DANIA BEACH CITY COMMISSION
TUESDAY, SEPTEMBER 13, 2016 - 7:00 P.M.
1. Call to Order/Roll Call
Mayor Salvino called the meeting to order at 7:00 p.m.
Present:

2. Moment of Silence and Pledge of Allegiance
Mayor Salvino called for a moment of silence followed by the Pledge of Allegiance to the United
States Flag.
3. Presentations and Special Event Approvals
3.1 K-2 Summer Literacy Program—Dr. Tracy Jackson, Principal, Collins Elementary
Dr. Tracy Jackson, Principal of Collins Elementary, presented a video showcasing the activities
of the Collins Elementary Summer Literacy Enrichment Camp.
3.2 A Penny at Work— Transportation and Infrastructure Surtaxes. Update on the public
information campaign.
Colin Donnelly, Assistant City Manager, provided an overview of the transportation and
infrastructure surtaxes.
On the ballot this November are two one-half percent (or 0.5 cent per dollar) sales surtax
questions. One 0.5 cent sales surtax is proposed to fund countywide transportation projects and
the other 0.5 cent sales surtax is proposed to fund infrastructure projects. Together, they
represent a one percent sales surtax, which is the equivalent of one penny per dollar spent. These
two ballot questions are linked together, so that both must pass in order for either to take effect.
If only one ballot measure passes, then neither will be implemented.
The funds generated by the combined one penny sales surtax will be used to fund a variety of
projects such as enhanced transit options, traffic signal synchronization, water and sewer
improvements (pipes and treatment plants), drainage improvements to address street flooding
issues, and senior mobility. Both sales surtaxes would expire after 30 years.
3.3 Special Event request from the Tamara James Foundation to have a "Pink Fest" on
October 8, 2016 at C. W. Thomas Park from 11:00 a.m. —5:00 p.m.
Commissioner Grace motioned to approve the Pink Fest Special Event request; seconded
by Vice-Mayor Jones. The motion carried unanimously.
3.4 Special Event request from the Dania Beach Lions Club to have a "Quarter
Deck/Dania Beach Lions Club Moonlite Classic Car Show" on October 15, 2016
from 5:00 p.m. - 11:00 p.m. This event will be located in the Marina parking lot. The
applicant is requesting the use of City barricades to block off the west side of the
parking lot.
Vice-Mayor Jones motioned to approve the Moonlite Classic Car Show Special Event
request; seconded by Commissioner Grace. The motion carried unanimously.
3.5 Special Event request from the St. Maurice at Resurrection Church to have a "St.
Maurice Country Fair". The requested event will be held October 27- 30, 2016 at the
St. Maurice at Resurrection Church located at 441 NE 2nd Street.
Commissioner Grace motioned to approve the St. Maurice County Fair Special Event
request; seconded by Vice-Mayor Jones. The motion carried unanimously.
3.6 Special Event request from the Broward County Environmental Planning &
Community Resilience Division to have an "Ocean Conservancy International
Coastal Cleanup" on September 17, 2016 from 9:00 a.m. -12:00 p.m. on Dania Beach.
The applicant is requesting a pickup for trash collected and to suspend beach raking
services the morning of the event.
Commissioner Grace motioned to approve the Ocean Conservancy International Coastal
Cleanup Special Event request; seconded by Commissioner Fetscher. The motion carried
unanimously.

