A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, APPROVING A PLAT NOTE AMENDMENT TO THE
BRYAN ROAD WAREHOUSES PLAT (DR-61-16) SUBMITTED BY DANIA
BEACH MARINA CORP., ON BEHALF OF THE PROPERTY OWNER FOR
PROPERTY LOCATED AT 90 NORTH BRYAN ROAD IN THE CITY OF
DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the boundary plat known as the "Bryan Road Warehouses" Plat was
approved by the Broward County Planning Council in 2001; and
WHEREAS, pursuant to Chapter 28, "Land Development Code," Part 6, "Development
Review Procedures And Requirements," Article 640, "Plats", of the City Code of Ordinances
(the "City Code"), Michael M Lally, representing the property owner Dania Beach Marina Corp.,
(the "Applicant") has applied to the City of Dania Beach, Florida (the "City"), for approval of a
Plat Note Amendment attached as Exhibit `B," for property legally described in Exhibit "A"
(Application DR-61-16); and
WHEREAS,the Applicant is requesting to amend the Plat Note, as follows:

This plat is restricted to 45,000 square feet of industrial use on Parcel "A". Any
additional uses are not permitted without the approval of the Board of County
Commissioners who shall review and address these uses for increased impact fees.
TO:
Parcel "A" is restricted to a marina which includes 222 boat slips (12 existing wet slips);
2,500 square feet ancillary commercial use; and 1,600 square feet of restaurant use (844
square feet existing and 756 square feet additional proposed).
WHEREAS, Broward County requires that the City concur with the proposed Plat Note
Amendment prior to a review by the Broward County Commission; and
WHEREAS, the City Commission finds that the approval of the proposed Plat Note
Amendment complies with the City Code and will protect the public health, safety, and welfare
of the residents of the City, and furthers the purpose, goals, objectives and policies of the
Comprehensive Plan;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as
being true and correct and they are made a specific part of this Resolution.
Section 2. That the BRYAN ROAD WAREHOUSES Plat Note Amendment (DR-
61-16) to allow for a marina with ancillary commercial uses and a restaurant use as provided in
the attached Exhibit`B," a copy of which is made a part of and incorporated into this Resolution
by this reference, is accepted and approved.
Section 3. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 4. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
