Call to Order/Roll Call Mayor Salvino called the meeting to order at 7:00 p.m. Present: Mayor: Marco A. Salvino, Sr. Vice-Mayor: Albert C. Jones Commissioners: Chickie Brandimarte Bobbie H. Grace City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Moment of Silence and Pledge of Allegiance Mayor Salvino called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Approve the Parks, Recreation and Community Affairs Advisory Board recommendation for a $600.00 rental fee waiver for the use of the I. T. Parker Community Center, by Royalty Inc., on May 21, 2016 Vice-Mayor Jones motioned to approve the I.T. Parker Community Center fee waiver of $600.00 for Royalty, Inc.; seconded by Commissioner Grace. The motion carried unanimously. 3.2 Special Event request from St. Ruth's Missionary Baptist Church to have a "Wayne Barton Study Center Free Food Give-A-Way", on February 20, 2016, from 10:00 a.m. - 1:00 p.m., located at C.W. Thomas Park Mark Felicetty, Director of Parks and Recreation, distributed a revised site plan; the event now proposes a street closure on NW 2nd Street, from NW l Od`Court to NW 9d'Avenue. Commissioner Grace motioned to approve the Special Event request for St. Ruth Missionary Baptist Church "Wayne Barton Study Center Free Food Give-A-Way", as amended; seconded by Vice-Mayor Jones. The motion carried unanimously. Members of the Commission requested that the City coordinate a calendar on the website that coordinates events throughout the City. 4. Proclamations 4.1 Sergeant Thomas McPartland—Captain Daniel Marks, BSO District Chief Captain Daniel Marks, BSO District Chief, presented a proclamation, from the City of Dania Beach, to Sergeant Thomas McPartland on the occasion of his retirement after 35 years of service to the Dania Beach community. Commissioner Grace reported that she was invited to attend today's Broward County Commission meeting and receive a proclamation for the Dania Beach PATCH. The PATCH was recognized as part of Broward County's "Year of Good News". She presented the Proclamation to Mr. Carroll, on behalf of the Community Redevelopment Agency. 5. Citizen Comments John Doria, 304 SE 3rd Terrace, spoke about the new bulk trash and alley pickup, and suggested the 15% of residents who have alleyway pickup pool together to possibly lower their rates. Tamara James, 255 NW Tamara James Avenue, noted she was unaware of the change of schedule for recycling and regular trash pickup. She also requested a basketball gymnasium be built in Dania Beach. Eileen Snyder, 3061 Cove Drive, addressed the Stellar Homes project at the former St. Maurice property, and expressed her displeasure with the proposal. Shirley Jones, 130 SW 5 h Court, expressed her concerns about squatters in her neighborhood, no property standards in the neighborhood, lack of beautification in the neighborhood, and lack of lighting. Teddy Bohanan, SW 15d` Street, said people need to stop spending money foolishly. Gerald Clark, who lives in Maryland but purchased property at 134 SW 5u' Court, addressed the problems on 5 h Court with lighting, apartment buildings, drug activity,traffic,trees, and theft. Michael Sartin, 746 SW 3rd Street, noted there should be an expiration on things that are "grandfathered-in". He complained on the design of the cover of the recycling containers. Carolyn Jones, 722 SW 3rd Street, thanked the Commission for their participation in the MLK celebration and Dania Beach CAN. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,February 9,2016—7:00 p.m. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, noted they have been working with Ravenswood Estates since the last meeting. He reported on recent drug arrests, and other criminal activities. Dan Suarez, BSO Fire Rescue, was available to answer questions. 7. Consent Agenda Items removed from Consent Agenda: #7.3 7.1 Minutes: Approve Minutes of January 26, 2016 City Commission Meeting 7.2 Travel Requests: Request from Eleanor Norena, Permitting Office Supervisor, to attend the Florida Floodplain Managers Association (FFMA) Annual Conference in St. Augustine, Florida, from March 29, 2016 -April 1, 2016 (estimated cost $1,393.90) Commissioner Grace motioned to adopt the Consent Agenda, with the exception of Item #7.3; seconded by Vice-Mayor Jones. The motion carried unanimously. Resolutions 7.3 RESOLUTION#2016-015 A RESOLUTION OF THE CITY COMMISSION OF DANIA BEACH, FLORIDA AUTHORIZING THE CITY MANAGER TO PURCHASE OUTDOOR EXERCISE EQUIPMENT FOR CHESTER BYRD PARK, IN AN AMOUNT NOT TO EXCEED FIFTY THREE THOUSAND NINE HUNDRED THIRTY FIVE DOLLARS ($53,935.00) FROM GREENFIELDS OUTDOOR FITNESS WHICH INCLUDES INTALLATION OF THE EQUIPMENT BY REGAL CONTACTORS INC., USING AVAILABLE PRICING FROM CLAY COUNTY, FLORIDA CONTRACT BID NO. #13/14-8, DATED JANUARY 7, 2014; PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2016-015. Vice-Mayor Jones questioned the equipment that would be installed at Chester Byrd Park. Mark Felicetty, Director of Parks & Recreation, responded there will be 10 separate pieces, placed on three separate concrete pads. He confirmed no additional lighting will be installed, and the equipment will have instructional signage. Vice-Mayor Jones motioned to adopt Resolution #2016-015; seconded by Commissioner Grace. The motion carried unanimously. