Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Tamara James Vice-Mayor: Bill Harris Commissioners: Chickie Brandimarte Bobbie H. Grace Marco A. Salvino, Sr. City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Special event request by the Russian Saint Matrona Foundation for an "Orthodox Christmas Fair" on January 8, 2017, to be held at 113 S. Federal Highway from 11:30 a.m. — 6:00 p.m. The applicant is requesting temporary signage and use of the City parking garage. Mark Felicetty, Director of Parks and Recreation, noted the parking fee is still pending and the applicant will provide us backup on the off-duty detail. Vice-Mayor Harris motioned to approve the Special Event request for Russian Saint Matrona Foundation's Orthodox Christmas Fair; seconded by Commissioner Grace. The motion carried unanimously. Commissioner Salvino presented Certificates of Recognition to Donald, Deborah and Dalton Faguy, and Nicole Garcia for their participation as Santa & Friends at the City of Dania Beach Holiday Tree Lighting event. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Vivek Golikeri, 301 SE 3rd Street, suggested imposing a $100 fine on each minor violation, such as trespassing, illegal fishing and loud music. Tommy Hicks, 327 SW 2nd Avenue, requested more police patrol in his neighborhood due to a recent crime against his family. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, noted they are doing everything possible to bring the persons who committed the crime previously mentioned to justice. He also reported on other criminal activity in the City, and noted the Sheriff will be providing a marine boat to the City at no charge. Chief Marks introduced King, the new K-9 drug dog. Commissioner Grace commented that three residents have had mail stolen at the post office, and asked if the camera could be placed near the drop-off box. Chief Marks noted he will look into it. Commissioner Grace noted Smith's Store was flooded with people at 9:45 a.m. on Sunday morning, and also wants the camera to be placed there. Chief Marks said they will take care of it. Lieutenant Dan Suarez, BSO Fire Rescue,provided a brief video on holiday tree safety. 7. Commissioner Grace motioned to adopt the Consent Agenda, with the exception of Items #7.3, #7.5, #7.6 and #7.8; seconded by Commissioner Salvino. The motion carried unanimously. 7.3 RESOLUTION#2016-161 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING EXECUTION OF A FIRST AMENDMENT TO THE EXISTING AGREEMENT BETWEEN THE CITY OF DANIA BEACH AND HOWARD C. FORMAN, CLERK OF THE COURTS, SEVENTEENTH JUDICIAL CIRCUIT COURTS TO INCLUDE HEARINGS OF APPEALS AS THEY RELATE TO ELECTRONIC PARKING TICKETS; PROVIDING FOR CONFLICTS; FURTHER PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2016-161. Commissioner Salvino requested an explanation of the process. Marc LaFerrier, Director of Community Development, explained we will no longer need the Clerk of the Courts to process all of our parking tickets, only handwritten tickets and tickets that are contested; all of the E-ticket processing is done by the service provider and staff. He noted he will follow-up with the service provider regarding a way to pay parking tickets at City Hall. Commissioner Grace motioned to adopt Resolution #2016-161; seconded by Commissioner Salvino. BOOK, P.A., FOR CONSULTING SERVICES RELATED TO ISSUES OF CONCERN TO THE CITY OF DANIA BEACH (MATTERS ASSOCIATED WITH BROWARD COUNTY AND WITH THE FORT LAUDERDALE-HOLLYWOOD INTERNATIONAL AIRPORT), AS WELL AS GENERAL LEGISLATION AND RELATED ISSUES AT THE STATE LEVEL IN AN AMOUNT NOT TO EXCEED FIFTY THOUSAND DOLLARS ($50,000.00)FOR A ONE YEAR TERM; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2016-163. Commissioner Salvino requested an explanation for the public. City Attorney Ansbro reviewed the memo included in the agenda packet. Commissioner Salvino confirmed there would be a cost savings to the City and we would be getting a top notch lobbyist. Commissioner Salvino motioned to adopt Resolution #2016-163; seconded by Commissioner Grace. City Attorney Ansbro read the title of Resolution#2016-164. Commissioner Salvino asked what enhancements would be included in the grant. City Manager Baldwin responded the project had been presented to the Commission, and minor modifications can be made to it, such as eliminating the traffic circles and doing raised intersections. He noted the sidewalk enhancements are slated for Dania Beach Boulevard. Commissioner Grace motioned to adopt Resolution #2016-164; seconded by Commissioner Salvino. (FIRST READING) City Attorney Ansbro read the title of Ordinance#2017-003. Commissioner Salvino asked