A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, APPROVING THE "DANIA HOMES" PLAT (PL-90-16)
SUBMITTED BY PULICE LAND SURVEYORS, INC., ON BEHALF OF THE
PROPERTY OWNER, DANIA HOMES, LLC, FOR PROPERTY LOCATED
AT 4485 SOUTHWEST 25TH TERRACE IN THE CITY OF DANIA BEACH,
FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A'; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Chapter 28 of the Code of Ordinances of the City of Dania
Beach (the "Code"), which chapter contains the City Land Development Code (the "LDC"), Part
6, "Development Review Procedures and Requirements", Article 640 "Plats", it is stated that
since June 4, 1953, no principal building may be constructed on any lot unless a plat including
the lot has been approved by both the City Commission and the Broward County Commission,
and recorded in the official records of Broward County; and
WHEREAS, Pulice Land Surveyors, Inc., on behalf of Dania Homes, LLC (the
"Applicant"), is requesting plat approval (PL-90-16), for property legally described in the
attached Exhibit "A", a copy of which is made a part of and incorporated into this Resolution by
this reference; and
WHEREAS, the "Dania Homes" Plat (PL-90-16), is restricted to four (4) detached
single-family units; and
WHEREAS, staff recommends approval of the plat; and
WHEREAS, the City Commission conducted a duly noticed public hearing in
accordance with Article 640 of the LDC; and
WHEREAS, the City Commission finds that the approval of the proposed plat will
protect the public health, safety and welfare of residents of the City, and furthers the purposes,
goals, objectives and policies of the City's Comprehensive Plan;
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH,FLORIDA:
Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as
being true and correct, and they are made a specific part of this Resolution.
Section 2. That pursuant to Chapter 28, entitled, "Land Development Regulations", Part
6, entitled, "Development Review Procedures and Requirements", the following application for a
Plat (PL-90-16), attached as Exhibit `B," is approved subject to compliance with the following
condition:
(1) Prior to the issuance of a building permit for the construction of a residential dwelling
unit, the approved plat shall be recorded in the Public Records of Broward County,
Florida and the Applicant shall provide a copy of the recorded plat to the City.
Section 3. That the issuance of a development permit by a municipality does not in
any way create any right on the part of an applicant to obtain a permit from a state or federal
agency, and does not create any liability on the part of the municipality for issuance of the permit
if the applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a
state or federal agency, or undertakes actions that result in a violation of state or federal law.
Section 4. Such application must be reviewed by the Broward County Aviation
Department; the point of contact is William Castillo, Airport Planner located at 220 S.W. 45
Street, Suite 101, Dania Beach, Florida, 33312, (954) 359-6100.
Section 5. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 6. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.