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,February 9,2016—7:00 p.m. 8. Bids and Requests for Proposals 8.1 RESOLUTION#2016-016 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO AWARD A BID FOR THE OASIS IX NEIGHBORHOOD IMPROVEMENT PROJECT TO DP DEVELOPMENT OF THE TREASURE COAST, LLC IN THE AMOUNT OF ONE HUNDRED FORTY SEVEN THOUSAND FIVE HUNDRED TWENTY FOUR DOLLARS AND FIFTY CENTS($147,524.50);PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2016-016. Assistant City Manager Colin Donnelly distributed information on alternative design elements that are being considered in the project. Commissioner Grace motioned to adopt Resolution #2016-016; seconded by Vice-Mayor Jones. The motion carried unanimously. 9. (SECOND READING) City Attorney Ansbro read the title of Ordinance#2016-001. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,February 9,2016—7:00 p.m. Corinne Lajoie, Principal City Planner, reviewed the 13 proposed amendments, and noted that staff is recommending to withdraw the changes for Pawn Shop, and keep the allowed Special Exception use. In response to Vice-Mayor Jones' questions, she explained the change to the height allowance in the City Centre district, and incentives applicable to this district. Commissioner Grace requested to remove Pawn Shops and Bail Bonds from Federal Highway and East Dania Beach Boulevard, in order to keep these streets as clean as possible and appealing to entice new people to come in. Vice-Mayor Jones spoke against removing Bail Bonds from East Dania Beach Boulevard. Mayor Salvino said he opposes having Bail Bond or Pawn Shop on Federal Highway or East Dania Beach Boulevard. With the direction the City is going now, he does not want this element on our main arteries. He recommends that the Commission pull Amendments 2 and 3 tonight, and revisit them later to perhaps make them a conditional use. Mayor Salvino opened the Public Hearing. Gloria Black, 802 NW 3`d Street, spoke in favor of Bail Bond. Frank Cornelius, 26 SW 7d'Avenue, said he is a bondsman, and does not understand why people are opposed to it. Carolyn Jones, 722 SW 3`d Street, spoke in favor of allowing Bail Bond on East Dania Beach Boulevard. Charlotte Sloboda, 2905 Lakeshore Drive, spoke against having Bail Bond on East Dania Beach Boulevard or Federal Highway. Pastor Bob Sands, Community Bible Church, spoke in favor of Bail Bond on East Dania Beach Boulevard and Federal Highway. He said this should not be made political. Veronica Larkins, 211 NW 12d` Avenue, spoke in favor of Bail Bond on East Dania Beach Boulevard. Bob Adams, 330 SE 3`d Terrace, spoke in favor of Bail Bond in Dania Beach. Michael Sartin, 746 SW 3`d Street, spoke in favor of Bail Bond. Jimmy Peterman, 717 SW 4 h Terrace, spoke in favor of Bail Bond. Penny Cesar Black, 105 NW l Oh Court, spoke in favor of Pawn Shop and Bail Bond on Federal Highway. Myrna Loy, 5353 W Sunrise Boulevard, Ft. Lauderdale, said she is a Bail Bondsman, and explained what they do and that they are regulated by the State. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,February 9,2016—7:00 p.m. Kenya Peterman, 732 SW 2"d Place, described her efforts to open her business and her functions as a Bail Bond Officer. Teddy Bohanan, SW 15d' Street, spoke in favor of Bail Bond, and the Peterman family. Eileen Snyder, 3061 Cove Drive, questioned how the exterior of a Bail Bond office would look. Seeing as there was no one else to speak in favor or opposition, Mayor Salvino closed the Public Hearing. Commissioner Grace said when she came back in 2009/2010, the CRA had a vision of what they wanted Dania Beach to look like; she sees now that the residents have some vision as to how they want the City to look. She spoke of efforts to clean up the storefronts, and new residents and visitors coming into the City as a result of new development. She noted that we are not discouraging opening a business in Dania Beach, but we need to be sure everything possible is done to do the things that are right for everyone. She would like to see Amendments 2 and 3 moved out of this. Commissioner Brandimarte commented she supports giving new businesses a chance, particularly the Bail Bond, and they will not distract people from coming to the area. She felt visitors are stopped from coming because the stores are not open due to the absentee ownership; to her these stores do not exist. This business will be something that exists and should not be hidden in a warehouse. Mayor Salvino said he agrees with