DANIA BEACH CITY COMMISSION
ABATEMENT HEARING
WEDNESDAY, DECEMBER 2, 2015 — 5:00 P.M.
1. Call to Order
Mayor Salvino called the meeting to order at 5:00 p.m.

3. Abatement Requests
3.1 Abatement Request from Gabriela Engles, 4736 SW 24 Avenue, Case #12-1029
(Folio#0229-12-0250)
Attorney Ryan noted this case involved 2 violations. The fine ran for 221 days for a total of
$33,504.00, including recording/admin fees of$354.00. The Special Magistrate recommends an
abatement of$3,315.00. The City's out of pocket costs are $1,200.00.
Ms. Engles explained due to financial stress, she was unable to promptly make repairs to her
property,but was eventually able to do it.
Commissioner Grace motioned to abate the lien to $2,000.00 to be paid in 60 days. Motion died
for lack of a second.
Commissioner Duke motioned to abate the lien to $1,200.00 to be paid in 60 days; seconded
by Commissioner Grace. The motion carried unanimously.
3.2 Abatement Request from Dalland Properties LP, 113 NW 13 Avenue, Case #13-1309
& Case#13-1568 (Folio #0233-10-0520)
Attorney Ryan noted the first case was cited for 6 violations. The fine ran for 548 days for a
total of $109,862.50, including recording/admin fees of $262.50. The Special Magistrate
recommends an abatement of$10,900.00. The City's out of pocket costs are $1,200.00.
Attorney Ryan noted the second case was cited for 1 violation. The fine ran for 112 days for a
total of $17,054.00, including recording/admin fees of $254.00. The Special Magistrate
recommends an abatement of$8,400.00. The City's out of pocket costs are $1,000.00.
Jacob Webb, representing Dalland Properties, explained the former management company was
doing a poor job and it was replaced. This has been a culmination of a year's work to get
everything cleaned up. All of the properties are vacant and are being sold; they will be taking a
substantial loss on them. He said the fine is a high percentage of the value of the property, and
asked for a reduction.
Attorney Ryan noted the BCPA's market value on this property is $101,550.00; the
recommended abatement is less than 20%of the property value.
Commissioner Grace motioned to abate the lien to $9,000.00 to be paid in 60 days;
seconded by Commissioner Duke. The motion carried unanimously.
3.3 Approval of Surplus Proceeds from Tax Deed Sale for Elaine Law 250 SW 7 Street,
Case#12-0133, in the amount of$44,737.20
Commissioner Grace motioned to approve the settlement; seconded by Commissioner
Duke. The motion carried unanimously.
3.4 Approval of Surplus Proceeds from the Tax Deed Sale for Cookies & Crackers, Case
#11-1606 -1075, in the amount of$9,108.06
Commissioner Grace motioned to approve the settlement; seconded by Commissioner
Duke. The motion carried unanimously.
4. Adjournment
Mayor Salvino adjourned the meeting at 5:13 p.m.
