TUESDAY, APRIL 26, 2016 - 7:00 P.M.
1. Call to Order/Roll Call
Mayor Salvino called the meeting to order at 7:00 p.m.

Mayor Salvino called for a moment of silence followed by the Pledge of Allegiance to the United
States Flag.

5. Citizen Comments
Paula Winters, 545 SE 12d' Street, was present to support the Fire Fighters and favored not
reducing their number on rescue units.
Russell Thompson, 7771 W Oakland Park Boulevard, said he is a guardian for Honor Flight
South Florida and will represent a Dania Beach resident. They honor these heroes home and
would like residents to meet them at the airport on May 21 sc
James Dee, 217 SE 2nd Terrace, spoke in support of having three Fire Fighters on rescue units.
Walter Dix, President of Broward County Fire Fighters, asked the Commission to vote against
Item#10.1.
Teddy Bohanan, 312 SW 15 Street, said she has fought crime and drugs in this City for many
years; it is still happening in her neighborhood, and we need more police in the City.
Roberta Grimmer, 5250 SW 22°d Avenue, spoke in support of the Fire Fighters.
Jeffrey Hatcher, 125 NW 7 h Avenue, commented he supports First Responders, no matter what
it takes.
Anna Hadley, 2961 SW 54t' Street, Ft. Lauderdale, said we need more Fire Fighters, and we
need to support them.
Janine Rice, 233 SW 4d' Street, spoke in support of First Responders and a three-person team.
Michael Thomas, 327 SE 7d' Street, spoke in support of Police and First Responders.
6. Public Safety Reports
Captain Daniel Marks, BSO Chief of Police,provided an update on recent criminal activity.
Lieutenant Dan Suarez, BSO Fire Rescue, recognized the Fire Fighters from Station 1, Station
17, and Station 32 for responding to a house fire where they rescued many dogs. He also noted
the CarFit program went well, and BSO is establishing another program for child safety.

City Attorney Ansbro read the title of Resolution#2016-040.
Vice-Mayor Jones asked about illumination and what the County's share of the cost of electricity
and maintenance would be since this is a County road. He also questioned installation of
sidewalks.
Brad Kaine, Director of Public Services, said he would need to look at the agreement to know
the costs.
Vice-Mayor Jones motioned to adopt Resolution #2016-040; seconded by Commissioner
Grace. The motion carried unanimously.
7.5 RESOLUTION#2016-042

City Attorney Ansbro read the title of Resolution#2016-042.
Vice-Mayor Jones said there are several items on the agenda for this vendor, and questioned
what they are doing.
City Manager Baldwin noted most of the items deal with Dania Pointe.
Marc LaFerrier, Director of Community Development, explained there are numerous
applications for Dania Pointe that are going through various agencies, and this contractual

service agreement covers the cost of the firm attending those meetings. He noted that all of these
costs will be paid for by the developer as they are all cost recovery.

7.9 RESOLUTION#2016-046

City Attorney Ansbro read the title of Resolution#2016-046.
Vice-Mayor Jones said he heard residents who attended the community meeting are okay with
eliminating a lane, but questioned how the lane changing into a bicycle lane would work.
Marc LaFerrier, Director of Community Development, explained the 6-lane section of Dania
Beach Boulevard would be reduced by the State to four lanes, and sidewalks, bike lanes and
landscaping would be installed. It can work because the third lane will be used as
bicycle/pedestrian/turn lanes.
Vice-Mayor Jones motioned to adopt Resolution #2016-046; seconded by Commissioner
Grace.
Commissioner Brandimarte commented she attended the meeting, and 30 homeowners attended.
The part she has a problem with is the bikes have the right of way in the traffic lane when the
street narrows at the bridge.
Community Development Director LaFerrier noted this is in preliminary design and he will ask
FDOT if there is another way to accommodate the cyclists. There will be an opportunity for the
City to look at it again before the final design.
Commissioner Grace withdrew her second. The motion failed.

