MINUTES OF REGULAR MEETING DANIA BEACH CITY COMMISSION TUESDAY, JUNE 28, 2016 - 7:00 P.M. 1. Call to Order/Roll Call Mayor Salvino called the meeting to order at 7:00 p.m. Present: Mayor: Marco A. Salvino, Sr. Vice-Mayor: Albert C. Jones Commissioners: Chickie Brandimarte Paul Fetscher Bobbie H. Grace City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Moment of Silence and Pledge of Allegiance Mayor Salvino called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 2016 Comprehensive Emergency Management Plan (CEMP) — Battalion Chief Sean Brown, BSO Fire Marshall's Office Lieutenant Dan Suarez, BSO Fire Rescue, presented an overview of the current Comprehensive Emergency Management Plan. 4. Proclamations 4.1 Guardian ad Litem Month— Laura Davis, Guardian ad Litem Program— 17th Judicial Circuit Laura Davis, Guardian ad Litem Program, read the proclamation, and asked people to get involved to help a child. 5. Citizen Comments Nick Cowart, 21 SE 151h Street, addressed a serious issue in his neighborhood regarding speeding. He has 16 signatures of residents on his street and wants speed humps. City Attorney Ansbro noted there is a policy to follow that will be provided by Public Services. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, introduced the new night time Sergeant Matthew Perricone. He provided an overview of a recent situation at a gas station and recognized the officers involved; he also spoke of the immigrants who came ashore on Saturday night. He noted BSO will begin the transition back into the 803 building next week. Lieutenant Dan Suarez, BSO Fire Rescue, noted Camp BSO was well attended and went well. He also reviewed firework safety due to the 4t' of July holiday coming up this weekend. 7. The motion carried unanimously. 7.10 RESOLUTION#2016-085 Revised Resolution and backup A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE APPROPRIATION OF FUNDS FOR FISCAL YEAR 2015-2016, RELATING TO MID- YEAR REVIEW BY CITY ADMINISTRATION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2016-085. City Manager Baldwin reviewed the information provided in the revised backup material that is attached to and incorporated into these minutes. Commissioner Grace motioned to adopt revised Resolution #2016-085; seconded by Vice- Mayor Jones. The motion carried unanimously. 8. Seeing as there was no one to speak in favor or opposition, Mayor Salvino closed the Public Hearing. Commissioner Grace motioned to adopt Ordinance #2016-013, on first reading; seconded by Vice-Mayor Jones. He asked the Commission to disclose any communication they had on these matters. 9.3 RESOLUTION#2016-076 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE "CALM PLAT" (PL-39-16) SUBMITTED BY PULICE LAND SURVEYORS, INC., ON BEHALF OF CALM PROPERTIES, LLC, FOR PROPERTY LOCATED AT 601 EAST DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (Continued from June 14,2016) City Attorney Ansbro read the title of Resolution #2016-076, and noted the applicant requested a continuance until the July 26, 2016 City Commission meeting. He explained this is only a plat approval and does not reflect anything that may be built on the property. Mayor Salvino opened the Public Hearing. Linda LaRosa, 85 Gulfstream Road, voiced her objections to the proposed development, and asked the Commission if this project is suited for this location. Mayor Salvino explained that the Commission cannot stop the construction of 7-story structures because it is allowed by law. John Vasquez, 85 Gulfstream Road, #312, expressed his opposition to the proposed development. Oswaldo Romero, 75 Gulfstream Road, #106B, noted incentives must outweigh the impact this will have on the City. Tom Smitha, 85 Gulfstream Road, #212A, voiced his objections to the proposed 14-story development, but noted a 7-story development was acceptable. Seeing as there was no one else to speak in favor or opposition, Mayor Salvino closed the Public Hearing. Mayor Salvino noted Dania Beach is changing and he respects everyone's opinion. The Commission will try to make the best decision and everyone needs to work together to come to a compromise. Commissioner Grace motioned to continue Resolution #2016-076 until the July 26, 2016 City Commission meeting at 7:00 p.m.; seconded by Commissioner Fetscher. The motion passed unanimously. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,June 28,2016—7:00 p.m. 9.4 RESOLUTION#2016-077 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-127-15) AND VARIANCES (VA-55-16 AND VA-56-16) SUBMITTED BY DANIA SQUARE INVESTMENT GROUP, LLC, FOR PROPERTY LOCATED AT 1301 SOUTH FEDERAL HIGHWAY, IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2016-077. Corinne Lajoie, Planning and Zoning Manager, reviewed the variances and site plan requests. Anthony Leon, Architect of the project, was available to answer questions. Mayor Salvino opened the Public Hearing. Daniel Parker, 41 SE 14th Street, said he is building a spec house for a man around the corner and is afraid this will affect the value of his property. Seeing as there was no one else to speak in favor or opposition, Mayor Salvino closed the Public Hearing. Vice-Mayor Jones motioned to adopt Resolution #2016-077; seconded by Commissioner Grace. The motion carried unanimously. 10. Discussion and Possible Action 10.1 Procurement through Piggyback Contracting City Manager Baldwin noted this was added at the request of Vice-Mayor Jones. Vice-Mayor Jones said he asked for this because people do not understand it. Nicki Satterfield, Finance Director, reviewed the memo that was included in the agenda packet. She noted there are many benefits to using piggyback contracts, such as time and cost savings, as well as it leverages your economy of scale. Construction projects and various services unique to Dania Beach cannot be piggybacked. Vice-Mayor Jones commented we do not utilize local vendors with piggyback contracts; however,there are more advantages than disadvantages to piggybacking. Dwight Collins, 26 SW 5th Avenue, asked if there was a notice published so that local vendors could bid. Finance Director Satterfield said if an item is competitively bid, it is noticed on the website, newspaper and Demand Star; if it is a piggybacked, it comes before the Commission. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,June 28,2016—7:00 p.m. Vice-Mayor Jones noted that when he was on the hospital board, over 60-70% of bids went out to non-local vendors; they were able to change that and now over 60% comes from Florida and Broward County vendors. Commissioner Grace concurred with Vice-Mayor Jones; she wants to keep it in Broward County and Dania Beach. 10.2 Budget Review Presentation Nicki Satterfield, Finance Director, reviewed the presentation that was included in the agenda packet. She noted the current revenues are finally equalized to the revenues from 2008. Public safety and pension costs have increased this year, and the cost for 5 additional fire personnel (SAFER) is $665,000.00. She also noted the Fire Assessment will increase $10.00 this year. Overall, there is at minimum $3 million in increased costs and only a $1.3 million revenue increase for the coming year. Commissioner Grace said we are going to be short, and she will not agree to raise taxes; we should cut salaries and people, if needed, as we are overstaffed. Vice-Mayor Jones asked staff to make sure we have some generalities; that is, at least 3 options or more to look at. He agrees with Commissioner Grace and the possibility that we may have to tighten our belt; he is not looking at any tax increases. Hopefully, we can look at some best case scenarios. Commissioner Grace asked at what level increasing the fire assessment by $10.00 would put us compared with the other cities. Finance Director Satterfield responded we would be the 1 oth lowest in Broward County. She noted we want to do a full analysis before increasing the fee in future years, but the cost for a study is $40,000.00 - $50,000.00. The fire assessment can only be used for fire, not EMS. There is $120,000.00 left in contingency this year, but an analysis would not be complete in time for the upcoming budget cycle. She explained that we have an operating deficit, which is problematic because we need to have revenues coming in to match expenses going out. Mayor Salvino felt the building fund could be used to pay other items in the budget, because they could be considered as building related. Finance Director Satterfield noted that all of the other funds, including the building fund, already pay a cost overhead allocation to the General Fund. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte told everyone to be safe over the 4th of July weekend. We need to elect the right people to make sure they understand the needs of the residents. Commissioner Grace said she wants to replace John Whitten on the Airport Advisor Board, and Roslyn Curry on the General Employees Pension Board. She noted Mayor Salvino needs to look at his Parks and Recreation board appointments. 11.4 Vice-Mayor Jones Vice-Mayor Jones spoke about attending the sentencing trial in the Apollo Brown case; the person who was convicted was sentenced to 7 years. 11.5 Mayor Salvino Mayor Salvino said he is removing Angela Lee from the Parks and Recreation Board, and replacing her with Samantha Christianson. Mayor Salvino confirmed that he replaced Tim Cates with Lauren Odman on the Parks and Recreation Board. 12. Appointments Mayor Salvino made one appointment during his comments. 13. Administrative Reports 13.1 City Manager City Manager Baldwin had no comments. Vice-Mayor Jones asked the City Manager to look into a water leak policy for rusty pipes. Commissioner Brandimarte spoke of water leaks in her building and elsewhere, and noted it would be taking on a big responsibility for the City to pay for residents' water bills. Introduction and Backg1ound The two neighborhood projects that make up Oasis IX (Davis Isles and Monroe Udell. Street) require additional work due to field conditions and modification to bid contruction plans. Oasis V (NE 2 Avenue) requires swale remediation following the installation of the new water line. The Oasis IX neighborhood improvement projects were awarded to the low bidder DP Development of the Treasure Coast, LLC in the amount of $147,524.50 on February 9, 2016. DP Development has performed excellently on four prior Oasis projects. The Davis Isles residents asked if changes to the approved landscaping design. The Oasis program has always tried to incorporate resident input when possible. The residents wanted the royal palms replaced with smaller palms. DP Development agreed to purchase new plants if the City agreed to install them. Additionally, unforeseen costs were incurred to repair the entrance way electrical system. The south side is installed as bid. The business owners requested several changes on the north side at Grampa's and Jean Cook's corners. Grampa's has a safety issue that was asked to be addressed: a sign in the middle of the asphalt and poor visibility. The sidewalk and Grampa's island add about$30,000 to the contract, but are needed for safety reasons. The swales along NE 2 Street required regrading to address standing water issues on the street caused by the flusing of the water line that interfered with the Oasis improvements made last year. Staff suggested that DP Development perform the work since they are mobilized in the City and are familiar with the Oasis projects. DP Developments quote for work was approximately one half of the other two quotes. The Contract to DP Development is being changed as follows: Credit for work not perform for Davis Isles and Monroe Udell + $45,166.50 Davis Isles additional work - $28,669.00 Monroe Udell Street additional work -$47,666.00 NE 2 Street (Oasis V) swale modification - $18,600.75 Staff recommends that Change Order No. 1 be approved for DP Development in the amount of $49,796.71. to address the changes. Funding in the amount of $12,475.50 is available and remains in the Oasis IX project budget. In addition there is $21,210.75 in direct stormwater work which is recommended by staff to be funded from the Stormwater Fund.