5. Citizen Comments

Linda Wilson, Friends of the Dania Beach Library, Kristin Dridge, Friends of the Dania Beach
Paul DeMaio Library, and Tim Bain, Manager of the Dania Beach Paul DeMaio Library,
thanked the Commission for the charitable contribution they received last year. They noted none
of the money they receive is spent on administration; it is only spent on programs. They asked if
they could add their monthly schedule to the City website.
Vivik Golikeri, 301 SE 3rd Street, noted he is having problems contacting BSO through their
telephone system. He proposed the creation of a restitution program for minor criminal
offenders.
Linda Meyer, 438 SE 11 Terrace, had questions regarding a dead-end road near the new
Walmart. She also questioned the noise ordinance because Walmart will be receiving deliveries
during nighttime hours.
Kara Weber Castor, 25 SE llth Street and 39 SE 12th Street, complained of crime in her
neighborhood, and the antique businesses in downtown.
Jason Wilson, 75 Gulfstream Road, spoke of responsible development. He recommended the
City adopt policies to better inform residents of developer-backed initiatives.
Betty Sokol, 609 NW loth Street, questioned what happened to the lights at the main entrance to
Melaleuca Gardens.
Elizabeth Parella, 85 Gulfstream Road, voiced her concerns with the developments in the City.
She requested a traffic study for Gulfstream Road, and that the Bureau of Alcohol, Tobacco and
Firearms be contacted to establish how close a building should be to TNT Fireworks.
Peter Parella, 85 Gulfstream Road, spoke about the time allowed for citizen comments and
comments made about development at the last Commission meeting.
Douglas Edwards, 75 Gulfstream Road, said his community is misunderstood. He would like
Dania Beach to host a public forum on the Gateway mixed-use area; we need a workshop and
open house.
Carolyn Jones, 722 SW 3rd Street, spoke of cancer awareness, and events that will be held at St.
Ruth Missionary Baptist Church during the month of October.
Ray Rapaglia, 301 S 57th Way, Hollywood, spoke in favor of the Hope Spot Center. He noted he
is currently the director of Jaycees Recovery House and executive director of the James Club.
James "Riley" Wynn, 323 NE 7th Avenue, Ft. Lauderdale, noted he was once a resident at the
Dismas House. He was a drug user for 46 years, and said the Hope Spot is a sacred place that
helps save and change lives.
Brenda Lepage-Stephens, 145 SW 5th Court, Apt #2, said Dania Beach has the best Police
Department in the world. She attends meetings at t�e Hope Spot every day, and added we need

to work together to stop the use of drugs. She asked to keep the Hope Spot open, or to help find
a place where they can relocate to.
Mario Rass, 5001 Hollywood Boulevard, Hollywood, is one of the owners of the Hope Spot.
Their intention was to have a safe place for addicts to meet, and they chose the current location
because they saw that these areas got hit the hardest. He took responsibility for not checking into
the regulations and guidelines as to where they could meet, and asked the City to work with
them.
Barbara Jefford, 126 NE 2nd Avenue, stated the Hope Spot is an issue worth fighting for. They
offer hope and solutions that can change lives.
Lance Getreider, 126 NE 2nd Avenue, spoke in favor of allowing the Hope Spot to continue its
operation.
Betty Sokol noted the Methodist church used to have a Monday night program, and she
wondered where the people went when the church closed.
6. Public Safelyports
Captain Daniel Marks, BSO Chief of Police, advised of upcoming BSO events: Walk for Peace
will be begin at Collins Elementary at 9:00 a.m. on September 241', and Operation Medicine
Cabinet will be held at the I. T. Parker Community Center during the Seniors Meeting on
October 6t'. Captain Marks also reported on high profile crimes in the City.
Sean Brown, Battalion Chief, BSO Fire Rescue, reported on a fire that happened on September
4t'at the FPL substation.

Commissioner Grace had no comments.
11.4 Vice-Mayor Jones
Vice-Mayor Jones noted we need to look at our sign ordinance. He feels Dania Beach
candidates are treated differently from candidates for federal, state and court elections regarding
signs placed on swales and public property. He also noted a lot of his signs are being taken, and
he thought this practice went away in 2012. He is offering a reward for any signs that are being
taken, regardless of who they belong to.
11.5 Mayor Salvino
Mayor Salvino noted next Tuesday night will be a fund raiser for a nurse at Memorial Hospital
for her recovery period following amputation of her leg due to cancer.
Mayor Salvino also noted girls' softball, baseball, and tee-ball has started again at Frost Park and
sign-ups are currently underway.

