HomeMy WebLinkAboutR-2016-071 Approves a Request for Waiver of Payment in Lieu of Taxes (''P.I.L.O.T.''), Made by the Dania Beach Housing Authority, for Property Taxes Otherwise to Be Paid by the Authority to the City. RESOLUTION NO. 2016-071 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING A REQUEST FOR WAIVER OF THE PAYMENT IN LIEU OF TAXES ("P.I.L.O.T."), WHICH REQUEST HAS BEEN MADE BY THE DANIA BEACH HOUSING AUTHORITY, FOR PROPERTY TAXES OTHERWISE TO BE PAID BY THE AUTHORITY TO THE CITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Housing Authority ("DBHA") is requesting that the City Commission grant a waiver of the "Payment in Lieu of Taxes" ("P.I.L.O.T.") for all properties owned by DBHA and its affiliate Dania Beach Quality Housing Solutions ("DBQHS") located within the boundaries of the City; and WHEREAS, the City Commission approved such a waiver by vote on July 24, 2012, for several Fiscal Years; and WHEREAS, the P.LL.O.T. is calculated as follows: actual shelter rent collected by DBHA minus total utility costs times ten percent(10%); and WHEREAS, the P.I.L.O.T. waiver has only applied to properties owned by the DBHA and DBQHS, and if any property was ever sold at any time, the waiver would have been terminated as to such property; and WHEREAS, the DBHA seeks City Commission approval to grant the waiver for such DBHA and DBHA owned properties on a permanent basis, subject to a provision that provides for termination of the waiver as to any one or more properties as they are sold and the right of the City to withdraw the waiver as applied to any particular property at any time; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the DBHA request for the P.I.L.O.T waiver is granted, as outlined above, and the condition as to termination of the waiver as to any property that is sold is incorporated into this grant of the request of the Authority; provided, however, that the City reserves the right, at any time, to withdraw the waiver of any P.LL.O.T. as applied to any particular property. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 3.
