DANIA BEACH CITY COMMISSION
TUESDAY, JANUARY 12, 2016 - 7:00 P.M.
1. Call to Order/Roll Call
Mayor Salvino called the meeting to order at 7:00 p.m.

2. Moment of Silence and Pledge of Allegiance
Mayor Salvino called for a moment of silence followed by the Pledge of Allegiance to the United
States Flag.
3. Presentations and Special Event Approvals
3.1 Certificate of Recognition for Shenanigans East Side Pub—Mayor Salvino
Mayor Salvino presented the certificate to the owner of Shenanigans East Side Pub for his festive
holiday decorations. Mayor Salvino noted that next year he would like to have an official
competition.
3.2 Special Event request for the MLK Charitable Corporation, Inc.'s annual "Martin
Luther King Jr. Parade and Activities" event. The parade will be held on Monday,
January 18, 2016, from 9:00 a.m. - 11:00 a.m., and the activities will be held at C.W.
Thomas Park from 7:30 a.m. - 6:00 p.m. The applicant is requesting road closures for
the parade and police presence at C.W. Thomas Park.
Commissioner Grace motioned to approve the Special Event request for the Martin Luther
King Jr. Parade and Activities, including road closures and BSO services; seconded by
Vice-Mayor Jones. The motion carried unanimously.
3.3 All Aboard Florida Presentation
Colin Donnelly, Assistant City Manager, reviewed the temporary road closures that were
presented in the agenda packet.
4. Proclamations
4.1 Dr. Martin Luther King, Jr. Day—Carolyn Jones
Mayor Salvino presented the Dr. Martin Luther King, Jr. Day proclamation to Carolyn Jones.
5. Citizen Comments
Katie Milledge, 5525 SW 41 Street, commented on money she has contributed to St. Ruth
Missionary Baptist Church and asked to have it returned.
Josd Armand, 50 SE 3 Avenue, #3, introduced himself and noted that he is interested in the
Creative Arts Council.
6. Public Safety Reports
Captain Daniel Marks, BSO Chief of Police, addressed BSO activities during the busy holiday
season. He also reported on recent criminal activity, and recognized the December Deputies of
the month, Deputies Irizarry and Rocha.
Sean Brown, Battalion Chief, BSO Fire Rescue, introduced Lt. Dan Suarez, who will be
replacing him in a few years when he retires.

Commissioner Duke motioned to adopt the Consent Agenda, with the exception of Item
#7.5, which was moved to Public Hearings; seconded by Vice-Mayor Jones. The motion
carried unanimously.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,
AUTHORIZING THE PROPER CITY OFFICIALS TO AWARD A BID FOR THE OASIS X NEIGHBORHOOD
IMPROVEMENT PROJECT TO GRELITE CORP. IN THE AMOUNT OF ONE HUNDRED THIRTY SIX
THOUSAND EIGHTY SIX DOLLARS AND TWENTY SEVEN CENTS ($136,086.27); PROVIDING FOR

City Attorney Ansbro read the title of Resolution#2016-009.
Commissioner Duke motioned to adopt Resolution #2016-009; seconded by Commissioner
Grace. The motion carried unanimously.

Corinne Lajoie, Principal City Planner, provided an overview of the zoning text amendment to
allow outdoor seating.

Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition, he closed the Public Hearing.
Commissioner Duke motioned to adopt Ordinance #2015-027, on second reading; seconded
by Commissioner Grace. The motion carried on the following 5-0 Roll Call vote:

Dwayne Dickerson, representing the applicant, was available to answer questions.

City Attorney Ansbro read the title of Resolution#2016-006.
Corinne Lajoie, Principal City Planner, provided an overview of the alcohol variance request.
Alex Valezquez, applicant, noted this will be a bike and a run store that will be a place to gather
after a bike run to have a beer and have bikes serviced. In response to Commissioner
Brandimarte, he said because they are just starting out, they do not have the expertise to provide
food.
Commissioner Brandimarte said she has a problem with this because she does not see any
control in this situation.
Mayor Salvino questioned if people could come in for a beer without having a bike or without
having ran.
Stefanie Epp, who lives in Hollywood, noted they are an established group of athletes who desire
to gather in Dania Beach to socialize. She added it is not a possibility to serve food in the future;
these are athletes and not people who are going out to get drunk.
Vice-Mayor Jones commented that food is important when you drink, and because there will be
no food provided, he is out.
Commissioner Duke said he hopes they will draw people to the plaza, and the market will
determine if they should serve food.

property is under the flight path.

7.5 RESOLUTION#2016-003 Moved from Consent Agenda

AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A TREE REMOVAL AND MITIGATION
AGREEMENT AND ANY ADDITIONAL DOCUMENTS PERTAINING TO THE AGREEMENT, AND TO
TAKE ALL ACTIONS NECESSARY TO IMPLEMENT THE TERMS AND CONDITIONS OF THE
AGREEMENT, WITH DANIA LIVE 1748, LLC (DANIA LIVE); PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2016-003.
Corinne Lajoie, Principal City Planner, explained the request for tree removal and the mitigation
agreement for the Dania Pointe project.
Commissioner Grace questioned if quality trees would be planted on the site, and if the trees
removed could be planted elsewhere.
Steve Wherry, Greenspoon Marder, PA, on behalf of the applicant, explained this agreement
protects the City and the existing tree canopy.

