A RESOLUTION OF THE CITY COMMISISON OF THE CITY OF DANIA
BEACH, .FLORIDA, APPROVING A VARIANCE (VA-118-15) REQUEST
SUBMITTED BY STEPHANIE YAP/BRB, BIKE, RUN, AND BREWS, ON
BEHALF OF THE PROPERTY OWNER DANIANS CORP., FROM CHAPTER
28, "ZONING", SECTION 110-50 "PROXIMITY OF BEVERAGE
ESTABLISHMENTS TO OTHER ESTABLISHMENTS AND USES", FOR
PROPERTY LOCATED AT 601 EAST DANIA BEACH BOULEVARD IN THE
CITY OF DANIA BEACH FLORIDA; PROVIDING FOR CONFLICTS;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28 (the City's Land
Development Code,the"LDC"),"Zoning",Section 110-50,"Proximity of Beverage Establishments
to Other Establishment and Uses",prescribes the separation requirements for the sale of alcohol for
businesses located within the City of Dania Beach; and
WHEREAS,pursuant to article 625, "Variances", of the LDC, Stephani Yap/BRB, Bike,
Run, Brews, on behalf of the property owner,Danians Corp., is requesting a variance from Section
110-50 of the LDC for separation of uses for property located at 601 East Dania Beach Boulevard in
the City of Dania Beach as legally described in Exhibit"A"; and
WHEREAS,the proposed business is requesting to sell alcohol less than one thousand feet
(1,000')from another business selling alcohol;Code requires a one thousand foot(1,000')separation
per LDC, Section 110-50; and
WHEREAS, the applicant has provided in its application sufficient justification
demonstrating compliance with the approval criteria to meet the requirements of the Code; and
WHEREAS, public notice was provided in accordance with law; and
WHEREAS,the City Commission finds that approval of the requested variance is consistent
with the City's Code and Comprehensive Plan;
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. The foregoing"WHEREAS" clauses are ratified and confirmed as being true
and correct and are made a specific part of this Resolution.
Section 2. That the certain application VA-118-15 requesting a variance from the
requirements in Chapter 28 (LDC), "Zoning", Section 110-50, "Proximity of beverage
establishments to other establishments and uses" of the City Code of Ordinances is approved to
allow the sale of alcohol within one thousand feet (1,000') from another business also selling
alcohol.
Section 3. Issuance of a development permit by a municipality does not in any way create
any right on the part of an applicant to obtain a permit from a state or federal agency and does not
create any liability on the part of the municipality for issuance of the permit if the applicant fails to
obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes
actions that result in a violation of state or federal law.
Section 4. That pursuant to LDC Section 625-50 entitled"Expiration of Variances",the
variance (VA-118-15) approval shall expire and become null and void and shall expire unless the
applicant obtains a building permit to implement the improvements for which the approval is secured
within one hundred and eighty (180) days and submits all applications for any additional required
development permits including construction drawings(if applicable)within eighteen(18)months of
the date of this approval.
Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 6. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