7.11 RESOLUTION#2016-050

City Attorney Ansbro read the title of Resolution#2016-050.
Commissioner Grace questioned the need for another Special Magistrate.
City Attorney Ansbro noted this is for one meeting that neither of our two Special Magistrates is
able to attend.
Mayor Salvino motioned to adopt Resolution #2016-050; seconded by Commissioner
Grace. The motion carried unanimously.
8. Bids and Requests for Proposals
8.1 RESOLUTION#2016-048
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,REQUESTING
APPROVAL FROM THE CITY COMMISSION TO APPROVE A BID ADVERTISEMENT FOR THE
SOUTHWEST 26TH TERRACE DRAINAGE IMPROVEMENT PROJECT; PROVIDING FOR CONFLICTS;
FURTHER,PROVIDING FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution#2016-048.
City Manager Baldwin noted this project has been planned for several years.
Commissioner Grace motioned to adopt Resolution #2016-048; seconded by Vice-Mayor
Jones. The motion carried unanimously.
9. Public Hearings and Site Plans
9.1 RESOLUTION#2016-049
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING
A SITE PLAN MODIFICATION (SP-69-13MOD1) AND VARIANCE (VA-50-16) SUBMITTED BY
LAWRENCE KRAMER ON BEHALF OF VILLAGE AT DANIA BEACH, LLC, FOR PROPERTY LOCATED
AT 180 EAST DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING
FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE.
City Attorney Ansbro read the title of Resolution #2016-049 and advised it was a quasi-judicial
hearing and swore-in those who would speak. He asked the Commission to disclose any
communication they had on this matter.
Marc LaFerrier, Director of Community Development, explained the request for the Dania Place
prof ect.
Hunter Holton, Director of Development, AHS Development Group, presented renderings of the
proposed changes,which were included in the agenda packet.

Commissioner Grace noted we want to make sure new projects are appealing, and questioned the
colors that are proposed. Mr. Holton presented paint chips of the true colors.
Mayor Salvino opened the Public Hearing. Seeing as there was no one to speak in favor or
opposition, he closed the Public Hearing.
Commissioner Grace motioned to adopt Resolution #2016-049; seconded by Vice-Mayor
Jones. The motion carried unanimously.
10. Discussion and Possible Action
10.1 Discussion on SAFER Staff
City Manager Baldwin said the SAFER Grant does not correspond with the fiscal year calendar;
the grant expires on May 15. He noted we need bridge funds to fund this program until October
1st, and that he supports the 3-man med unit. He provided the history on the SAFER Grant and
the transition to the Broward Sheriffs Office for fire services. He said we are not eligible to
apply for the SAFER Grant again and the Sheriff is unwilling to continue to pay for any portion
of the cost. The City does not have the money to continue to fund the 3-man med unit for this
fiscal year. He has learned that Station 1 is the busiest fire station in the Sheriffs service; he
thought we had enough money that we could fund Station 1 for the balance of the year. A
separate part of that is he would also like to add a couple of deputies for police services. The 2-
man unit is an adequate level of service, and he is recommending the compromise suggested by
the Broward Sheriffs Office. The 3-man med unit is an expensive proposal for next year;
adding 9 people to the fire department is an 18% increase.
City Manager Baldwin proposed that we fund Station 1 only as a 3-man med unit for the
remainder of this fiscal year, and fund 2 additional deputies from the General Fund Contingency.
Commissioner Grace said we need 3 people on the med unit; although there is a need, we will
not discuss police officers tonight because tonight is about the fire personnel. Her vote is to keep
the 9 fire fighter/paramedics, regardless of the cost.
Vice-Mayor Jones noted he is not against fire fighters or safety, but we do not want to spend
money we do not have. He is willing to work with the Fire Department and the Union to make
sure we are safe. He said Station 1 is the busiest and we would be compromising by funding a 3-
man unit there. He told the City Manager we need to get figures to fund the one station, and
possibly fund Station 17 later on. He hopes there is cooperation with the Commission in support
of this plan.
City Manager Baldwin noted his understanding is that our station runs calls all the way to
Sunrise Boulevard and Pembroke Park; we also run far more calls to Hollywood than they do to
Dania Beach. He would like to get data about these calls from Fire Administration.

