A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, APPROVING A PLAT NOTE AMENDMENT TO THE
GRIFFIN POINTE PLAT (DR-81-16) SUBMITTED BY GREENSPOON
MARDER, P.A., ON BEHALF OF THE PROPERTY OWNER GRIFFIN
POINTE PARTNERS LLLP, FOR PROPERTY LOCATED AT 2271 GRIFFIN
ROAD IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the boundary plat known as the "GRIFFIN POINTE" Plat was approved by
the City Commission in 2007; and
WHEREAS, pursuant to Chapter 28, "Land Development Code," Part 6, "Development
Review Procedures And Requirements," Article 640, "Plats", of the City Code of Ordinances
(the "City Code"), Greenspoon Marder, P.A., representing the property owner Griffin Pointe
Partners LLLP, (the "Applicant") has applied to the City of Dania Beach, Florida (the "City"),
for approval of a Plat Note Amendment attached as Exhibit`B," for property legally described in
Exhibit"A" (Application DR-81-16); and
WHEREAS, the Applicant is requesting to amend the Plat Note, as follows:
FROM:
This plat is restricted to 40,000 square feet of office use, 5,000 square feet of commercial
use and 5,000 square feet of bank use. Any commercial uses located within the northern
8.67 acres of this plat (designated "office park" on the effective land use plan) are further
restricted to either restaurants or personal services which are accessory to the primary
office use.
TO:
This plat is restricted to 294,000 square feet of office use. No commercial/retail/bank
uses are permitted within the plat without approval from the board of county
commissioners who shall review and address these uses for increased impacts.
WHEREAS, Broward County requires that the City of Dania Beach concur with the
proposed revision prior to a review by the Broward County Commission; and
WHEREAS, the City Commission finds that the approval of the proposed Plat Note
Amendment will protect the public health, safety, and welfare of the residents of the City, and
furthers the purpose, goals, objectives and policies of the Comprehensive Plan;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as
being true and correct and they are made a specific part of this Resolution.
Section 2. That the GRIFFIN POINTE Plat Note Amendment (DR-81-16) to allow
for office use as provided in the attached Exhibit `B," a copy of which is made a part of and
incorporated into this Resolution by this reference, is accepted and approved.
Section 3. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 4. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
