HomeMy WebLinkAboutR-2016-106 Amends Parking Fees, Pursuant to Section 6-33, '' Schedule of Charges'' of Chapter 6, ''Beach and Public Parking Garage Parking'' of the City Code of Ordinances. RESOLUTION NO. 2016-106 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING PARKING FEES, PURSUANT TO SECTION 6-33, "SCHEDULE OF CHARGES" OF CHAPTER 6, "BEACH AND PUBLIC PARKING GARAGE PARKING" OF THE CITY CODE OF ORDINANCES; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach, Florida, is authorized by state law to enact user fees commensurate with the cost to the City of providing services, in such amounts as are necessary for the conduct of municipal governmental affairs; and WHEREAS, the City spends considerable sums of money in maintaining the beach area of the City of Dania Beach as a public park, public beach and recreational area; and WHEREAS, such sums of money are expended for direct costs, such as maintaining and operating the City parking garage, cleaning the beach and recreational areas of debris, providing lifeguard services and police protection to the beach area and parking garage; and WHEREAS, the City of Dania Beach Code of Ordinances, pursuant to Section 6-33, "Schedule of Charges" of Chapter 6, establishes a framework for parking fees; and WHEREAS, the City wishes to revise its parking fee schedules to continue and improve the maintenance of the facilities identified above; and WHEREAS, the fees contained in this Resolution have been developed to properly reflect the costs for providing such services and are listed in Exhibit "A", a copy of which is attached; and WHEREAS, the Director of Community Development believes that it is in the best interest of the citizens and residents of the City of Dania Beach to approve the recommended fee schedule; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That a parking fee schedule is adopted, a copy of which is attached as Exhibit"A", which is made a part of and is incorporated into this Resolution by this reference. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution shall be repealed to the extent of such conflict. Section 4. AASBRO CITY ATTORNEY 2 RESOLUTION#2016-106 EXHIBIT "A" SECTION 6-33, CITY CODE OF ORDINANCES SCHEDULE OF PARKING FEES (a) Beach Parking Fees Beach Hourly Parking Rate (or any portion of an hour) $2.00 per hour Resident Beach Parking Permit(in-state registration under age 65) $45.00 per year plus sales tax Resident Beach Parking Permit(out-of-state registration under age $75.00 per year plus sales tax 65) Resident Beach Parking Permit(in-state registration age 65 or more $25.00 per year plus sales tax Resident Beach Parking Permit(out-of-state registration age 65 or $25.00 per year plus sales tax more with proof of ownership) The City Manager is authorized to adjust the hourly charge, due to special events, weekends, holidays, seasonal demand or any or all of the foregoing, by an amount of up to an additional one dollar ($1.00) for each hour or fraction of an hour of parking time. Beach parking permits are issued annually to correspond with the City's fiscal year and shall not be prorated for any fraction of a year. (b) Parking Garage Fees Parking Garage Hourly Parking Rate (or any portion of an hour) $1.00 per hour Parking Garage Monthly Permit-Business Permit(or any part of a $55.00 per month plus sales tax month) Lost Parking Garage Ticket $10.00 minimum charge Parking Garage License Agreements Fee as determined by contract The City Manager is authorized to adjust the hourly charge, due to special events, weekends, holidays, seasonal demand or any or all of the foregoing, by an amount of up to an additional one dollar ($1.00) for each hour or fraction of an hour of parking time. Parking garage permits are issued monthly and shall not be prorated for any fraction of a month. (c) Resident: A "resident" is defined to mean a person who lives in the City and who submits the following documentation: 1. A current Florida motor vehicle registration or copy of current existing fully executed lease agreement for a vehicle registered in Florida to verify the applicant's name. If the vehicle is registered to a business name, proof of ownership must be submitted to verify the applicant's name as directly related to the business; 2. A current utility bill or voter's registration card in the same name of applicant as the vehicle registration or lease agreement showing a Dania Beach address; 3 RESOLUTION#2016-106 3. The applicant must present and provide proof of identity to the City; and 4. Any resident claiming senior status must further demonstrate to the City the following: a) That his or her age is sixty-five (65) or more; b) Proof of ownership of property in the City if presenting an out-of-state registration; and c) A current utility bill or voter's registration in the same name of the applicant as the vehicle registration or lease agreement. (d) Business: To qualify for business parking in the parking garage, the applicant must be an employee or owner of a business establishment with a current valid City business tax receipt issued to such business which business is located within 900 yards of the City garage. Such owner or employee shall submit the following documentation: 1. Proof of employment by a downtown business meeting the above criteria; 2. Current motor vehicle registration or copy of fully executed lease agreement to verify the applicant's name; and 3. Current valid driver's license. 4 RESOLUTION#2016-106
