RESOLUTION NO. 2016-067 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING A SPECIAL EXCEPTION (SE-24-16) TO ALLOW A CO-LOCATION OF A STEALTH ANTENNA CANISTER AND RELATED EQUIPMENT ON A FLORIDA POWER & LIGHT COMPANY SUBSTATION UTILITY POLE IN ACCORDANCE WITH A SITE PLAN(SP-25- 16)AND LANDSCAPE VARIANCE(VA-40-16)SUBMITTED BY DEBORAH L. MARTOHUE, ESQUIRE, WITH MARTOHUE LAND USE LAW PA, ON BEHALF OF T-MOBILE SOUTH, LLC FOR PROPERTY LOCATED AT 3801 SOUTHWEST 43"D COURT, ALSO KNOWN AS 4750 SW 42°d AVENUE, IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 28, Part 8 of the Land Development Code (the "LDC"), Article 835 entitled"Telecommunications,Towers and Antennas"and specifically Section 835-50(C)(3) states that stealth antennas shall be permitted as a special exception in the ("C-2") Commercial zoning district upon approval by the City Commission; and WHEREAS,Deborah L.Martohue,Esquire with Martohue Land Use Law PA,on behalf of T-Mobile South LLC ("the Applicant") is requesting a special exception to allow a stealth antenna canister co-location on a Florida Power & Light Company ("FPL") utility pole along with the associated ground equipment in the Commercial("C-2")zoning district,per Section 835-50(C)(3)of the LDC; and WHEREAS, Chapter 28, Part 6 of the LDC, Article 635, entitled "Development Review Procedures and Requirements", states that site plan approval is required as a condition precedent to the issuance of a building permit; and WHEREAS, the Applicant is requesting site plan approval to allow the co-location of a twelve foot(12')stealth antenna canister atop a seventy-eight foot(78')FPL utility distribution pole with an associated three hundred(300)square foot secure equipment compound in accordance with the plans prepared by Caltrop Telecom,consisting of six(6)sheets date last revised April 5,2016 to be located at 3801 Southwest 43rd Court (aka 4750 SW 42 Avenue) in the City of Dania Beach, Florida, commonly referred to as the Playland FPL substation(SP-25-16); and WHEREAS,the subject property is legally described in attached Exhibit"A",which is made a part of and is incorporated into this Resolution by this reference; and WHEREAS, Article 630 of the LDC,entitled"Special Exception Uses",states that the City Commission may grant a special exception based upon its determination that the petitioner has demonstrated that the criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant is requesting a special exception use to permit the co-location of a stealth antenna atop a FPL utility distribution pole as proposed in the Site Plan within the C-2 zoning district(SE-24-16); and WHEREAS, Chapter 28,Part 6 of the LDC,Article 625,entitled"Variances",Section 625- 40 states that the City Commission may grant a variance based on its determination that the Applicant has demonstrated that the criteria identified in the LDC have been satisfied; and WHEREAS,the Applicant is requesting a variance to allow zero(0)canopy trees where two (2) are required (VA-40-16); and WHEREAS, staff recommended approval of the requested applications in the staff report dated June 14, 2016; and WHEREAS,the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the Site Plan (SP-15-16), Special Exception(SE-24-16),and Variance(VA-40-16)will protect the health,safety,and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. The foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. Pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements,"Article 635"Site Plan,"the following Site Plan(SP-15-16), attached as Exhibit`B"which is made a part of and incorporated into this Resolution by reference is approved. Section 3. Pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements," Article 630 "Special Exception uses,"the application for Special Exception use(SE-24-16)is approved consistent with the Site Plan provided in Exhibit`B". 2 RESOLUTION#2016-067 Section 4. Pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements,"Article 625"Variances,"the following Variance application (VA-40-16) is approved consistent with the Site Plan provided in Exhibit"B". Section 5. The approvals granted by this Resolution are subject to the Applicant's compliance with the following condition: Applicant shall obtain and provide an Airspace Obstruction Permit from FDOT as requested by Broward County Aviation Department. Section 6. Such application must be reviewed by the Broward County Aviation Department. Pursuant to LDC Section 635-100"Expiration of Site Plans,"Section 630-70 "Expiration of special exceptions,"and Section 625-50"Expiration of variances,"the Site Plan(SP- 25-16), Special Exception (SE-24-16), and Variance (VA-40-16) approvals shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen (18) months from the date of this Resolution. Section 8. The issuance of a development permit by a municipality does not in any way create any right on the part of an applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 9. All resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 10.
