A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH,FLORIDA,APPROVING THE VARIANCE REQUESTS SUBMITTED
UNDER APPLICATIONS (VA-67-16), (VA-68-16) AND (VA-69-16) BY
MICHAEL SALUS ARCHITECTS, LLC, ON BEHALF OF THE PROPERTY
OWNER, RJ MARINA HOLDING, LLC,FOR PROPERTIES LOCATED AT 50,
70 AND 90 SOUTH BRYAN ROAD IN THE CITY OF DANIA BEACH,
FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, pursuant to Chapter 28,the"Land Development Code,"Part 6,"Development
Review Procedures And Requirements,"Article 625, "Variances" of the City Code of Ordinances
(the"City Code"),Michael Salus Architects,LLC agent on behalf of the property owner RJ Marina
Holding,LLC(the"Applicant"),has applied to the City of Dania Beach(the"City"),for approval of
variance requests (VA-67-16), (VA-68-16), and (VA-69-16) as referenced in Exhibit `B", for
property legally described in Exhibit"A"; and
WHEREAS, City Code Section 625-40 provides that the City Commission may grant a
variance based on its determination that the petitioner has demonstrated that the criteria identified in
the City Code have been satisfied; and
WHEREAS,the Applicant is requesting a variance(VA-67-16)to allow a boat slip to extend
into a waterway approximately thirty four (34) feet in length where City Code Section 240-20(B)
requires a maximum twenty(20) feet in length; and
WHEREAS, the Applicant is requesting a variance to the off-street parking requirements
(VA-68-16) as follows: (1)allow five(5) feet between the property line and the first parking space
where City Code Section 265-110(C)requires a minimum twenty-five(25);(2)to provide no striping
or marking of off-street parking where City Code Section 265-I 10(1)requires both;and(3)to allow
storage lots for boats on a gravel surface where City Code Section 265-110(K)requires either asphalt
or concrete surface; and
WHEREAS,the Applicant is requesting a variance to the landscaping requirements(VA-69-
16) as follows: (1) to allow a perimeter landscape buffer with no hedge, wall or other durable
landscape barrier where City Code Section 275-90(C)requires a continuous minimum five(5)foot
VUA buffer on three(3)sides;(2)to allow(0)percent of the total VUA to be landscaped where City
Code Section 275-100(B) requires a minimum twenty (20) percent; (3) to provide zero (0)
intermediate landscape peninsulas where City Code Section 275-100(C) requires an intermediate
landscape peninsula every twelve (12) linear parking spaces; (4) to provide zero (0) terminal
landscape peninsulas where City Code Section 275-100(D)requires terminal landscape peninsulas at
the end of each row of parking; and(5)to provide zero(0)landscaping between the parking lot and
building where City Code Section 275-100 (e) requires a minimum five (5) foot landscape area
between the building and parking lot; and
WHEREAS,the Applicant has provided sufficient justification demonstrating compliance
with the approval criteria to meet the requirements of the City Code; and
WHEREAS,public notice was provided in accordance with law; and
WHEREAS, the City Commission finds that approvals of the requested variances are
consistent with the City's Code and Comprehensive Plan;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being
true and correct and are made a specific part of this Resolution.
Section 2. Pursuant to Chapter 28 "Land Development Code," Part 6 "Development
Review Procedures and Requirements,"Article 625"Variances,"the following applications(VA-67-
16),(VA-68-16) and(VA-69-16)for variance approval,copies of which are attached as Exhibit`B",
which are made a part of and are incorporated into this Resolution by this reference,are approved.
Section 3. Pursuant to Section 625-50 "Expiration of Variances" of the Land
Development Code, the variance approvals (VA-67-16), (VA-68-16) and (VA-69-16) shall
automatically expire and become null and void unless the Applicant files a complete building permit
application with construction drawings within eighteen(18)months from the date of this Resolution.
Section 4. That the issuance of a development permit by a municipality does not in any
way create any right on the part of an applicant to obtain a permit from a state or federal agency,and
does not create any liability on the part of the municipality for issuance of the permit if the applicant
fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal
agency, or undertakes actions that result in a violation of state or federal law.

Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 6. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

The following fees shall apply to all applications for land use plan amendments, rezoning, special exception use,
variances,site plans and other zoning related applications.These fees are used to defray staff cost in the evaluation of
the proposal made and provide for the required notices and public advertisements according to Florida State Statute and
the Dania Beach Land Development Code. Should any applicant have more than one type of request to the City, the
applications involved should be submitted at the same time. The present City policy is to have concurrent reviews being
processed before the final review and actions by the Planning and Zoning Board and/or City Commission. It is the
obligation of all applicants to review the appropriate City Codes and design standards related to their proposal before
making any application to the City. The standard review process for all development applications are two (2) review
cycles. Any additional review or public notice required by staff or professional consultants due to the

240-20—Construction of accessory boat slips and docks on waterways: limitations.
240-20 (B) —Accessory docks shall not extend into the waterway more than five (5) feet
beyond the property line, unless the waterway exceeds fifty (50)feet in width; in which
case a dock or slip may extend up to ten (10) percent the width of the waterway, or a
maximum of twenty (20)feet, whichever is smaller, measured from the property line.
Basis for variance request:
As a direct result of the Fort Lauderdale Airport Expansion, the owners business was
forced to leave its previous location in Dania Beach. Three parcels of land were
purchased and the business was relocated to South Bryan Road. The Northernmost
parcel was completely redeveloped. The extension of floating docks installed in the C-10
Canal exceeds the length allowed as per the above referenced zoning code section.
Variance Criteria:
(1) That the requested variance maintains the basic intent and purpose of the subject
regulations, particularly as it affects the stability and appearance of the city;
Due to the geometries' of the floating dock and adjacent land it does not reduce
the available clearance width of the C-10 Canal.
(2)That the requested variance is otherwise compatible with the surrounding land uses
and would not be detrimental to the community;
The portion of the dock extending furthest East into the C-10 at the South
Portion of the property is in compliance with the referenced zoning code.
(3)That the requested variance is consistent with, and in furtherance of, the goals,
objectives and policies of the adopted Comprehensive Plan, as amended from time to
time, and all other similar plans adopted by the city;

The space provided on the floating docks allows safety training courses to be
taught with demonstrations along the water's edge, protecting the patrons. The
use of the site in question allowed this business to remain in the City of Dania
Beach, not only serving as a unique, necessary and useful amenity to its
residents but also attracting patrons from other locations and aligning with the
goals, objectives, and policies of the City's Comprehensive Plan.
(4) That the plight of the petitioner is due to unique circumstances of the property or
petitioner which would render conformity with the strict requirements of the subject
regulations unnecessarily burdensome; and
With the canal protruding inland towards the North of the property and the
protected Mangroves exceeding farther east than the floating docks, these
docks will not provide an adverse effect to passing vessels. Refer to the
dimensioned SK-1 attached to this submittal.
(5) That the variance requested is the minimum variance that is necessary to afford relief
to the petitioner, while preserving the character, health, safety and welfare of the
community.
As the dock travels towards the South, the extension is diminished to comply
with the zoning codes.Refer to the dimensioned SK-1 attached to this submittal.

275-90 — Interior Landscape Requirements for Vehicular Use Areas (VUA's)
275-90 (C) - Business, commercial and industrial properties. On the site of a building or
open lot use providing a vehicular use area,where such area will not be entirely screened
visually by an intervening building or structure from any abutting right-of-way or adjacent
property, there shall be provided landscaping between such area and such abutting right-
of-way or property as follows:
(c) In addition, a continuous hedge, wall or other durable landscape barrier shall be
placed no closer to the VUA than five (5)feet and shall be maintained at three (3)feet
minimum height, but not higher than five (5) feet above the adjacent VUA and the
abutting property.
275-100— Interior Landscape requirements for vehicular use areas (VUA's)
275-100 (B) -Overall VUA landscape requirement.
An area, or combinations of areas, equal to twenty (20) percent of the total vehicular use
area exclusive of perimeter landscape buffers required under section 275-90 shall be
devoted to interior vehicular use area landscaping. In no case shall a parking stall be
further than sixty-five (65) feet from a tree, measured from the tree trunk. All landscape
areas within the vehicular use area or abutting landscape areas shall be protected from
vehicular encroachment through appropriate wheel stops or curbs. Wheel stops shall be
located a minimum of two (2) feet from the required landscape area.
275-100 (C) - Intermediate landscape peninsulas.
(1) There shall be no more than twelve (12) parking stalls along the same parking aisle
without an eight-foot-wide by fifteen-foot-long intermediate landscape peninsula
(exclusive of curb dimensions). Each peninsula shall have a minimum of two (2)
category 2 or category 3 trees, or a minimum of one(1) category 1 tree, provided that
the peninsula width is increased to ten (10)feet.