a lot of the comments, and asked for clarification on the current approval process for Pawn Shops and on the proposed Bail Bond use. He spoke of his experience with Bail Bondsman and his mixed views on them. Vice-Mayor Jones reviewed the requirements for Pawn Shops. Vice-Mayor Jones motioned to adopt Ordinance #2016-001, on second reading, with no change to Bail Bond, and the change to Pawn Shop to keep it as is in the Code; seconded by Commissioner Brandimarte. (SECOND READING) City Attorney Ansbro read the title of Ordinance#2016-002. Corinne Lajoie, Principal City Planner, explained this text amendment is for the Dania Live Group for the PMUD District. Steve Wherry-, Greenspoon Marder, PA, in response to Vice-Mayor Jones, explained the proposed amendment to the Code, and that it would apply only to the PMUD District. Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Commissioner Grace motioned to adopt Ordinance #2016-002, on second reading; seconded by Vice-Mayor Jones. The motion carried unanimously. City Attorney Ansbro advised the remaining items were quasi-judicial hearings and swore-in those who would speak. He asked the Commission to disclose any communication they had on these matters. Vice-Mayor Jones noted he had been contacted. 9.3 ORDINANCE#2016-003 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING THE REQUEST MADE BY LINDA C. STRUTT, AICP, ON BEHALF OF THE PROPERTY OWNERS, DANIA LIVE 1748, LLC AND DISCOUNT AUTO PARTS, INC. The motion carried unanimously. 9.4 RESOLUTION#2016-017 Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,February 9,2016—7:00 p.m. A RESOLUTION OF THE CITY COMMISISON OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE VARIANCE (VA-138-15) REQUEST SUBMITTED BY HEIDI DAVIS KNAPIK, ESQ., AGENT ON BEHALF OF THE PROPERTY OWNER, FORT LAUDERDALE CY, LLC, FOR PROPERTY LOCATED AT 400 GULFSTREAM WAY IN THE CITY OF DANIA BEACH FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT"A",A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION;PROVIDING FOR CONFLICTS; FURTHER,PROVIDING FOR AN EFFECTIVE DATE. Heidi Davis Knapik, Gunster Law Firm, representing the property owner, presented an overview of the requested variance. Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, he closed the Public Hearing. Vice-Mayor Jones motioned to adopt Resolution #2016-017; seconded by Commissioner Grace. The motion carried unanimously. Mayor Salvino advanced Item#13.1.1 13.1.1 Update on Dania Pointe Project City Manager Baldwin distributed a memo from Marc LaFerrier, Director of Community Development, which is attached to and incorporated into these minutes. Peter Flint, Director of Development for the Southern Region of Kimco Realty, gave an update on Dania Pointe. Robert Shapiro, President of Master Development, provided an economic impact analysis of the project, noting there will be $20 million in impact fees. They are targeting the fall of 2017 for Phase I, and fall of 2018 for Phase II. He thanked staff and the City Commission for all their assistance. 10. Discussion and Possible Action There were no discussion items on this agenda. 11. Commission Comments 11.1 Commissioner Brandimarte Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,February 9,2016—7:00 p.m. Commissioner Brandimarte complimented Clive Taylor for the Vintage Motorcycle Show, and addressed parking on the grass at the event. 11.2 Commissioner Grace Commissioner Grace reported she networked with other elected officials in Tallahassee, and elaborated on bills that were passed that may impact Dania Beach in future years. Commissioner Grace addressed SW 5t' Court, and noted we should have a workshop to handle the issues. Commissioner Grace noted her board members are good. She appoints people who will attend meetings. 11.3 Vice-Mayor Jones Vice-Mayor Jones spoke of the St. Ruth Missionary Baptist Church food giveaway. Vice-Mayor Jones complimented Public Works staff for the work on Frost Park for the Motorcycle Show. Vice-Mayor Jones commented we are looking at having a gymnasium in the City, and will report at a future date. Vice-Mayor Jones noted his efforts, on or off the dais, to be sure there are opportunities for citizens. 11.4 Mayor Salvino Mayor Salvino said the Commission is doing a good job, and sometimes the decisions being made are not just based on what we hear from the audience, but also from the community. Mayor Salvino spoke of the City Commission vacancy and the steps being taken to fill the seat. Mayor Salvino felt we cannot do without the Motorcycle Show; we need to work harder to prepare for how not to destroy the field when we have events. Mayor Salvino noted he is not opposed to Bail Bonds, but perhaps move the allowable locations closer to Sheridan Street. 12. Appointments Mayor Salvino requested that the Commissioners review their appointments and reappoint, within the next couple Commission meetings, to replace those people who have missed a lot of meetings. