RESOLUTION NO. 2016-137 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-03-15) AND ASSOCIATED DESIGN VARIATIONS AND DESIGN WAIVERS(OT-83-16/OT- 84-16/OT-85-16/OT-86-16) SUBMITTED BY RAMESH ACQUISITIONS, LLC, FOR PROPERTY LOCATED ON THE NORTHEAST CORNER OF FEDERAL HIGHWAY AND DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONDITIONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City Code of Ordinances,Chapter 28,entitled"Land Development Code" (the"LDC"),of Part 6,entitled"Development Review Procedures and Requirements,"Article 635, entitled "Site Plans," states that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Ramesh Acquisitions, LLC ("Applicant") is requesting site plan approval to allow the construction of a mixed use project consisting of 286 dwelling units and 18,978 square feet of commercial space to be located on the northeast corner of Federal Highway and Dania Beach Boulevard in the City of Dania Beach, Florida; and WHEREAS,Chapter 28,Part 3 of the LDC,entitled"Design District Overlay,"Article 301 "Legal and Administrative Provisions,"Section 301-50"Variations in design;procedure for review of design variations,"states that the City may waive design-based requirements as part of a site plan application; and WHEREAS, Chapter 28, Part 5 of the LDC, entitled "Signage and Design Regulations," Article 525 "Architectural Standards for the Community Redevelopment Area Form-Based Zoning Districts,"Section 525-10"Applicability,"states that the City may waive design-based guidelines as part of a site plan application; and WHEREAS,the Applicant has requested greater setbacks and building recess along US 1, Dania Beach Boulevard and NW 1'Court where Section 303-40(L),(M)and(N)require a Build-to- Line of 5' for 70% of the fagade and maximum allowable recess from Build-to-Line of 10'; and WHEREAS, the Applicant has requested to provide no recess at the sixth story where Section 303-40(P) of the LDC requires a 10' recess at the sixth story; and WHEREAS,the Applicant has requested to provide no horizontal moderation between 25' and 35' where Section 525-30(B) of the LDC encourages buildings that exceed 35' to display a uniform cornice height between 25' and 35' above finished grade with a horizontal moderation of 4' in vertical plane; and WHEREAS,the Applicant has requested to provide no roof pitch where Section 510-30(D) of the LDC requires roof pitches; and WHEREAS,the Applicant has requested to provide glass windows to make up 40.5%of the elevation fronting Dania Beach Boulevard and 30.6% of the elevation fronting Federal Highway where Section 510-30(H)of the LDC requires glass windows to make up at least 35%of the primary elevation of a corner site; and WHEREAS,the Applicant has requested a height variation to provide a height of 82'on the west and 87' on the east and the LDC allows for such request for a height variation equal to 10% above maximum building height or additional 10 feet,whichever is less and provided no additional stories are granted; and WHEREAS, pursuant to Section 301-50(c)(1) of the LDC, the above referenced Design Variations and Design Waivers shall be considered as part of the proposed Site Plan(SP-03-15);and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS,the City Commission finds that the approval of the proposed Site Plan(SP-03- 15)and associated Design Variations and Design Waivers are consistent with the requirements of the Code and will protect the public health, safety,and welfare of the residents of the City,and furthers the purpose, goals, objectives and policies of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct,and they are made a part of and incorporated into this Resolution by this reference. Section 2. Pursuant to Chapter 28 "Land Development Code,"Part 3 "Design District Overlay,"Article 301 "Legal and Administrative Provisions,"Section 301-50"Variations in design; procedure for review of design variations,"the requested Design Variations are approved consistent with the Site Plan provided in Exhibit`B". 2 RESOLUTION#2016-137 Section 3. Pursuant to Chapter 28 "Land Development Code," Part 5 "Signage and Design Regulations,"Article 525"Architectural Standards for the Community Redevelopment Area Form-Based Zoning Districts," Section 525-10 "Applicability,"the requested Design Waivers are approved consistent with the Site Plan provided in Exhibit`B". Section 4. Pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements,"Article 635"Site Plan,"the following Site Plan(SP-03-15), attached as Exhibit`B"which is made a part of and incorporated into this Resolution by reference is approved. Section 5. The approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. Park Impact Fee: per Section 805-110 & Reso. No. 2014-071, $1,364.00 per multifamily dwelling (368 X 1364 = $501,953) must be paid prior to issuance of a building permit (Planning). 2. Per Section 305-50 (H), Performance Bonds. "Participants in the voluntary green building program, at the time of building permit application, shall post a performance bond, letter of credit, or other form of surety approved by the City Attorney, in the amount described by the regulations (Planning). 3. SUSTAINABLE BUILDING PRACTICES: Per Section 305-50(F) Provide "Project site and engineering plans that clearly detail all green building measures which are intended to qualify for incentive." 