RIP THROUGH L.I. FIREWORKS PLANT
BELLPORT, L.I., Nov. 26— A series of explosions tore through the Grucci
fireworks plant here today, heavily damaging the nation's largest fireworks
factory and too nearby homes. Two people were killed and 24 were injured,
the Suffolk County police said.
The blasts, punctuated by bursting skyrockets and a huge mushroom cloud
that some witnesses took for a nuclear explosion, erupted between 11:10 and
11:45 A.M. at the New York Pyrotechnic Products Company, a 13-acre complex
of warehouses and storage sheds in this Suffolk County community of 2,800
people, 50 miles east of New York City. The cause of the blasts was not
immediately determined.
The explosions, heard miles away, leveled many of the dozen buildings on the
property,blew out the windows of surrounding homes, collapsed roofs,
cracked walls and chimneys, overturned cars, knocked out power to 7,000
homes, showered surrounding communities with fragments of fireworks and
sent neighbors scurrying after children and fleeing in panic.
"It looks like a couple of thousand pounds of bombs came down there," said
John C.Wehrenberg, a Suffolk County Legislator from Holbrook who was at
the scene.
"After the first explosion, it looked like a big mushroom cloud," said Robert
McDermott, an auto mechanic who was working nearby. "Everything was black
from smoke. There were rockets going into the woods. The woods caught fire.
Windows were blown out of trucks in the yard."

"It sounded like the atomic bomb," said Vincent Costanzo, who lives more than
a mile from the scene. "I thought our house was going down."
Deputy Inspector Philip McGuire of the Suffolk County police said the first
explosion occurred in a warehouse used as the main production building. It
was destroyed, leaving a crater 3 feet deep and 10 feet across. A number of
smaller buildings were flattened and the tops of several storage trailers were
sheared off, turning the north end of the property into what looked like a
smoking, devastated battlefield. "Whatever was in there is gone, and if anybody
was in there, they were just destroyed," Inspector McGuire said.
The family business, founded and headed by Felix Grucci Sr., has an
international reputation in pyrotechnic choreography. It has designed displays
for such festivities as the 1976 Bicentennial, President Reagan's 1981
Inauguration and the tooth anniversary of the Brooklyn Bridge last May.
The dead were tentatively identified as James Grucci, one of the founder's
sons, and Donna Gruber, 19 years old, of 56 Hedges Road, East Patchogue, a
cousin. Both had been working in Warehouse Building No. 5, a half-block long,
one-and-a-half story corrugated metal structure where employees made
rockets, flares and other pyrotechnic devices.
Their bodies were found just outside the wreckage of the building, and officials
said they believed that both had been trying to flee when the explosions
occurred. 2 Admitted to Hospital
A spokesman for Brookhaven Memorial Hospital in Patchogue, Kevin Miller,
reported that 24 people, including several children and infants, had been
treated for cuts, bruises, fractures and other minor injuries.All but two were
released. One of them, Gertrude Barzilay, 56, of Bellport, was admitted to the
intensive-care unit with chest pains; the other, George Perez, 24, also of
Bellport, was admitted with respiratory problems.
At least four Grucci family members were treated. Felix Grucci Sr., the
company's 78-year-old founder, and his wife, Concetta, 65, were treated for
what was described as excessive stress. Their daughter, Donna Grucci Butler,
43, and a grandson, Vincent Grucci, l9, sustained minor injuries.

Some of the injured were Grucci employees working on fireworks for
Christmas displays. Most, however, were people who lived near the plant, Mr.
Miller said.
Edward Thompson, a Red Cross official at the scene, said that the explosions
had left 5o homes within about a half mile of the factory "uninhabitable" and
that "another 5o have a lot of major problems."
The police said the blast created an implosion, a suction effect that blew the
windows of neighborhood buildings outward rather than inward.A blast that
blew the windows inward might have caused many more injuries, they noted.
Dozens of Smaller Fires
As flames engulfed buildings on the site, witnesses said dozens of smaller fires
were touched off by flaming debris that came down as far as eight miles away.
As firemen fought the flames, the police set up roadblocks surrounding the
area and allowed no one to enter, not even residents who had been away from
their homes at the time of the blast. Police officials said they feared homes
might otherwise be looted.
Most of the houses close to the site, at Association Road and Station Avenue
just south of Bellport's Long Island Rail Road station, were evacuated as
Suffolk County policemen and fire and ambulance crews from Bellport and six
other communities raced to the scene.
Temporary shelters for the more than 300 people removed from their homes
were set up at Bellport High School and at the Hagerman Fire Department in
East Patchogue. There was no damage to the station or tracks of the Long
Island Rail Road, and train service was not affected.
The police went from door to door late this afternoon warning residents of the
area to beware of unexploded fireworks that might have landed on their
property. Officials also said other blasts were a possibility because explosive
materials were buried on the Grucci property. In Business 53 Years

