should reduce insurance costs for commercial businesses in the City. 3.2 Special Event request from the Dania Beach Kiwanis Club for a "Live Christmas Tree Sales" event, to be held at 1301 South Federal Highway, on November 25 - December 24, 2015, daily from 9:00 a.m. - 9:00 p.m. Commissioner Duke motioned to approve the Special Event request for the Dania Beach Kiwanis Club Live Christmas Tree Sales event; seconded by Vice-Mayor Jones. The motion carried unanimously. 3.3 Special Event request from the City of Dania Beach Parks and Recreation Department and the Dania Beach Community Redevelopment Agency, for a "Holiday Lighting Event" to be held on December 10, 2015, from 6:00 p.m. - 9:00 p.m., in the City Hall Nautilus area Commissioner Grace motioned to approve the Special Event request for the City's Holiday Lighting Event; seconded by Vice-Mayor Jones. The motion carried unanimously. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Patricia Tyra, 2912 SW 54t' Street, spoke in favor of the possibility of having a meeting out west. She said there are people out west who do not know where City Hall is located. Rodney Collins, 24 SW 5 h Avenue, acknowledged his appreciation to the City for working on the sign issue that he has been addressing. He noted Dania Beach needs a facility dedicated to our elderly residents, and more childcare in the City. He indicated there is one more facility in the City that has a name on it that should be investigated. Commissioner Duke noted we are doing the best we can for our residents, but we are a small City and it is difficult to take care of everyone's needs within our budget. 6. Public Safely Reports Captain Daniel Marks, BSO Chief of Police, reported on recent criminal activity in the City. He recognized Deputy Jennifer Weir as the Deputy of the Month. Commissioner Duke commented that the Walgreen's on Federal Highway does not feel safe. He asked if there was something the Chief could suggest to make that corner safer. Mayor Salvino concurred with Commissioner Duke's comments. 7. Commissioner Duke motioned to adopt the Consent Agenda; seconded by Commissioner Grace. The motion carried unanimously. 8. Bids and Requests for Proposals There were no proposals on this agenda. 9. Public Hearings and Site Plans 9.1 ORDINANCE#2015-027 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, TO AMEND CHAPTER 28, OF THE "LAND DEVELOPMENT CODE" OF THE CITY'S CODE OF ORDINANCES BY AMENDING ARTICLE 115, "INDUSTRIAL DISTRICTS: PERMITTED, PROHIBITED, SPECIAL EXCEPTION USES, AND CONDITIONS OF USE," CONCERNING OUTDOOR SEATING ACCESSORY TO FAST FOOD RESTAURANTS IN CERTAIN INDUSTRIAL ZONING DISTRICTS; PROVIDING FOR SEVERABILITY;PROVIDING FOR CONFLICTS;PROVIDING FOR INCLUSION IN THE CODE;FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) City Attorney Ansbro read the title of Ordinance#2015-027. Corinne Lajoie, Principal City Planner, provided an overview of the proposed text amendment to allow outdoor seating as a special exception use for fast food restaurants. Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Commissioner Duke motioned to adopt Ordinance #2015-027, on first reading; seconded by Commissioner Grace. The motion carried unanimously. City Attorney Ansbro advised the remaining items were quasi-judicial hearings and swore-in those who would speak. He asked the Commission to disclose any communication they had on these matters. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,November 24,2015—7:00 p.m. 9.2 RESOLUTION#2015-144 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING A SPECIAL EXCEPTION (SE-105-15) TO ALLOW A HOTEL USE PURSUANT TO A REQUEST SUBMITTED BY SUSAN F. DELEGAL,ESQ., ON BEHALF OF THE PROPERTY OWNER COED-STIRLING ROAD, LLC, FOR PROPERTY LOCATED AT 180 SW 18 AVENUE IN THE CITY OF DANIA BEACH, FLORIDA;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. 9.3 RESOLUTION#2015-145 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE VARIANCE(VA-104-15)REQUEST SUBMITTED BY SUSAN F.DELEGAL,ESQUIRE ON BEHALF OF THE PROPERTY OWNER COED-STIRLING ROAD LLC, FOR PROPERTY LOCATED AT 180 SW 18 AVENUE IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution #2015-144 and Resolution #2015-145 because they relate to the same property. Corinne Lajoie, Principal City Planner, provided an overview of the special exception and variance requests. She noted the Land Development Code changed after the construction of the hotel and now makes it non-conforming; these requests would make the hotel legal. Mayor Salvino opened the Public Hearings. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearings. Commissioner Duke motioned to adopt Resolution #2015-144; seconded by Commissioner Grace. The motion carried unanimously. 