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,February 9,2016—7:00 p.m. 13. Administrative Reports 13.1 City Manager City Manager Baldwin noted we are trying to set up a priorities workshop after March 8t'. He will submit a list of priorities from previous years for the Commission to rate. City Manager Baldwin thanked Assistant City Manager Donnelly and Public Services Director Kaine for meeting with the community regarding the new garbage agreement. 13.2 City Attorney City Attorney Ansbro requested the Commission extend the appointment of lobbyist Ron Book for an additional three-month period, for airport related matters. Funding would come from Commission contingency account#001-18-00-519-99-10. Mayor Salvino suggested that perhaps an audit should be requested on the County if something is not happening at the end of the additional 90 days. Vice-Mayor Jones motioned to continue the services of Ron Book for an additional three- month period, at $3,500.00 per month,with funding to come from Commission contingency account #001-18-00-519-99-10; seconded by Commissioner Grace. The motion carried unanimously. City Attorney Ansbro asked the Commission to consider approving the use of the City Logo by the PACE program, on the Florida Green Energy Works website, which would provide a link to the City's website. The new event site plan will now have a street closure on NW 2 Street from NW 10th Court to NW 9th Avenue. By utilizing NW 2nd Street this will not interfere with any private residences or driveways. Currently, the Developer is applying for development approvals for the Phase I portion of the Project. Phase I involves the area South of W. Dania Beach Boulevard. This area is being planned for "suburban style" shopping center development. It is anticipated that the Developer will receive the zoning and site plan approvals in the second quarter of 2016; with the building permit applications also in review during the second quarter of 2016. Phase II will involve the area North of W. Dania Beach Boulevard. This area is being planned as an urban center. The Developer anticipates that these site plans will be submitted in the first quarter of 2017. On-site clearing, filling, excavation and predevelopment activities are underway. RECENT APPROVALS AND ACTIONS The City of Dania Beach has processed the following approvals/ actions for the development of Dania Pointe: • Rezoning of 2 parcels from Industrial to Commercial. • Planned Mixed Use Development (PMUD) Zoning District was created to provide a new regulatory framework for large scale mixed use development in the Regional Activity Center (RAC). This new Zoning District will define specific and integrated and design development standards, phasing plans, infrastructure, and land uses for an urban center. • Temporary use to allow storage of fill on the site. • Text Amendments to the City's Land Development Code (LDC) to allow certain site work (i.e. clearing, fill, infrastructure) before Site Plan approval. • Tree Removal permit in area of lake. • Fill permit for the lake. • Demolition permits for existing buildings and structures (rollercoaster demo permit application has not been submitted). • Temporary fence permit for the perimeter of the site. UPCOMING APPROVALS AND ACTIONS • MPO/FDOT: The developer is currently coordinating a schedule of improvements to the 1-95/ Sterling and 1-95/Griffin Road interchanges with the MPO/FDOT. • Plat: The Plat application was approved at the Planning and Zoning Board agenda on January 20, 2016. The City Commission February 9t' &23`d, 2016. Broward County Plat approval will be scheduled in the 3"d quarter of 2016. Plat approval will include land use, traffic, and utility service. • PMUD Rezoning/DDG's: The Development Design Guidelines (DDG's) are new zoning regulations prepared specifically for this project. These DDG's will be incorporated with the PMUD rezoning property. The application for rezoning will be scheduled for City Commission meetings in the second quarter of 2016. • Phase I/Site Plan: Staff had several meetings with the developer's team on the Site Plan for Phase 1 (area South of West Dania Beach Boulevard) and is awaiting a Td revision. The site plan application will be scheduled for meetings in the second quarter of 2016. • Alcohol Beverage Regulations: These regulations are proposed to allow additional alcohol beverage opportunities and specific regulations for entertainment uses at Dania Pointe. These regulations are being processed with the rezoning schedule. • Sewer Line Construction Agreement: A new sewer line to serve Dania Pointe will be needed. An agreement between the City and the developer to provide for the construction of the new sewer line will be forthcoming. • Street ROW Vacations: Various city street Rights-of-Way (ROW) will need to be vacated for the project.