and the Treasury Department's Bureau of Alcohol, Tobacco and Firearms went
to the scene to stabilize the explosives.
It was believed to be the first explosion in 16 years at the site, where the Grucci
family, operators of the nation's largest pyrotechnics concern, has been making
fireworks for 53 years. The company won the world championship at the
International Festival of Fireworks in Monte Carlo in 1979•
The property that serves as the company headquarters was part of the World
War I site of Camp Upton. It is a lightly wooded field dotted with a series of
corrugated metal and cinder-block buildings used for the storage and
fabrication of fireworks. In addition to fireworks, the company makes signal
flares and other safety devices. Safety Precautions Cited
The compound is surrounded by a six-foot-high chain-link fence topped with
barbed wire.A guard dog patrols the site, which has signs warning: "Danger,
explosives. Keep out." The Gruccis have said they never use dynamite and have
often spoken publicly of their extensive safety precautions and devices, ranging
from 50400t spaces between buildings to a ban on smoking on the property.
The plant is governed by regulations of the Bureau of Alcohol, Tobacco and
Firearms. The last explosion there occurred in 1967, according to the family,
with damage confined to the Grucci property.
Despite the company's record, safety at the plant, which is the only industrial
complex in a residential area, has been the subject of controversy among
neighbors and other Bellport residents this year. The Grucci family has
contended that residents' fears are exaggerated.
The family's application to rezone the property from residential to industrial
was denied by the Town of Brookhaven in August after protests by nearby
residents, who told of cracked windows, fiery debris floating in the air and the
sounds of explosions day after day as fireworks are tested at the site.
Despite their familiarity with such sounds in their neighborhood, many
residents were stunned by yesterday's explosions.

"I knew what it was," said Vincent Corella, who was at his home on Association
Road 500 yards from the plant. "I was in World War II and I never heard
anything that loud."
'It Was a Real Mess'
Ray Braun, manager of Rollup Insulating Service, a block away, raced to the
scene and said he found the 14,000- square foot roof of his building collapsed
and all the windows and doors blown out. He also found chaos in the streets.
"There were people running out of their homes half-dressed," he said. "There
were babies being thrown out of windows. It was a real mess. After the initial
explosion, I could see bursts of flame and then there was a tremendous impact
and then a back suction."
Witnesses said that multi-colored rockets filled the sky overhead as the blasts
erupted, and a large white mushroom cloud billowed hundreds of feet over the
site. The cloud turned black then, and carried flaming pieces of debris over a
wide area surrounding the facility.
"They were red, blue, green and white," said Jim Lyons, 18. "This was the
biggest show ever. It's just incredible. I've never been terrified in my life until
now."
Charles Salit, a spokesman for the Long Island Lighting Company, said that the
first explosion damaged an electrical substation in Bellport and knocked out
power to customers in Bellport, Shirley and Mastic. Power was restored to all
but about 300 of the 7,000 customers by 2 P.M., he said. Many Windows
Blown Out
Peter Capizzi, who lives on Maple Avenue next to the site, was in his backyard
when the blast occurred. He dived behind a woodpile as his chimney collapsed
and all the windows blew out of his house. "I thought it was the end," he said.
In another house nearby, Lori Fuhrmann said, the explosion blew out all her
windows, cracked walls and sent food and dishes crashing down from cabinets.
Diane Sardella, another Maple Avenue resident, said that when the blast
erupted, she thought of last Sunday's television dramatization of nuclear war,

"The Day After." She said she dashed out of the house with her two children
and sped away in her car.
Other people, uncertain what was happening, took refuge in their cellars, as
some people did in the nuclear war movie. "After seeing the movie 'The Day
After' last week, I was really scared," said Bobby Wallen, 17.
In the village of Bellport, shoppers ran out of stores and people stopped
whatever they were doing to find out what had happened. More than 40 fire
and rescue vehicles raced to the scene. Small fires around the property were
put out in about an hour, but the fires inside the compound raged longer as
firemen, fearing more blasts, were unable to get close.

