AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AMENDING CHAPTER 6, ENTITLED "BEACHES,
PARKS, WATERWAYS AND RECREATION", ARTICLE II, ENTITLED
"BEACH AND PUBLIC PARKING GARAGE PARKING", SECTION 6-33,
ENTITLED "SCHEDULE OF CHARGES", OF THE CITY CODE OF
ORDINANCES, BY REPEALING AND REPLACING THAT SECTION AS A
RESULT OF UPDATES AND REVISIONS TO THE PARKING CHARGES'
SCHEDULE; REPEALING SECTION 6-33.1 ENTITLED "PARKING
CITATION SURCHARGE FOR SCHOOL CROSSING GUARD PROGRAM"
AND TRANSFERRING THE PROVISION TO CHAPTER 25 OF THE CODE;
PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA:
Section 1. That Article II, entitled `Beach and Public Parking Garage Parking" of
Chapter 6, entitled "Beaches, Parks, Waterways and Recreation", Section 6-33, "Schedule of
Charges", of the City Code of Ordinances, is repealed in its entirety and in its place, a new
Section 6-33 is created to read as follows:
Sec. 6-33. - Schedule of charges.
(a) Dania Beach (beach parking areas). Parking fees are and will be established by City
Commission resolution from time to time, to be charged the owner or operator of each motor
vehicle parking at the beach parking area:
(1) There shall be a charge for each hour or any fraction of an hour of parking time.
Additionally, the City Manager is authorized to adjust the hourly charge, due to special
events, weekends, holidays, seasonal demands, or any or all of the foregoing for each
hour or fraction of an hour of parking time as authorized by resolution adopted by the
City Commission.
(2) A resident of the City shall be exempt from the payment of charges as set forth in
subsection (1) above by obtaining and displaying a parking permit from the City. The
permit shall be available from the City. Parking permits shall be issued annually to
correspond with the City's fiscal year. Permits shall not be prorated for a fraction of a
year.
(b) Parking garage: Parking garage fees are and will be established by City Commission
resolution from time to time to be charged to the owner or operator of each motor vehicle
parking at the parking garage:
(1) There shall be a charge for each hour or any fraction of an hour of parking time as
established by resolution adopted by the City Commission. Additionally, the City
Manager is authorized to adjust the hourly charge, due to special events, weekends,
holidays, seasonal demands, or any or all of the foregoing, as authorized by resolution
adopted by the City Commission. Persons conducting business at City Hall or the
County library (including library employees) may have their parking approved by
authorized City or County employees, resulting in free garage parking. There shall be a
minimum charge for any lost ticket as prescribed by resolution adopted by the City
Commission.
(2) Any employee or owner of a downtown City business establishment (which shall be
defined as a business operating with a valid and active business tax receipt located
within 900 yards of the City garage) shall have the option, in lieu of paying for hourly
parking, to purchase a monthly parking permit for parking of the employee's or owner's
vehicle in the City garage after providing documentation of his or her current
employment by a downtown business establishment and submission of a current vehicle
registration and driver's license to City staff who will research and confirm the
existence of the business tax receipt, registration and license before issuing a parking
garage permit. The parking garage permit shall be available from the City in the form of
a decal or placard. When a decal is provided, it must be affixed to the exterior lower left
corner of the rear window of the specified individual's vehicle, or if the vehicle is a
convertible, it must be affixed to the left of the license plate on the rear bumper. When a
placard is provided, it must be displayed so that it is visible on the dashboard of the
vehicle. The fee for permits shall be paid to the City finance department and issued by
the City parking enforcement division.
(3) City Administration may direct and authorize that City garage parking be made
available at no charge for a period of forty-five (45) minutes before and thirty (30)
minutes following the completion of public meetings scheduled and conducted by the
City and any other meetings approved by City Administration.

(4) There shall be no overnight parking allowed in the garage except as otherwise permitted
by the City in accordance with an agreement approved by the City Commission as
otherwise authorized in writing by the City Manager or designee. The City
Administration shall monitor and enforce this prohibition through its review and
ticketing of parked vehicles. The City may also have any such vehicle removed from
the garage by towing it.
Section 2. That Section 6-33.1 entitled "Parking Citation Surcharge for School
Crossing Guard Program" is repealed, and the text of the provision is transferred to Code Section
25-79, "Fines", as a new subsection (f), pursuant to adoption of a separate ordinance which will
amend various provisions in Chapter 25 of the Code.
Section 3. That if any section, clause, sentence or phrase of this Ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this Ordinance.
Section 4. That all ordinances or parts of ordinances and all resolutions or parts of
resolutions in conflict with this Ordinance, are repealed to the extent of such conflict.
Section 5. That this Ordinance shall take effect immediately upon City Commission
adoption.
