A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, REQUESTING APPROVAL FROM THE CITY
COMMISSION TO APPROVE A BID ADVERTISEMENT FOR THE
SOUTHWEST 26' TERRACE DRAINAGE IMPROVEMENT PROJECT;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on September 27, 2011, the City Commission adopted Ordinance No. 2011-
032, which provides that all City Departments, Divisions and City staff must seek advance City
Commission approval by Resolution prior to bidding by placing an item on a City Commission
Agenda for formal City Commission conceptual approval by Resolution of any proposed capital
project or capital purchase appropriated in the City budget approved by the City Commission,
when bidding would otherwise be required, which Resolution shall also identify all sources of
planned funding, including appropriations of available cash balances, loans and grants; and
WHEREAS, in March, 2009, the City Commission approved the contracting of
professional engineering services to be provided by Chen Moore and Associates, Inc., for a
Stormwater Capital Drainage Improvement Project in the Southwest 26th Terrace area under
Resolution#2009-039 in an amount not to exceed $114,198.00; and
WHEREAS, in July, 2012, the City Commission approved an additional services
agreement in the amount not to exceed$36,400.00; and
WHEREAS, the implementation of this project had been delayed pending
implementation and completion of the Florida Department of Transportation (FDOT) drainage
outfall connection to the FPL cooling ponds and eventually providing for drainage into the
North New River Canal (FDOT Project ID No. 432797-1-52-01); and
WHEREAS, the FDOT drainage work is nearing completion with the construction of
the drainage culvert system across Southwest 30th Avenue; and
WHEREAS, the construction plans for SW 261h Terrace Drainage Improvements and
the surface water management license permit from Broward County are now secured for the
project; and
WHEREAS, funding is available with a remaining fund balance of$719,472.00 in the
stormwater fund;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF DANIA BEACH, FLORIDA:
Section 1. That the above "Whereas" clauses are true and correct, and they are made
a part of and are incorporated into this Resolution by this reference.
Section 2. That the City Commission authorizes City administration to proceed with
advertisement of the Project known as the Southwest 26th Terrace Drainage Improvement
Project.
Section 3. That a funding appropriation is available in account number 403-38-28-
538-31-10 in the amount of$719,472.00
Section 4. That all resolutions or part of Resolutions in conflict with any of the
provisions of this Resolution are repealed.
Section 5. That this Resolution shall become effective immediately upon its passage
and adoption.