Among the possible causes being pursued by the investigators is the chance
that Miss Gruber and Mr.Grucci accidentally mixed some of the wrong
chemicals when they were assembling the fireworks.

Another possibility is the weather.It rained heavily the two days before the
explosions,creating damp conditions inside the storage sheds and assembly

Investigators say some of the wind-driven rain may have seeped into a
storage shed and dripped onto some chemicals,causing them to become
unstable.
And when a high-pressure system with warming temperatures moved into the
area on the day of the blasts,they said,the change could have caused

Investigators say they were told by one family member that some recently
assembled fireworks were drying in Building Number 5.The investigators say
it is possible that gases given off by the drying chemical could have
spontaneously ignited.
Lieutenant Allen said most of the witnesses to the explosions had been
interviewed except for"the prime witness,"Felix Grucci,who has been in
mourning.
A spokesman for the family said late last week that the Gruccis hoped to
rebuild the business.However,officials of the Town of Brookhaven,of which
Bellport is a part,said the area had become too residential since the Grucci
complex was begun 53 years ago and that town approval for rebuilding was
doubtful.

Larry Elkin,a special agent in charge of the explosives-enforcement branch of
the Bureau of Alcohol,Tobacco and Firearms,said a report on the joint
investigation by local and Federal officials should be issued within a few
weeks.

Lieutenant Allen,meanwhile,said he was less than optimistic about the
outcome of the Bellport investigation.
"There's no question about what kind of explosives were involved,"he said.
"We just don't know what touched them off.And the fact is,we may never

The Department was not able to properly complete all of the necessary public notice
requirements for the September 13, 2016 Public Hearing agenda items. These agenda
items include:
• RZ-60-16 Rezoning 2nd reading Optekar
• RZ-70-16 Arthur Choate Rezoning 1 st reading
• RZ-71-16 Rezoning Lally 2nd reading
• SP-61-OOMOD/SE-72-16 Lally site plan mod/Special Exception
• TX-75-16 20th Text Amendment 1st reading
Proper completion of the public notice for the items was due, in part, to the protracted and
unanticipated illnesses/absences by key staff members involved in the public notice
process. New and proper notice for these agenda items will be completed for the
September 27, 2016 City Commission Meeting.
I have contacted all of the applicants for the September 13, 2016 public hearing and
advised them of the same. The applicants expressed no objections or concerns.

Subject: The Collection of Water Fees
It is fundamental to a utility that all participants in a utility fund the improvements and
operations of the utility. The setting of utility rates, the billing for services, the
collection of debt, and the regular maintenance is established by ordinance and the
annual budget process to insure the utility is self-supporting. The City's loan
agreements and Code reinforce the principle that "all water must be paid for", so the
utility can remain solvent to meet its obligation to the rate payers and lenders.
The excerpt below from City Code provides the guiding principles the utility operates
within:
"The_cit utility system was created to develop safe reliable and financially self-
supporting potable water and sanitary sewerage systems which will meet the
water and sewerage needs of a developing area served by the city, to ensure
that existing and future utility systems are constructed operated and managed
at the least possible cost to the users and with no direct or indirect financial aid
from the general fund of the city, to develop systems requiring the most reliable
operating and maintenance costs and to develop a system that is compatible
with the city's growth."

water bills and to prevent the wasting of water."