Vice-Mayor Jones said the City Manager's plan is a great compromise and hopes the Broward
County fire fighters see this.
Commissioner Brandimarte commented she asked the Sheriff if the 2-man unit was safe, and he
said absolutely. She added this Commission does not negotiate with the Fire Department; it is
the fire fighters' obligation to negotiate with the Sheriff. She asked Mr. Dix to come to the
podium.
Mr. Dix said the union does not negotiate staffing in Dania Beach with the Sheriff, the City does.
The Commission has to establish the level of service. He does not think it is unsafe to run a 2-
man unit; however, it is about the higher level of care that can be provided with a 3-man unit.
He spoke to the Sheriff and he said he is not comfortable with trading fire fighters for police
officers; this should be discussed separately. He noted concurrent call rates are very high in
Dania Beach, which is not considered in the statistics.
Commissioner Brandimarte said she feels we need the 3-man unit at Station 1, not Station 17.
We also need more facilities for the fire department as the City grows. She noted an 18%
increase would mean a tax increase.
Mr. Dix stated no compromise was ever offered to the union, and they were not involved in any
of the discussions.
City Manager Baldwin confirmed he did not negotiate with the union; he negotiates with Fire
Administration. Chief Stravino asked him if he would compromise and fund 5 people for Station
1.
Commissioner Fetscher said safety of citizens is our number one priority; however, we need to
be able to pay for it. Compromise is where we need to be; when our tax base expands, we can
fund it.
Mayor Salvino commented we will need more fire facilities and employees when Dania Pointe
comes on board, and then we can expand. Right now we need the Sheriff to be able to fund this
so that next year we can trim our budget and keep all 9 guys on. He added perhaps we could
extend it for 30 days and see what the Sheriff can negotiate; this is strictly a money issue.
Mr. Dix stated the City has a lot of money in reserves.
Nicki Satterfield, Finance Director, explained that from a financial perspective, her
recommendation is to not fund anything tonight. This cost tonight, for 5 people, extrapolated
over next year, is approximately $700,000.00; the cost for 9 is $1.2 million. She is asking the
Commission to wait until the property tax values come in and we can see where we are. She said
taking money from reserves is a one-time grab, and reiterated her recommendation to wait until
we have all the financial information. She noted there is a $1.2 million increase in the Fire
pension fund next year. Our reserve balance is at $15 million, with $3 million set aside as a
bridge loan to the stormwater fund; the remaining $12 million is 25-26% of the General Fund

operating budget, which is within the Commission's debt policy and GFOA recommended
amount.
City Manager Baldwin noted he still recommends the compromise.
Responding to Commissioner Brandimarte, Finance Director Satterfield explained the increase in
pension is expected, and the pension obligation is over $6.2 million next year. The $1.2 million
increase would either come from budget cuts, the reserve, or increasing tax rates, which equates
to a 7% tax increase. She reviewed the costs for the 5-man unit for the remainder of this year
and for next year.
City Manager Baldwin added we do not have the information to make the recommendation for
next year.
Commissioner Brandimarte motioned to go with the City Manager's Plan; seconded by
Commissioner Fetscher. The motion carried on the following 3-2 vote:

10.2 Annexation of Property Located at 1005 E. Dania Beach Boulevard
Ilene Michelson, on behalf of the property owner, asked if the City was interested in annexing
the property from Hollywood and how the two cities could work together to make this happen.
The property is a vacant lot with no vegetation on it. She provided new handouts, which are
attached to and included in these minutes, and gave an overview of the subject property. She
said Hollywood would like to know whether or not Dania Beach is interested in annexing this
property, and spoke of the Chapter 164 process as an option to do so. This property should be in
Dania Beach and should be consistent with the development in the CRA.
Commissioner Brandimarte noted there is no letter from Hollywood saying they are willing to
de-annex this property. She said her understanding is that Hollywood is going back to Broward
County to see if they would purchase the piece of land. As such, she cannot support anything
until Hollywood contacts us first.
Mrs. Michelson stated Dania Beach has a different vision than Hollywood, and the developers
are more consistent with the vision of Dania Beach. Hollywood zoning is C-2; Dania Beach
zoning would be Mixed Use, like the downtown CRA. Her question is whether or not the
Commission has an interest in having this land developed consistent with Dania Beach uses, and
if so,what is the best way to get the dialogue going to reach an agreement.
Mayor Salvino commented the property is on Dania Beach Boulevard, not Hollywood
Boulevard, and Hollywood could put any commercial development on the property. He
questioned what harm there is to have the City Manager call Hollywood and see what happens.

Commissioner Fetscher said we are looking for a broader tax base so that we can afford what we
want; we should take the property.
City Manager Baldwin noted he has had several conversations with Hollywood; the Hollywood
City Manager recommended to his commission that it not be annexed. He, as City Manager of
Dania Beach, will not take a position on this until his commission takes a position.
City Attorney Ansbro advised that, as desirable as this would be for our City, we need to
understand that Hollywood cannot be made to give it to us. They have to offer it to us by
contraction, and then the annexation process would proceed.
Vice-Mayor Jones questioned where Hollywood would get water and police services if they
decide to develop; we would be asked to be a good neighbor. He felt if they are willing to
voluntarily give it to the City, most of the Commissioners would be okay with annexing it.
There was Commission consensus for the City Manager and City Attorney to get dialogue going
with the City Manager of Hollywood that we are interested in having the property annexed into

