HomeMy WebLinkAboutR-2016-159 Ippolito Isle Plat Note Amendment (DR-102-16) RESOLUTION NO. 2016-159 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING A PLAT NOTE AMENDMENT TO THE IPPOLITO ISLE PLAT (DR-102-16) SUBMITTED BY PULICE LAND SURVEYORS, INC. FOR PROPERTY GENERALLY LOCATED ON VACANT PROPERTY ON THE WEST SIDE OF SW 25 AVENUE, SOUTH OF GRIFFIN ROAD IN THE CITY OF DANIA BEACH, FLORIDA AS LEGALLY DESCRIBED IN EXHIBIT "A"; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the boundary plat known as the "Ippolito Isle" Plat was approved by the Broward County Planning Council on August 23, 2007; and WHEREAS, pursuant to Chapter 28, "Land Development Code," Part 6, "Development Review Procedures And Requirements," Article 640, "Plats", of the City Code of Ordinances (the "City Code"), Pulice Land Surveyors, Inc. (the "Applicant"), has applied to the City of Dania Beach, Florida (the "City"), for approval of a Plat Note Amendment attached as Exhibit "B," for property legally described in Exhibit"A" (Application DR-102-16); and WHEREAS, the Applicant is requesting to amend the Plat Note, as follows: FROM: This plat is restricted to: thirty six (36) townhouse units, a proposed conservation area on Parcel B, a private recreational area and a proposed water management area on Parcel C, and a local public park on Parcel D. TO: This plat is restricted to 36 single-family dwelling units, a proposed conservation area on Parcel B, a private recreational area and a proposed water management area on Parcel C, and a local park on Parcel D. WHEREAS, Broward County requires that the City concur with the proposed Plat Note Amendment prior to a review by the Broward County Commission; and WHEREAS, the City Commission finds that the approval of the proposed Plat Note Amendment complies with the City Code and will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW,THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That the Ippolito Isle Note Amendment (DR-102-16) to allow for thirty six (36) single family homes with a conservation area (Parcel B), a private recreational area and proposed water management area (Parcel C), and a local public park (Parcel D), as provided in the attached Exhibit `B," a copy of which is made a part of and incorporated into this Resolution by this reference, is accepted and approved. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. That this Resolution shall be in force and take effect immediately upon its passage and adoption.