(2) Intermediate peninsulas may be spaced to allow up to twenty (20) parking stalls
between them along the same parking aisle when a minimum width of ten (10) feet
plus one (1)foot for every extra parking space over fifteen (15) is added to one (1) of
the adjacent islands in the row. These islands must contain a minimum of two (2)
category 1 trees.
(3) Intermediate peninsulas are not required for head-to-head parking rows or parking
rows abutting buildings when separated by a landscape area a minimum of fifteen feet
in depth and planted with a minimum of one(1)category 1 tree per twelve(12)parking
stalls.
275-100 (D)—Terminal landscape peninsulas.
Terminal landscape peninsulas shall be ten (10) feet wide and as long as the required
length of the parking stall in that aisle (exclusive of curb dimensions). Each peninsula
shall have a minimum of two (2) category 1 trees.
275-100 (E) -Vehicular use landscape areas abutting buildings.
(1) Requirements for site plans not within CRA-form-based districts. A landscaped area
having a minimum width of five (5) feet, or the equivalent square footage, shall
separate the VUA from the walls of a single story building. The minimum landscaped
area width shall increase by five (5) feet for each additional story up to a maximum
landscaped area of twenty-five (25) feet. If the site constraints and configuration limit
the ability to provide the required dimensions adjacent to the building, a minimum five
(5) feet of landscaping, or the equivalent square footage, must be provided adjacent
to the building, and the additional required square footage not provided adjacent to
the building must be added to the perimeter landscape buffer of the site.
Basis for variance request:

purchased and the business was relocated to South Bryan Road. The Northernmost
parcel was completely redeveloped in compliance with all applicable zoning codes. The
two parcels associated with this variance request are directly adjacent to the South and
serve as an accessory to the primary business, will minimal public use. The Owner has
not made changes to the prior function or use of the parcels in question, although the
duration of time left unoccupied led to the expiration of the previous use.
Variance Criteria:
(1) That the requested variance maintains the basic intent and purpose of the subject
regulations, particularly as it affects the stability and appearance of the city;
All proposed site improvements, as per the provided site plan, intend to comply
to the extent feasible with the current zoning codes while at the same time
allowing the business to function properly. All parking space requirements are
met with the existing layout. This site is an accessory storage location integral
with the overall business plan of Nautical Ventures. The visiting public will

access this business only at 50 Bryan Road, the Northernmost Parcel of the
three owned by the applicant.
(2) That the requested variance is otherwise compatible with the surrounding land uses
and would not be detrimental to the community;
The proposed solution will bring a level of compliance exceeding each of the
neighboring businesses currently existing along South Bryan Road.
(3) That the requested variance is consistent with, and in furtherance of, the goals,
objectives and policies of the adopted Comprehensive Plan,as amended from time to
time, and all other similar plans adopted by the city;
The use of the site in question allowed this business to remain in the City of
Dania Beach, not only serving as a unique, necessary and useful amenity to its
residents but also attracting patrons from other locations and aligning with the
goals, objectives, and policies of the City's Comprehensive Plan.
(4)That the plight of the petitioner is due to unique circumstances of the property or
petitioner which would render conformity with the strict requirements of the subject
regulations unnecessarily burdensome;
The site as it exists met all previous requirements at the time of the original
development.The building cannot be relocated to accommodate the 5'-0" buffer
required between the building and VUA and in addition to reducing the area
allotted for parking spaces, the reconfiguration of the asphalt parking area will
be costly with no way to offset the financial impact to the business. With the
proposed solution all damaged asphalt will be repaired and the entire asphalt
lot will be restriped.
(5) That the variance requested is the minimum variance that is necessary to afford relief
to the petitioner, while preserving the character, health, safety and welfare of the
community.
The required 10'-0" landscape buffer with trees installed every 30'-0" between
the property's VUA and the City Right-of-Way to the West (South Bryan Road)
as well as the adjacent property to the South will be provided in full compliance.
Providing a buffer along the east property line,adjacentto the C-10 Canal,would
only prohibit access to the water. With the nature of this business and the size
of the boats being continuously rearranged around the site, all landscaping
installed or terminal islands on the properties interior would only serve as
obstacles, restricting movement of the large forklift necessary to relocate the
vessels and would inevitably be continuously damaged.