City Manager Baldwin clarified that the City Commission is directing him and the City Attorney
to contact the City of Hollywood and express the Commission's position that they would be
willing to annex that property if they are interested in annexing it to us.
10.3 Establishment of Special Permit Office — Marc LaFerrier, Director of Community
Development
Marc LaFerrier, Director of Community Development, noted we will be doubling our workload
with all the development proposed in the next few years. To handle this, a separate office for the
additional contracted staff would be established, with all costs derived from building fees. He
expects the plans for the larger development to begin coming in in July or August. Staff
recommends approval and the recommended changes would be presented in the next agenda.
Commissioner Grace asked if staff is overworked. Community Development Director LaFerrier
responded staff is working well with the amount of additional work they have gotten over the last
several years, but the expected doubling of the workload would overload them.
Vice-Mayor Jones noted he said in a prior Commission meeting to bring in an outside company,
and here we are. He added he supports it because he knows the need is there.
Commissioner Brandimarte questioned who will pay for this office, and Community
Development Director LaFerrier said the additional staff would be paid for by developers and
contractors. He confirmed this is on a temporary basis. Commissioner Brandimarte noted she
supports this.
Commissioner Fetscher said going to the private sector to do these kinds of things will
eventually allow us to be able to afford the extra fire fighters and police.

Mayor Salvino felt this is good timing and the building department stays intact, the way it is. He
asked if Broward County could provide additional staff. Community Development Director
LaFerrier said they can, but he wants to diversify in order to prevent getting behind if the County
would happen to come up short.
The Commissioners were in agreement to proceed.
10.4 Schedule City Commission Summer Break
Vice-Mayor Jones motioned to cancel the July 12, 2016 and August 9, 2016 City
Commission meetings; seconded by Commissioner Grace. The motion carried
unanimously.

Commissioner Brandimarte spoke of Vice-Mayor Jones receiving the Spirit of Healing Award
and of Harriett Tubman. She congratulated and thanked Community Development Director
LaFerrier.

Commissioner Grace said NW Byrd Point wants Community Development Director LaFerrier to

Vice-Mayor Jones spoke of the Spirit of Healing Award he recently received.
Vice-Mayor Jones noted trash cans are left out all day every day because of the pickup schedule,
and he is unsure how we can overcome this issue.
Commissioner Grace suggested placing a notice on the water bills.

13.1 City Manager
City Manager Baldwin noted the Melaleuca wall is repaired, the Dania Beach Boulevard Bridge
is partially open, and no dump signs are being installed on the FEC right-of-way.
13.2 City Attorney
City Attorney Ansbro noted Broward County is seeking Commission permission to store clean
fill next to the Hilton site for 60 days in connection with airport work.
Commissioner Grace motioned to approve allowing the County to store clean fill for 60
days; seconded by Vice-Mayor Jones.
Community Development Director LaFerrier explained where the fill is coming from and
confirmed it is clean.
The motion carried unanimously.
Mayor Salvino noted at the airport staging area on loth Street, dump trucks are coming out of the
site and because the stop sign says right turn only, they are going through Melaleuca Gardens
and they are tearing up our streets. There are no weight or axle restrictions on the street.
City Attorney Ansbro suggested we could post it.

F.S. §164.1052 Initiation of conflict resolution procedure; duty to give notice.—
(1) The governing body of a governmental entity shall initiate the conflict resolution
procedures provided by this act through passage of a resolution by its members. The resolution
shall state that it is the intention of the governing body to initiate the conflict resolution
procedures provided by this act prior to initiating court proceedings or prosecuting action on a
previously filed court proceeding to resolve the conflict and shall specify the issues of conflict
and the governmental entity or entities with which the governing body has a conflict. Within 5
days after the passage of the resolution, a letter and a certified copy of the resolution shall be
provided to the chief administrator of the governmental entity or entities with which the
governing body has a conflict by certified mail, return receipt requested. The letter shall state, at
a minimum,the conflict, other governmental entities in conflict with the initiating governmental
entity,the justification for initiating the conflict resolution process,the proposed date and
location for the conflict assessment meeting to be held pursuant to s. 164.1053, and suggestions
regarding the officials who should be present at the conflict assessment meeting. The initiating
governmental entity also shall mail a copy of the letter and resolution to any state, regional, or
local governmental entities which, in the determination of the initiating governmental entity, may
have a role in approving or implementing a particular element or aspect of any settlement of the
conflict or whose substantial interests may be affected by the resolution of the conflict, and any
other governmental entity deemed appropriate by the initiating governmental entity.
(2) Within 10 days after receiving a copy of a certified letter noticing the initiation of the
conflict resolution procedure, other governmental entities receiving the notice may elect to
participate in the conflict resolution process, but are not entitled by virtue of that participation to
control the timing or progress of the conflict resolution process, which at all times shall remain
in the discretion of the primary conflicting governmental entities. However, a governmental
entity which receives notice of a conflict may, by passage of its own resolution and by otherwise
following the procedures set forth in subsection(1),join the conflict resolution process as a
primary conflicting governmental entity. The intent of a governmental entity to join in the
conflict resolution process shall be communicated to the initiating governmental entity by
certified mail. The joining governmental entity also shall mail a copy of the letter to any state,
regional, or local governmental entities which, in the determination of the joining governmental
entity, may have a role in approving or implementing a particular element or aspect of any
settlement of the conflict or whose substantial interests may be affected by the resolution of the
conflict, and any other governmental entity deemed appropriate by the joining governmental
entity.
(3) For purposes of this act, the date of initiation of the conflict resolution procedure shall be
the date of the passage of a resolution by a governmental entity.
F.S. §164.1053 Conflict assessment phase.—
(1) After the initiation of the conflict resolution procedure, and after proper notice by certified
letter has been given, a conflict assessment meeting shall occur. The meeting shall be scheduled
to occur within 30 days of the receipt of the letter initiating the conflict resolution procedure.
Public notice shall be given for this meeting in accordance with s. 164.1031(7). The conflict
assessment meeting shall be scheduled to allow the attendance by the appropriate personnel from
each primary conflicting governmental entity. The chief administrator, or his or her designee, for
each governmental entity that is a primary conflicting governmental entity in the conflict
resolution procedure shall be present at this meeting. If the entities in conflict agree,the