all leaks on the premises and shall notify the city promptly of any leak
discovered other than upon the premises."
The City aggressively seeks to prevent the waste of water by monitoring meter
readings and notifying consumers of high use, as well as some assistance with leak
detection. Wasted water and uncollected revenue is ultimately passed back to the
customers in the form of higher rates or deferred maintenance of the water system.
The City Code does allow for the adjustment of water bills, usually for billing errors,
instances of lost or waste through leaks, carelessness, and neglect. In these cases,
water does not enter the sanitary sewer system; therefore, adjustments to the sewer
portion may be warranted. This is typically done with proper documentation.
Adjustments other than these are atypical as other unwarranted adjustments would
reduce the City's anticipated revenue stream which hinders the City's ability to meet its
maintenance and debt obligations to its lenders.
When borrowing for utility capital needs, lenders ask for guarantees that the city will bill
and collect for the water that is produced. There is a legal expectation rates are set to
maintain the utility and meet debt payments. The legal remedy is that the lender has
the right to control the utility's revenue to guarantee payment.
The excerpts below from the City' State Revolving Fund (SRF) loan agreements
illustrate the covenants the City must adhere to:
• The City must pledge revenues
(12) "Pledged Revenues" shall mean the specific revenues pledged as security
for repayment of the Loan and shall be the Gross Revenues derived yearly from
the operation of the Water and Sewer Systems after the payment of the
Operation and Maintenance Expense and the satisfaction of all yearly payment
obligations on account of any senior obligations issued pursuant to Section 7.02
of this Agreement.
• The City's other available General Fund revenues will be used to support the
utility if water and sewer revenues do not allow for payment of debt. This is to be
avoided because it is contrary to the City's Code and creates a burden on the City's
General Fund which cannot be supported by ad-valorem taxes.
(9) In the event the anticipated Pledged Revenues are shown by the Project
Sponsor's annual budget to be insufficient to make the Semiannual Loan
Payments for such Fiscal Year when due, the Project Sponsor shall include in
such budget other legally available non-ad valorem fund which will be sufficient,
together with the Pledged Revenues, to make the Semiannual Loan Payments.
• The City is required to charge for all services provided by the utility.
5.02 NO FREE SERVICE
The Local Borrower shall not permit connections to or furnish any services
afforded by the Water or Sewer System without making a charge therefore
based on the Local Borrower's uniform schedule of rates fees and charges
• The City is required to shut off service for customers who don't pay their bills.
5.07. COLLECTION OF REVENUES.
The Project Sponsor shall use its best efforts to collect all rates fees and other
charges due to it. The Project Sponsor shall establish liens on premises served
by the Water or Sewer System for the amount of all delinquent rates fees and
other charges where such action is permitted by law. The Project Sponsor
shall, to the full extent permitted by law, cause to discontinue the services of the
Water and Sewer Systems and use its best efforts to shut off water service
furnished to persons who are delinquent beyond customary grace periods in the
payment of Water and Sewer Svstem rates fees and other charges
• If the City fails to set rates and collect fees, the Florida State of Department
Environmental Protection can step in to do so.
6.02. Remedies.
Upon an event of default subject to the rights of others having prior liens on the
Pledged Revenues, the Department may enforce its rights by any of the
following remedies:
(1) By mandamus or other proceeding at law or in equity, cause to establish
rates and collect fees and charges for use of the Water and Sewer Systems,
and to require the Project Sponsor to fulfill this Agreement.
(2) By action or suit in equity, require the Project Sponsor to account for all
moneys received from the Department or from the ownership of the Water
and Sewer Systems and to account for the receipt use application or
disposition of the Pledged Revenues.
• The City must pledge revenue each year to cover 1.15 times the debt owed each
year.

debt service coming due in each Fiscal Year under the terms of this Agreement

The City Administration makes every effort to assist customers when instances of high
consumption are noted within the provisions allowed by the City Code. Where high
consumption qualifies for a sewer credit it is granted.
Unfortunately, high consumption situations do occur which do not qualify for a credit In
these instances the City's debt covenants govern the City's inability to grant credits.
In these cases, the City offers reasonable payment plans to its customers. Payment
plans allow for the City to maintain the requirements of the debt covenants while
providing relief to the customer without creating the financial burden having to pay the
bill in full all at once.
