AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA APPROVING THE RIGHT-OF-WAY AND EASEMENT
VACATION REQUESTS (VC-05-15, VC-06-15, VC-07-15) MADE BY
CRAVEN THOMPSON AND ASSOCIATES, INC., ON BEHALF OF THE
PROPERTY OWNER, CTKO DANIA VENTURE, LLC, FOR PROPERTIES
GENERALLY LOCATED AT 4 NORTH FEDERAL HIGHWAY WITHIN THE
CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, pursuant to Chapter 28, entitled, "Land Development Code" of Part 6,
entitled, "Development Review Procedures And Requirements" of Article 655, entitled,
"Vacations Of Right-Of-Way" of the City Code of Ordinances (the "City Code"), Craven
Thompson and Associates, Inc. (the "Applicant"), on behalf of the property owner, CTKO Dania
Venture, LLC, has applied to the City of Dania Beach (the "City") for approval to vacate the
following:
1. Vacate the 1.50' utility easement at the north side of Lot 16, Block 12 of Map of
Town of Modelo, Plat Book B-49, DCR, recorded in OR 3230, Page 295, BCR (VC-
05-15);
2. Vacate approximately 220 linear feet of the 40' platted Right-of-Way of NE 1st
Avenue per Map of Town of Modelo, Plat Book B-49, DCR, north Dania Beach
Boulevard(VC-06-15); and
3. Vacate the 15' platted alleyway per Beachway, Plat Book 8, Page 33, BCR, adjacent
to Block 6 and Block 1 (VC-07-15).
WHEREAS, the City Planning and Zoning Board, sitting as the Local Planning Agency,
held a duly advertised public hearing on September 21, 2016 and recommended approval of the
proposed right-of-way and easement vacations; and
WHEREAS, staff recommended approval of the proposed right-of-way and easement
vacations in its report September 27, 2016; and
WHEREAS, the City Commission of Dania Beach (the "City Commission") conducted
two (2) duly noticed public hearings in accordance with law; and
WHEREAS, the City Commission finds that granting the requested right-of-way and
easement vacations will not adversely affect access to neighboring properties and will not be
detrimental to the public health, safety and welfare; and
WHEREAS, the City Commission finds that the portion of the right-of-way and
easement subject to this vacation is no longer needed as a public right-of-way and easement, and
that it is in the best interest of the City to grant the request to vacate the right-of way and
easement.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. The foregoing "WHEREAS" clauses are ratified and confirmed as being
true and correct, and they are made a specific part of this Ordinance.
Section 2. Pursuant to Chapter 28, entitled, "Land Development Code" of Part 6,
entitled, "Development Review Procedures and Requirements" of Article 655, entitled,
"Vacations Of Right-Of-Way" of the City Code, the requested right-of-way (VC-05-15 and VC-
06-15) and easement (VC-07-15) vacations, as shown on the attached Exhibit "A," are approved
subject to the following conditions:
1. Vacation of approximately 220 linear feet of the 40' platted Right-of-Way of NE 1 st
Avenue is subject to a reservation by the City as a vehicular and pedestrian access and
utility easement restricted to a height of fourteen feet three inches (14% 3") above
finished grade. The future easement shall be subject to review and approval by the City
Attorney.
2. Vacation of approximately 220 linear feet of the 40' platted Right-of-Way of NE 1st
Avenue is subject to a reservation of a utility easement for water and sewer per Broward
County Waste Water System(BCWWS) Minimum Easement Requirements.
3. Provide/maintain public access to NE 1 st Avenue as part of the City's roadway network.
4. Reline existing 8" gravity clay pipe or replace with 8" PVC sewer pipe.
5. Upsize existing 6"watermain to 8"PVC watermain.
Section 3. If any clause, section, sentence or phrase of this Ordinance is for any
reason held unconstitutional or invalid by a competent jurisdiction, the holding shall not affect
the validity of the remaining portions of this Ordinance.

Section 4. All ordinances or parts of ordinances, resolutions or parts of resolutions in
conflict with this Ordinance are repealed to the extent of such conflict.
Section 5. This Ordinance shall be in force and take effective immediately upon its
passage and adoption.

This letter is in response to your request for a No Objection Letter for the
vacation of the following items:
1. 40' ROW for NE I st Avenue per PB B-49, DCR , to be retained as a
public utility and access easement with overhead clearance
2. 25' ROW easement reservation for NE 1 st Avenue per DB 547-7, BCR
3. 25' ROW easement reservation for NE 1 st Avenue per DB 527-450,BCR
4. 15' platted alley per PB 8-33, BCR
5. 1.5' utility easement per OR 3230-295,BCR
We have no objections to these vacations as long as the developer incurs all costs associated
with the above mentioned vacations. The relocation of city-owned facilities, if any, and will
be relocated at developer's expense and at no cost to the city. It is understood that the developer
will grant replacement easements as needed, and the developer will incur costs associated with
engineering,design,permitting,and document costs, etc.
Also, we would like to review conceptual/preliminary design drawings
showing the relocations as soon as possible.
