AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, APPROVING THE REQUEST MADE BY LINDA C.
STRUTT, AICP, ON BEHALF OF THE PROPERTY OWNERS, DANIA LIVE
1748, LLC AND DISCOUNT AUTO PARTS, INC. C/O ADVANCE STORES
CO., INC. #9183, TO CREATE A PLAT (PL-55-15) TO BE KNOWN AS THE
"DANIA POINTE" PLAT, FOR PROPERTY GENERALLY LOCATED ON
THE NORTH SIDE OF STIRLING ROAD BETWEEN BRYAN ROAD AND
INTERSTATE 95 IN THE CITY OF DANIA BEACH, FLORIDA; ACCEPTING
THE DEDICATION FOR PUBLIC USE OF ALL STREETS, HIGHWAYS,
ALLEYS AND EASEMENTS AS SHOWN ON SUCH PLAT; PROVIDING
FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Chapter 28 "Land Development Code," Part 6, "Development
Review Procedures And Requirements," Article 640, "Plats"of the City Code of Ordinances (the
"City Code"), Linda C. Strutt, AICP, agent on behalf of property owners Dania Live 1748, LLC
and Discount Auto Parts, Inc. C/O Advance Stores Co., Inc. #9183 (the "Applicant") has applied
to the City of Dania Beach (the "City"), for approval of a Plat attached as Exhibit "B," for
property legally described in Exhibit"A" (Application PL-55-15); and
WHEREAS, the City Planning and Zoning Advisory Board, sitting as the Local Planning
Agency, held a duly advertised public hearing on January, 20, 2016 and determined that the
proposed Plat is consistent with the goals and objectives of the City of Dania Beach
Comprehensive Plan (the "Comprehensive Plan") and City Code, and therefore, recommended
approval of the proposed Plat; and
WHEREAS, Section 177.101(2), Florida Statutues, provides in part "...The approval of
a replat by the governing body of a local government, which encompasses lands embraced in all
or part of a prior plat filed of public record shall, upon recordation of the replat, automatically
and simultaneously vacate and annul all of the prior plat encompassed by the replat; and
WHEREAS, the approval and recordation of the proposed Plat will effectively vacate the
underlying plats and platted rights-of-way and easements; and
WHEREAS, the City Commission conducted two (2) duly noticed public hearings in
accordance with law; and
WHEREAS, the City Commission finds that the approval of the proposed Plat is
consistent with the City Code and will protect the public health, safety, and welfare of the
residents of the City, and furthers the purpose, goals, objectives and policies of the
Comprehensive Plan.
NOW,THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. The foregoing "WHEREAS" clauses are ratified and confirmed as being
true and correct and are made a specific part of this Ordinance.
Section 2. That the "Dania Pointe" Plat attached as Exhibit `B" (PL-55-15), for
property generally located on the north side of Stirling Road between Bryan Road and Interstate
95 located within the City of Dania Beach, as legally described in Exhibit "A", a copy of which
is made a part of and incorporated into this Ordinance by this reference, is accepted and
approved. The The City of Dania Beach consents and agrees that such Plat may be recorded in
the Public Records of Broward County, Florida, upon further approval of all agencies of Broward
County, Florida, having jurisdiction in the matter.
Section 3. That the dedication for public use of all streets, highways, alleys and
easements as shown on the "Dania Pointe" plat, is accepted and approved by the City of Dania
Beach.
Section 4. That the vacation of underlying platted Rights-of-Way (ROW) and
Easements is accepted and approved by the City of Dania Beach subject to replat approval and
recordation of"Dania Pointe" Plat.
Section 5. The Applicant shall address the following conditions related to the
proposed Plat prior to recordation of the Plat:
1. The Applicant shall provide Utility Easements to the City for the proposed water main
and force main relocation as proposed by the Applicant. The following may be addressed
by a fully executed and recorded Easement Agreement until such time as the City Utility
Relocation Plan has been finalized and the recording of all necessary Utility Easements:
a. Utility Easements — The proposed plat shows vacation of Tigertail Boulevard Right-
of-Way (ROW), as well as vacation of the existing 30ft utility easement (O.R.B. 13770,
PG 10, B.C.R.). The submitted Utility Relocation Plan dated 10/30/2015 shows the
existing 6" PVC force main and existing 8" PVC water main to remain. The Applicant
shall provide Utility Easements for all existing City owned utilities to remain.

b. Utility Easements — The proposed plat shows vacation of Dania Beach Boulevard
ROW. The Applicant shall provide Utility Easements for the proposed relocation of the
existing 12" water main and 6" force main to be relocated from the Dania Beach
Boulevard ROW.
2. The NVAL shall indicate the necessary minimum width for adequate traffic lanes, as well
as minimum widths necessary for public sidewalks, bicycle lanes and street scaping.
3. The Applicant shall provide 10' sidewalks along Stirling Road and Bryan Road which
may be referenced on the Plat as dedicated public right-of-way (ROW), public easement
or both.
4. The Applicant shall provide final and complete Plat Note references on the Plat.
5. Issuance of a development permit by a municipality does not in any way create any right
on the part of an applicant to obtain a permit from a state or federal agency and does not
create any liability on the part of the municipality for issuance of the permit if the
applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or
federal agency or undertakes actions that result in a violation of state or federal law.
Section 6. That if any section, clause, sentence or phrase of this Ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this Ordinance.
Section 7. That all ordinances or parts of ordinances and all resolutions or parts of
resolutions in conflict with the provisions of this Ordinance are repealed.

Section 8. That this Ordinance shall take effect immediately at the time of its passage
and adoption.
