A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO
PURCHASE PARTS FOR LIFT STATION REPAIRS AT LIFT STATIONS 4,
11, AND 12 FOR THE PUBLIC SERVICES DEPARTMENT BY UTILIZING
THE PRICING UNDER THE PALM BEACH COUNTY, FLORIDA
CONTRACT WITH HINTERLAND GROUP, INC., DATED MARCH 10, 2015
WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT
FOR BIDS IN AN AMOUNT NOT TO EXCEED THIRTY EIGHT
THOUSAND ONE HUNDRED FORTY DOLLARS ($38,140.00); PROVIDING
FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Charter of the City of Dania Beach, Part 111, Article 3, Section 4,
Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and
materials for the City government in amounts in excess of the established monetary threshold
without competitive bidding and without advertisement for bids if he is authorized to do so in
advance by a resolution adopted by the City Commission and if such purchases are made
pursuant to a competitive bid obtained within the last eighteen (18) months by other government
agencies, such as the federal government, State of Florida or a Florida municipality or county;
and
WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10,
"Monetary thresholds for certain purchases and payment disbursement authorizations",
Subsection(a), sets the monetary threshold or limitation at $25,000.00; and
WHEREAS, the Public Services Department currently has three (3) lift stations that are
in need of repairs (Lift Stations 4, 11, and 12); and
WHEREAS, the Director of the Public Services Department has determined that such
parts can be purchased at the least cost to the City from Hinterland Group, Inc. by utilizing the
pricing under the Palm Beach County, Florida Contract dated March 10, 2015, a copy of which
is attached as Exhibit "A", and made a part of and incorporated into this Resolution by this
reference; and
WHEREAS, the City Commission approved funding for equipment repair and
maintenance in the amount of Seventy Five Thousand Dollars ($75,000.00) in the Public
Services Department Fiscal Year 2015-2016 budget;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the foregoing "Whereas" clauses are ratified and confirmed as being
true and correct, and they are made a part of and incorporated into this Resolution by this
reference.
Section 2. That the City Manager is authorized to contract for the purchase of lift
stations parts from Hinterland Group, Inc. by utilizing the pricing under the Palm Beach County,
Florida contract, dated March 10, 2015, a copy of which is attached as Exhibit "A", and
incorporated into this Resolution by this reference.
Section 3. That the City Administration is further authorized to open and sign a
Purchase Order with Hinterland Group and such Purchase Order shall not exceed the amount of
Thirty Eight Thousand One Hundred Forty Dollars ($38,140.00) for the purchase of lift station
parts to repair Lift Stations 4, 11, and 12 for the Public Services Department.
Section 4. That funding for the purchase of the above-described lift station parts is
available and appropriated from the Sewer Fund in the amount of Thirty Eight Thousand One
Hundred Forty Dollars ($38,140.00), from Public Services, Repair and Maintenance Account,
Account No. 402-35-02-535-46-10.
Section 5. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 6. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

THIS CONTRACT, made and entered into this day of , 20—, between
PALM BEACH COUNTY, a political subdivision of the State of Florida, hereinafter referred to as the
"County" and H:rw) atAA1b 6a4y,p -,rc. hereinafter referred to as the
"CONTRACTOR".
WITNESSETH:
That the said Contractor having been awarded the contract for the:

Continuing Construction Contract

in accordance with the Bid therefore and for and in consideration of the promises and of the covenants
and agreements, and of the payments herein specified, to be made and performed by the Contractor
— and the County, the Contractor hereby covenants and agrees to and with the County to undertake and
execute all of the said named work, in a good, substantial and workmanlike manner, and to furnish and
pay for all materials, labor, supervision, equipment, supplies, fees, expertise, and services necessary to
fully complete all work in accordance with all requirements of the Contract Documents and in
accordance with all Federal, State, and local laws, rules, and regulations, within the time limit specified
in the Bid Form. The Contract Documents consist of the following documents which are incorporated
herein by reference.
A- Invitation to Bid, Instructions to Bidders, Bid Form and Attachments 1 through 5.
B - Completed Bond and Guarantees.
C - General Conditions.
D - Supplemental Conditions.
E - Special Conditions.
F - Technical Specifications dated September 28,2014.
G - Addenda.
H- Drawings dated Member 28.2014.
Contractor agrees to accept as full compensation for the satisfactory performance of this Contract the
sum of$ 6, 7R7,5CV c'v . The prices named in the Bid are for the completed work and all
expense, direct or indirect, connected with the proper execution of the work of each Work Authorization
and of maintaining the same until it is accepted by the Board of County Commissioners. It is
understood that the Contractor holds and will maintain current appropriate certification and/or license
for the purpose of performing the specified work pursuant to this Contract. The time limit for the
Substantial Completion of all work under this contract shall be as stated in the Bid Form. The date fixing
the beginning of this period upon the calendar shall be established and stated in the Notice to Proceed.
— The Contract is for an 1.5 year term (and any additional time needed to complete issued Work
Authorizations). The amount shown above is the maximum amount for all Work Authorizations which

may be issued under this Contract. The County has no obligation to issue any'Work Authorizations
thereunder.
IN WITNESS WHEREOF, the Board of County Commissioners of Palm Beach County, Florida,
has made and executed this Contract on behalf of the said County and caused the seal of the said
County to be affixed hereto, and the Contractor has hereunto set his hand and seal the day and year
written. The Contractor represents that it is authorized to execute this contract on behalf of itself and its
Surety.