4. RAC TRAFFIC IMPACT MITIGATION: Provide an analysis, signed and sealed by a certified engineer, identifying the amount of RAC mitigation for traffic impact due based on resolution No. 2014-049 which established a rate of$21.26 per p.m.peak hour trip.Based on traffic study by Traf Tech dated June, 2016 the project will generate 325 PM peak hours trips, which will require payment of$6,909.50(325 X$21.26)must be paid prior to issuance of a building permit (Planning). 5. Must provide unity of title unifying all lots,prior to issuance of a building permit(Planning). 6. The developer shall enter into an Agreement with the City to ensure the compliance of the pocket park with Articles 305 and 312 of Chapter 28 of the Dania Beach City Code in a form acceptable to the City Attorney. Such Agreement shall provide for ongoing maintenance of the park by the developer and ensure continuous public access to the pocket park from dawn to dusk 365 days of the year,except during declared states of emergency and shall be recorded in the public records at the expense of the developer prior to the issuance of a building permit for the Site Plan. 3 RESOLUTION#2016-137 7. Existing sewer forcemain on NE lst Court must be reflected on survey plans (City Engineer). 8. Prior to application for building permit, a separate meeting needs to be arranged and sewer connections resolved with Public Services Department to discuss proposed water and sewer connection including other offsite development. Please contact Sherie Dunleavey, Office Manager,Public Services Department to make an appointment,phone number 954-924-6806 ext. 3882. (City Engineer). 9. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal (City Engineer). 10. Fire Department Access information as follows: a. Demonstrate turning radii for the entry from Federal Highway on the east side of the structure. b. Demonstrate turning radii for all lst floor garage turns to accommodate BSO Rescue Trucks (minimum inside radius of 24'10"; outside radius of 36'10") c. Demonstrate a minimum vertical clearance of 14' throughout the 1 st floor garage to accommodate BSO Rescue trucks. d. Provide FD access to the 1"floor corridor from valet area for the east building. e. Provide double sided doors for passenger elevator#4 (BSO Fire). 11. Water supply information as follows: a. Water mains must be looped on the north side of the project with a minimum 8"water mains. b. Additional fire hydrants in the following locations: a) Off the required looped 8" fire main on the north side of the project (on NE 1 Avenue). You can move the propose hydrant that is currently on the 6"main to this location. b) Off the proposed 8" fire main on NE 1 Court at the north end of the property. c) Proposed hydrant on NE 1 Court must be off the 12"main;not the 6' main—please correct c. One additional FDC at the NE corner of the property on NE 1 Court. d. Locations of all fire department connections(Siamese and Fire Hose Valves on standpipes) on the interior and exterior of the building or structure(for buildings or structures with fire sprinkler systems). (BSO Fire). 12. Proof of water supply&Fire flow demand as follows: a. Fire hydrant flow test must be accompanied with the 24 hour pressure recording;in addition the flow test data&chart must be on company letter head from the company performing the test;finally,please identify on the test the name of the BSO Fire inspector that accompanied and witnessed the test of the documentation. b. Fire flow demand calculations must be signed and sealed by a licensed engineer of record. c. The application for the approval of the fire protection water supply design must be signed by the owner or agent. 4 RESOLUTION#2016-137 13. Statement of verification from the design professions of record,on official company letterhead, must state that the proposed water main sizing, fire hydrant spacing, and fire hydrant locations are in compliance with the Broward County Land Use Code and the Florida Fire Prevention Code. In addition, this document must have the seal and signature of the engineer(BSO Fire). 14. Provide an egress plan demonstrating and dimensioning all comment paths of travel, dead end corridor distances and travel distances to all exits within the building and/or structures (BSO Fire). 15. Additional Fire Department Access Information as follows: a. Fire Lane locations and striping detail (demonstrated) b. "NO PARKING" sign locations and sign details demonstrated—Provide Details c. Fire Department Access Routes During Construction(BSO Fire). 16. Address Detail—provide details for the numbers (size, coloring, etc.)(BSO Fire). 17. The Applicant shall obtain all necessary county, state, and federal permits. Section 6. That such application must be reviewed by Broward County Aviation Department. Pursuant to LDC Section 63 5-100"Expiration of Site Plans,"Section 625-50 "Expiration of variances," the Site Plan (SP-03-15) and associated Design Variations and Design Waivers shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen(18) months from the date of this Resolution. Section S. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 9. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. 5 RESOLUTION#2016-137 Section 10.
