HomeMy WebLinkAboutR-2016-007 Griffin New River Plat Note Amendment (DR-119-15) RESOLUTION NO. 2016-007 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING A PLAT NOTE AMENDMENT TO THE GRIFFIN NEW RIVER PLAT (DR-119-15) SUBMITTED BY LEIGH ROBINSON KERR AND ASSOCIATES, INC., ON BEHALF OF THE PROPERTY OWNER GRIFFIN COMMERCIAL CENTER, LLC, FOR PROPERTY LOCATED AT 4600-4607 SW 44 AVENUE IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A," A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the boundary plat known as the "GRIFFIN NEW RIVER" Plat was approved by the Broward County Planning Council in 1995; and WHEREAS, pursuant to Chapter 28, "Land Development Code," Part 6, "Development Review Procedures And Requirements," Article 640, "Plats", of the City Code of Ordinances (the "City Code"), Leigh Robinson Kerr and Associates, Inc., representing the property owner Griffin Commercial Center, LLC, (the "Applicant") has applied to the City of Dania Beach, Florida (the "City"), for approval of a Plat Note Amendment attached as Exhibit "B," for property legally described in Exhibit"A" (Application DR-119-15); and WHEREAS, the Applicant is requesting to amend the Plat Note, as follows: FROM: This plat is restricted to 42,514 square feet of industrial use. Any additional uses are not permitted without the approval of the Board of County Commissioners who shall review and address these uses for increased impact fees. TO: Parcel A-1 (see attached legal description) and Parcel B is restricted to I10,000 square feet of industrial use (42,514 square feet existing, 67,486 square feet proposed) and Parcel A-2 (see attached legal description) is restricted to .68 acres of industrial use. Free standing ancillary office use may be permitted on Parcel A-2 only. Freestanding office buildings or commercial/retail buildings are not permitted without the approval of the Board of County Commissioners who shall review and address these uses for increased impacts. Industrial buildings may have 30% - 50% ancillary office or 30% ancillary commercial use per bay or single tenant building upon satisfaction of transportation impact/concurrency fees. WHEREAS, Broward County requires that the City of Dania Beach concur with the proposed revision prior to a review by the Broward County Commission; and WHEREAS, the City Commission finds that the approval of the proposed Plat Note Amendment will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That the GRIFFIN NEW RIVER Plat Note Amendment (DR-119-15) to allow for commercial, office and industrial uses as provided in the attached Exhibit `B," a copy of which is made a part of and incorporated into this Resolution by this reference, is accepted and approved. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. THE SOUTH 180 FEET OF PARCEL "A", GRIFFIN NEW RIVER PLAT, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 159, PAGE 18 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA. SAID LANDS LYING IN THE CITY OF DANIA BEACH, BROWARD COUNTY, FLORIDA, CONTAINING 29,700 SQUARE FEET(0.681 ACRES), MORE OR LESS. 3 RESOLUTION#2016-007 EXHIBIT B FROM: This plat is restricted to 42,514 square feet of industrial use.
