Call to Order Mayor Salvino called the meeting to order at 5:17 p.m. 2. Roll Call Present: Mayor: Marco A. Salvino, Sr. Vice-Mayor: Albert C. Jones Commissioner: Bobbie H. Grace City Manager: Robert Baldwin City Attorney: Thomas J. Ansbro City Clerk: Louise Stilson Code Attorney: Tim Ryan Absent: Commissioner: Chickie Brandimarte 3. Abatement Requests 3.1 Abatement Request from Isela Millan, 2 SW 6 Avenue, Case #08-0473, (Folio #5042-34-01-2560) Attorney Ryan noted this case involved 12 violations. The fine ran for 2,676 days for a total of $669,149.50, including recording fees of $149.00. The out of pocket cost to the City is $2,200.00. The Special Magistrate recommends an abatement of$66,900.00. Joseph Ryan, attorney representing the property owner, noted the Property Appraiser's office had the wrong address and that is why they never received notice. This is a rental property and the tenants did not advise the owner of the violations, and the City continued to send notices to the incorrect address even after learning of the correct mailing address. Commissioner Grace motioned to abate the lien to $20,000.00, to be paid in 90 days; seconded by Mayor Salvino. The motion carried unanimously. 3.2 Abatement Request from Joseph Herold, 4542 SW 25 Avenue, Case #12-1026 (Folio #0229-05-0580) Attorney Ryan noted this case involved 5 violations. The fine ran for 774 days for a total of $161,371.00, including the recording/admin fees of$271.00. The out of pocket cost to the City is $1,500.00. The Special Magistrate recommends an abatement of $8,880.00. He noted the applicant requested a continuance until the June 1, 2016 Abatement Hearing. Vice-Mayor Jones motioned to continue the abatement hearing until the June 1, 2016 Abatement Hearing; seconded by Commissioner Grace. The motion carried unanimously. 3.3 Abatement Request from HYH Management LLC, 2330 SW 44 Street, Case #14- 1200 (Folio#0229-01-1472) Attorney Ryan noted this case involved 2 violations. The fine ran for 314 days for a total of $78,904.00, including recording/admin fees of $404.00. The out of pocket cost to the City is $1,200.00. The Special Magistrate recommends an abatement of$7,850.00. Ariel Chapnick, representing the homeowner, noted her clients live in Israel. They hired a general contractor who did not obtain permits or complete the work, and they have been unable to find him. They hired a new contractor who obtained permits and finished the work. Vice-Mayor Jones motioned to abate the lien to $3,950.00, to be paid in 90 days; seconded by Commissioner Grace. The motion carried unanimously. 3.4 Abatement Request from BH-NV Dania Properties LLC, 5426-5430 SW 25 Avenue, Case#14-2072 (Folio#0232-32-0650) Attorney Ryan noted this case involved 4 violations that were split into two orders. The fine for violations 1 & 4 ran for 224 days for a total of$33,600.00. The fine for violations 2 & 3 ran for 154 days for a total of$30,800.00. The recording/admin fees were $262.50, which brings the total amount due to $64,662.50. The out of pocket cost to the City is $1,200.00. The Special Magistrate recommends an abatement of$6,400.00. Carlos Lopez, on behalf of BH-NV Dania Properties, LLC, noted the property was purchased through foreclosure. The violations were pre-existing prior to the purchase of the property. Vice-Mayor Jones motioned to abate the lien to $6,400.00, as recommended by the Special Magistrate, to be paid in 90 days; seconded by Commissioner Grace. The motion carried unanimously. 3.5 Abatement Request from SDS Development, & Trust LLC, 2632 W Griffin Road, Case#14-2335 (Folio#0232-02-0440) Attorney Ryan noted this case involved 2 violations. The fine ran for 212 days for a total of $42,712.50, including recording/admin fees of $312.50. The out of pocket cost to the City is $1,200.00. The Special Magistrate recommends an abatement of$4,240.00. Minutes of Abatement Hearing 2 Dania Beach City Commission Wednesday,March 2,2016—5:00 p.m. Michael Bloom, representing the applicant, noted the property consists of two lots and one side was not being cut because the contractor was unaware he was to cut both lots. He requested abatement to City costs. Commissioner Grace motioned to abate the lien to $1,200.00, to be paid in 30 days; seconded by Vice-Mayor Jones. The motion carried unanimously. 3.6 Approval of the settlement received for William DiBlasio, 313 SW 15 Street, Case #07-2834, for$1,900.00 due to foreclosure Commissioner Grace motioned to approve the settlement agreement; seconded by Vice- Mayor Jones. The motion carried unanimously. 3.7 Approval of the settlement received for Judith Williams, Lakeshore Drive, Case # 07- 0336, for $1,200.00 due to lien settlement Commissioner Grace motioned to approve the settlement agreement; seconded by Vice- Mayor Jones. The motion carried unanimously. 3.8 Approval of the settlement received for Robert Allen & Doug NHI, 1327 SE 2 Avenue, Case#08-0012, for$6,500.00 due to sale of property Commissioner Grace motioned to approve the settlement agreement; seconded by Vice- Mayor Jones. The motion carried unanimously. 3.9 Approval of the settlement received for Julius Freeman, 223 SW 8 Street, Case #08- 1376, #11-1606 and#12-1075, for$3,500.00 due to sale of property Commissioner Grace motioned to approve the settlement agreement; seconded by Vice- Mayor Jones. The motion carried unanimously. 3.10 Approval of the settlement received for Kathleen Joyce Rivers, 279 SW 8 Street, Case#08-1668, for$6,500.00 due to sale of property Commissioner Grace motioned to approve the settlement agreement; seconded by Vice- Mayor Jones. The motion carried unanimously. 3.11 Approval of the settlement received for EQR-Paradise Point Vistas Inc., 530 SE 12 Street, Case#12-0082, for$5,437.00 due to lien settlement Commissioner Grace motioned to approve the settlement agreement; seconded by Vice- Mayor Jones. The motion carried unanimously. 3.12 Approval of the settlement received for N&D Holdings Inc., 2822 Griffin Road, Case #13-0063,#14-0739 and#14-0744, for$21,800.00 due sale of property Minutes of Abatement Hearing 3 Dania Beach City Commission Wednesday,March 2,2016—5:00 p.m. Commissioner Grace motioned to approve the settlement agreement; seconded by Vice- Mayor Jones. The motion carried unanimously. 3.13 Approval of the settlement received for Kattie Sherman Est., c/o Damon Gamble & Willie Lee Taylor, 18 SW 7 Avenue, Case#14-0859, for$2,500.00 due to sale of property Commissioner Grace motioned to approve the settlement agreement; seconded by Vice- Mayor Jones.