(6)When a row of parking stalls is immediately adjacent to a driveway, a minimum
stacking area of twenty-five (25) feet is required between the property line and the
entrance to the first stall.
265-110 (1)—Striping, Signage and Pavement Markings.
(1) [Requirements.] All off-street parking areas shall be so arranged and marked as to
provide for orderly, safe loading, unloading, parking and storage of vehicles with
individual parking stalls clearly defined with directional arrows and traffic signs
provided as necessary for traffic control, including but not limited to, the clear
demarcation of one-way traffic aisles or driveways.
(2) Parking space designation. All required off-street parking spaces shall be clearly
delineated by a single four-inch wide, white, painted striping wherever a hard-paved
parking surface is required, except that striping shall not be required for:
(a) Stacked parking, where permitted within residential driveways;
(b) Brick-pavered parking surfaces, in which case wheel stops or alternating paver
colors shall be substituted for striping in order to clearly delineate parking space
boundaries.
(3) Other striping. All other striping, excluding parking stalls, shall be installed with
thermoplastic materials.
(4) [Pavement markings.] Pavement markings for parking facilities shall be provided in
conformance with the Manual on Uniform Traffic Control Devices, latest edition.
(5) Identification of parking lots. All off-street parking areas required by this article shall
be provided with identification as to purpose and location in the form of signage visible
to vehicular traffic when such parking areas are not clearly evident from a street or
alley. Signage shall comply with the requirements of article 505, Sign Regulations.

265-110 (K) -Storage lots for vehicles, boats and equipment.All open-air storage lots for
vehicles, boats or trucks shall be surfaced with asphalt or concrete.
Basis for variance request:
As a direct result of the Fort Lauderdale Airport Expansion, the owners business was
forced to leave its previous location in Dania Beach. Three parcels of land were
purchased and the business was relocated to South Bryan Road. The Northernmost
parcel was completely redeveloped in compliance with all applicable zoning codes. The
two parcels associated with this variance request are directly adjacent to the South and
are serve as an accessory to the primary business, with minimal public use. The Owner
has not made changes to the prior function or use of the parcels in question, although the
duration of time left unoccupied led to the expiration of the previous use.
Variance Criteria:
(1) That the requested variance maintains the basic intent and purpose of the subject
regulations, particularly as it affects the stability and appearance of the city;
As per the calculations provided on sheet AS-101, the total number of required
parking spaces is provided. This site is an accessory storage location integral
with the overall business plan of Nautical Ventures. This property will not be
visited by public vehicles as all traffic enters on the Northern Parcel, making the
required 25'-0" stacking dimension have no influence on the traffic flow. The
existing loose gravel lot allows the property's ground to percolate rain water
rather than shed it elsewhere. This area has issues of flooding already and
paving the area where boats are stored will only add to the existing problem.
(2) That the requested variance is otherwise compatible with the surrounding land uses
and would not be detrimental to the community;
The quantities of both vehicular and boat storage are provided in compliance
with the applicable zoning codes as indicated on sheet AS-101. The vehicular
parking area will be restriped as required.The location and size of boats on this
site change consistently, making permanent striping to determine their
locations not feasible.
(3) That the requested variance is consistent with, and in furtherance of, the goals,
objectives and policies of the adopted Comprehensive Plan, as amended from time to
time, and all other similar plans adopted by the city;
The use of the site in question allowed this business to remain in the City of
Dania Beach, not only serving as a unique, necessary and useful amenity to its
residents but also attracting patrons from other locations and aligning with the
goals, objectives, and policies of the City's Comprehensive Plan.
(4) That the plight of the petitioner is due to unique circumstances of the property or
petitioner which would render conformity with the strict requirements of the subject
regulations unnecessarily burdensome;

The site as it exists met all previous requirements at the time of the original
development. Providing a 25'-0" stacking space would cause the costly
redevelopment of the existing asphalt lot,which is not used for public parking,
and will reduce the amount of parking spaces able to be provided. With the
proposed solution all damaged asphalt will be repaired and the entire asphalt
lot will be restriped as per the applicable code sections.
(5) That the variance requested is the minimum variance that is necessary to afford relief
to the petitioner, while preserving the character, health, safety and welfare of the
community.
The total number of parking spaces will be provided as required and the asphalt
lot will be restriped in accordance with the zoning codes. The proposed
landscape buffer provides a visual break between the property's parking area
and the City Right-of-Way to the West (South Bryan Road). Public parking on
this facility is not intended. With the nature of this business and the size of the
boats being continuously rearranged around the site, permanent markings to
locate the boats will not be effective.