assistance of a facilitator may be enlisted for the conflict assessment meeting. During the conflict
assessment meeting, the governmental entities shall discuss the issues pertaining to the conflict
and an assessment of the conflict from the perspective of each governmental entity involved.
(2) If a tentative resolution to the conflict can be agreed upon by the representatives of the
primary conflicting governmental entities at the conflict assessment meeting, the primary
conflicting governmental entities may proceed with whatever steps they deem appropriate to
fully resolve the conflict, including, but not limited to, the scheduling of additional meetings for
informal negotiations or proposing a resolution to the governing bodies of the primary
conflicting governmental entities.
(3) In the event that no tentative resolution can be agreed upon, the primary conflicting
governmental entities shall schedule a joint public meeting as described in s. 164.1055, which
meeting shall occur within 50 days of the receipt of the first letter initiating the conflict
resolution process from the initiating governmental entity.
(4) After the conclusion of the conflict assessment meeting, any primary conflicting
governmental entity may request mediation as provided in s. 164.1055(2).
F.S. §164.1055 Joint public meeting.—
(1) Failure to resolve a conflict after following authorized procedures as specified in s.
164.1053 shall require the scheduling of a joint public meeting between the primary conflicting
governmental entities. The governmental entity first initiating the conflict resolution process
shall have the responsibility to schedule the joint public meeting and arrange a location. If the
entities in conflict agree, the assistance of a facilitator may be enlisted to assist them in
conducting the meeting. In this meeting,the governing bodies of the primary conflicting
governmental entities shall:
(a) Consider the statement of issues prepared in the conflict assessment phase.
(b) Seek an agreement.
(c) Schedule additional meetings of the entities in conflict, or of their designees,to continue to
seek resolution of the conflict.
(2) If no agreement is reached, the primary conflicting governmental entities shall participate
in mediation, the costs of which shall be equally divided between the primary conflicting
governmental entities. The primary conflicting governmental entities shall endeavor in good faith
to select a mutually acceptable mediator. If the primary conflicting governmental entities are
unable to mutually agree on a mediator within 14 days after the joint public meeting, the primary
conflicting governmental entities shall arrange for a mediator to be selected or recommended by
an independent conflict resolution organization, such as the Florida Conflict Resolution
Consortium, and shall agree to accept the recommendation of that independent organization, or
shall agree upon an alternate method for selection of a mediator, within 7 business days after the
close of that 14-day period. Upon the selection of a mediator, the conflicting governmental
entities shall schedule mediation to occur within 14 days, and shall issue a written agreement on
the issues in conflict within 10 days of the conclusion of the mediation proceeding. The written
agreement shall not be admissible in any court proceeding concerning the conflict, except for
proceedings to award attorney's fees under s. 164.1058, where the agreement may be used to
demonstrate an entity's refusal to participate in the process in good faith.
F.S. §164.1057 Execution of resolution of conflict.—Resolution of a conflict at any phase shall
require passage of an ordinance, resolution, or interlocal agreement that reflects the terms or
conditions of the resolution to the conflict.