9.4 RESOLUTION#2015-146 A RESOLUTION OF THE CITY COMMISSSON OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING VARIANCE (VA-103-15)AND WAIVER(OT-111-15) REQUESTS SUBMITTED BY CLOVERMINT CAFE& MARKET ON BEHALF OF THE PROPERTY OWNER.GRIFFIN INVESTMENT REALTY, LLC, FROM CHAPTER 28, "ZONING", SECTION 110-50 'PROXIMITY OF BEVERAGE ESTABLISHMENTS TO OTHER ESTABLISHMENTS AND USES", FOR PROPERTY LOCATED AT 3433 GRIFFIN ROAD IN THE CITY OF DANIA BEACH FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,November 24,2015—7:00 p.m. Commissioner Grace motioned to adopt Resolution #2015-146; seconded by Vice-Mayor Jones. The motion carried unanimously. 10. Discussion and Possible Action 10.1 Schedule a regular City Commission meeting in the western part of the City in the upcoming calendar year—Vice-Mayor Jones Vice-Mayor Jones requested the Commission consider setting a date for a regular City Commission meeting to be held in the western part of the City in 2016. He said this shows caring to the citizens out west, and requested the Commission consider having a meeting no later than February at PJ Meli Park. Commissioner Brandimarte was in favor of having a meeting out west in February. Mayor Salvino said he does not understand the need for meeting out west; City Hall is where meetings should be held. If there is a problem with people coming to the meetings, we could provide a shuttle to bring them to City Hall. He felt the expense of meeting offsite is high; if we are going to be one City, we all need to meet at City Hall. Commissioner Duke commented that he thinks Commissioner Jones means well, but it already feels like we are one City. It does not make financial sense to bring a Commission meeting out west, and the Commission shows its commitment to the west everyday by what they do. He suggested knocking on doors out west if this is about campaigning, and if a Commissioner wants to hold a Town Hall meeting, they should do so. He noted remote Commission meetings were not well-attended in the past. Commissioner Grace agreed with Mayor Salvino and Commissioner Duke. She stated she is not in favor of a Commission meeting or Town Hall meeting out west; Commission meetings should be here at City Hall. Vice-Mayor Jones felt it would not be that expensive to hold an offsite meeting, and said the only good idea came from the Mayor to provide a shuttle to City Hall. He noted this is not about politics, and he had suggested having a meeting out west two years ago. He spoke of the County and City jurisdictions in the west and said there are certain issues going on because of this. Commissioner Duke spoke of being fiscally responsible, and favored the idea of a shuttle to bring residents to the Commission meeting. Commissioner Grace agreed to the idea of a shuttle, and reiterated she is against having meetings in different locations. Commissioner Brandimarte said she would like a shuttle for members of the Senior Citizens club for the first Thursday of every month. Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,November 24,2015—7:00 p.m. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte had no comments. 11.2 Commissioner Duke Commissioner Duke reported on positive financial revenue information that was provided in the monthly reports. 11.3 Commissioner Grace Commissioner Grace commented we may want to lower the tax base next year due to the excellent revenue report. Commissioner Grace commented on the great turnout for the Dania Casino Job Fair; reminded everyone of the Tree Lighting on December 100'; and expressed her sincere appreciation to all the organizations who participated in the Thanksgiving turkey giveaways. 11.4 Vice-Mayor Jones Vice-Mayor Jones also thanked the organizations for their donations to the community. Vice-Mayor Jones noted he attended the Florida League of Cities Annual Legislative Advocacy meeting last week, and reported on the sessions he attended and the information he obtained. Vice-Mayor Jones spoke of a Broward County School Board Grant for $500,000.00, which will be administered to out-of-school youth. 11.5 Mayor Salvino Mayor Salvino commented on the report Commissioner Duke placed in the newspaper; he felt it was very good. Mayor Salvino noted Parks&Recreation is working on the baseball and softball programs. Mayor Salvino asked the Commission to consider a workshop in January to discuss where to obtain funds to accomplish some of the things the Commission would like to get done. 12. Administrative Reports 13.1 City Manager Assistant City Manager Donnelly had no comments. 13.2 City Attorney City Attorney Ansbro had no comments. 13.3 City Clerk -Reminders Wednesday, December 2, 2015 - 5:00 p.m. Abatement Hearing Tuesday, December 8, 2015 - 7:00 p.m. City Commission Meeting Commissioner Brandimarte noted she will not be attending the Abatement Hearing. Vice-Mayor Jones noted again that he would not be attending either. 14.
