HomeMy WebLinkAboutR-2016-049 Approves Site Plan Modification (SP-69-13MOD1) & Variance (VA-50-16) Submitted by Lawrence Cramer for Village At Dania Beach, L.L.C. for 180 East Dania Beach Boulevard RESOLUTION NO. 2016-049 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING A SITE PLAN MODIFICATION (SP-69- 13MOD1) AND VARIANCE (VA-50-16) SUBMITTED BY LAWRENCE KRAMER ON BEHALF OF VILLAGE AT DANIA BEACH, LLC, FOR PROPERTY LOCATED AT 180 EAST DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,Chapter 28 of the Code of Ordinances of the City of Dania Beach(the"Code"), which chapter contains the City Land Development Code (the "LDC"), pursuant to Part 6, "Development Review Procedures and Requirements",Section 635,states that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS,Chapter 28,Part 6,Article 625 of the LDC states that a variance approval may be granted by the City Commission at the time of site plan approval; and WHEREAS,Lawrence Kramer,on behalf of Village at Dania Beach,LLC(the"Applicant"), is requesting site plan modification approval(SP-69-13MOD1)and variance approval(VA-50-16), for property legally described in attached Exhibit"A",which is made a part of and is incorporated into this Resolution by this reference; and WHEREAS, previously, a site plan (SP-69-13) was approved on March 25, 2014, which allowed construction of a mixed use,seven-story building totaling approximately 83,875 square feet and containing 144 multi-family units, called "The Place at Dania Beach", which is under construction and located at 180 E Dania Beach Boulevard in the City of Dania Beach; and WHEREAS,site modifications have been identified by the Applicant,which are necessary to conform building exterior colors with those colors shown in the project renderings exhibited at City Hall since site plan approval was obtained, as well as to provide for four total paint colors as indicated in the building elevations described in attached Exhibit"B"; and WHEREAS,site modifications have been identified by the Applicant,which are necessary to improve building signage at the primary multi-family entrance near the corner of East Dania Beach Boulevard and SE 2nd Avenue, in full compliance with the Section 505 Sign Regulations of the Code, as described in the Master Signage Plan attached as Exhibit"C"; and WHEREAS,the Applicant is requesting variance approval to remove from the approved site plan four(4)on-street parking spaces on the south side of SE Park Street as shown in the revised Site Plan attached as Exhibit "D", so as to enhance the private, quiet nature of the street, while better preserving the character,health,safety and welfare of the community;this small reduction in parking reduces the total parking count for the project from 260 spaces to 256, a 1.5% reduction which causes minimal disruption to the Applicant in exchange for substantial benefit to the community;and WHEREAS, on February 25, 2016, the City's Development Review Committee (the "DRC"), which includes representatives from the Broward Sheriff's Office Fire, Public Services Department,the City's landscape consultant and the Planning Division staff,reviewed the site plan modifications for compliance with all applicable regulations; and WHEREAS,staff recommends approval of the site plan modification to exterior colors,site plan modification to signage, and parking variance for the mixed use project; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the City's LDC; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct, and they are made a specific part of this Resolution. Section 2. That those certain applications for site plan modification(SP-69-13MOD1) and variance respectively, (VA-50-16) copies of which are attached as composite Exhibit `B", Exhibit"C",and Exhibit"D",which are made a part of and incorporated into this Resolution by this reference, are approved. Section 3. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5.