11. Commission Comments
11.1 Commissioner Brandimarte
Commissioner Brandimarte commented on the tree lighting ceremony and the MLK event.
11.2 Commissioner Duke
Commissioner Duke resigned his seat on the Commission effective February 5, 2016.
11.3 Commissioner Grace
Commissioner Grace:
• expressed her concern with how the vacancy will be filled, and noted it should be filled
as soon as possible;
• encouraged everyone to vote in 2016, as there will be changes in the makeup of the
various levels of government;
• felt we should have a city-wide party for all City employees at Christmas;
• noted Department Heads have not promoted from within and she wants us to work on
this;
• said the Commission will be making a list of items for the upcoming budget, and she will
be cautious about spending unwisely;
• commented there have been complaints about parking in swales, and we need to work on
this;
• addressed the issue of young people taking for granted that they can do whatever they
want without permits, and thanked BSO for helping with the situation. She added we
want our City quiet and orderly.
11.4 Vice-Mayor Jones
Vice-Mayor Jones commented that it should not be like it was the last time we had a vacancy on
the Commission. He wished Commissioner Duke well.
Vice-Mayor Jones reported on a recent Broward League of Cities meeting where a Charter
change concerning the director of public safety for the E911 system was voted on favorably. He
felt this is something that is needed, but questioned the cost involved and who would pay.
Vice-Mayor Jones asked the City Manager to arrange meetings, dates and times for these items:
Boys & Girls Club; Dania Pointe lead persons; and staff to discuss adaptation action, resilience,
and coastal comprehensive plan for our beach and low-lying areas.
Vice-Mayor Jones noted Economic Development Manager Murphy, who is the point person for
My Brother's Keeper, would like to take action on one of six items and needs funding: daycare
center, all-schools reading initiative, youth and adult mentoring, employment initiatives, and
Dania Beach Has Talent.

11.5 Mayor Salvino
Mayor Salvino thanked everyone for the holiday lighting festival and the sports program.
Mayor Salvino thanked Commissioner Duke for all he has done for the City.
12. Appointments
There were no appointments at this meeting.
13. Administrative Reports
13.1 City Manager
City Manager Baldwin noted BSO is doing a great job, particularly with the homeless initiative;
there will be budgetary pressures coming from BSO for body cameras, paying for cadets to
attend the academy, and replacement radios. Chief Marks is very energetic and doing a great
job; he is evaluating the Marine Unit, and working to possibly get a drug dog in Dania Beach.
The 803 building is in desperate need of repairs, which will likely cost $190,000.00; he will
come back to the Commission to request this amount from Commission reserves.
City Manager Baldwin reported that BSO notified him that the City would have no additional
funding obligation for costs associated with the SAFER Grant through the end of the grant
period, May 15, 2016.
City Manager Baldwin advised he temporarily closed NW 10t' Street from the intersection in
front of Trails End eastward to deal with cabs and limousines parking there waiting for fares.
City Manager Baldwin reported the negotiating team reached agreement with AFSCME;
however, it still needs to be voted on by the members.
Commissioner Brandimarte questioned anticipated revenues coming into the City, and cautioned
that they cannot be spent on the upcoming budget.
City Manager Baldwin noted the Southeast stormwater project will proceed with public meetings
to be scheduled.
City Manager Baldwin commented on working with FDOT on concerns raised with various
projects that are underway.
City Manager Baldwin reported there is a resiliency workshop with Hollywood; staff is also
setting up a meeting with Dania Pointe to talk about the issue.

City Manager Baldwin said FAU will be concluding their report on the Oasis program and will
want to meet with each Commissioner individually to get their input.
13.2 City Attorney
City Attorney Ansbro reported on the preliminary injunction filed by the Citizens for
Responsible Development regarding the casino, and noted a hearing will probably be held next
week.
13.3 City Clerk - Reminders

Comments by Dania Beach citizens or interested parties that are not part of the regular printed agenda may be made during each
Commission meeting during the period set aside for"Citizen Comments." A thirty(30)minute"Citizen Comments"period shall
be designated on the agenda for citizens and interested persons to speak on matters not scheduled on that day's agenda Each
speaker shall be limited to 3 minutes for his or her comments. Persons desiring to speak during the citizen comment period shall
inform the City Clerk immediately prior to the beginning of the meeting of their intention to speak If more than 10 speakers
express a desire to speak,the Commission shall determine on a meeting by meeting basis whether to(a)extend the time allotted
for citizen comments to accommodate all speakers,or(b)whether to limit the number of speakers or amount of time per speaker.
A speaker's time shall not be transferable to another speaker.