about the purpose of this ordinance and its enforceability. City Attorney Ansbro noted that if a resident or business posts a no solicitation sign, solicitors would not be allowed to distribute handbills and would be in violation of the ordinance if they did so. A seller or marketer would be required to register with the City and wear a badge in order to solicit. He addressed the problems with the current ordinance and the impetus to update it to make it constitutionally defensible. Commissioner Salvino motioned to adopt Ordinance #2017-003, on first reading; seconded by Commissioner Grace. Bids and Requests for Proposals 8.1 RESOLUTION#2016-166 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO AWARD A BID TO EVERGLADES CONTRACTING, LLC, IN THE AMOUNT OF FIVE HUNDRED THIRTY NINE THOUSAND THREE HUNDRED SEVENTY THREE DOLLARS ($539,373.00) FOR THE TAYLOR LANE DRAINAGE PROJECT; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. City Attorney Ansbro read the title of Resolution#2016-166. Commissioner Salvino noted this has been ongoing for a few years and asked what will be done. Brad Kaine, Director of Public Services, responded there were mitigating issues that have been overcome. This project will elevate the road, as well as provide drainage easements to handle heavy rainfall. He added that the County constructed swales, a retention area and a limited storm pipe system; our project will address the actual flooding issue and will commence in January. Corinne Lajoie, Principal City Planner, provided an overview of the annexation request, and noted additional applications for the City zoning district and land use designation will need to be submitted after the annexation is completed. She addressed the fees involved in this process and noted the property owner is responsible for them. Mayor James opened the Public Hearing. He asked the Commission to disclose any communication they had on these matters. 9.3 RESOLUTION#2016-157 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE VARIANCE REQUESTS SUBMITTED UNDER APPLICATION NUMBER VA-92-16 BY TOWNHOUSE EAST CONDOMINIUM ASSOCIATION, INC. FOR THE PROPERTY LOCATED AT 450 SOUTHEAST 7TH STREET IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A"; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (Continued from 1112112016) City Attorney Ansbro read the title of Resolution#2016-157. Corinne Lajoie, Principal City Planner,provided an overview of the variance requests. Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,December 13,2016—7:00 p.m. Responding to Vice-Mayor Harris, Marc LaFerrier, Director of Community Development, noted this variance would allow those who have an existing structure that was identified in the engineer's report to be approved for zoning. They would still need to get building permits to ensure that the structure is safe and sound; however, Code Enforcement is not allowed to go into backyards or peer over fences so an investigation would come about as a result of a complaint. We intend to work carefully with the homeowners to make sure the process runs smoothly. The second step is to rewrite the code for townhouse developments to allow for accessory structures in the backyard. Commissioner Salvino felt it is likely none of the existing structures would meet today's building codes and they would have to be torn down and rebuilt. Secondly, his understanding is that the Director of Community Development has the power to allow a structure to be built if the proper permits were pulled; this should also apply to these existing structures. Requiring permits be pulled for existing structures will upset the homeowners. Community Development Director LaFerrier noted that some of the existing structures will be able to pass today's standards and some will be able to make minor modifications. This has to be worked through on a case by case basis; staff deals with issues like this regularly and takes care to help citizens go through the process. Zoning regulations and variances are of a local control and are things we can help with. The building codes are State regulations and we are an agent of the State; we cannot change those regulations. Commissioner Brandimarte noted this is not a new problem and spoke of what Meadowbrook residents went through. Community Development Director LaFerrier reiterated this came about because of a state requirement that when a building gets to a certain age, a report from an engineer is required that certifies that the building is safe. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,December 13,2016—7:00 p.m. City Attorney Ansbro read the title of Resolution#2016-168. Corinne Lajoie, Principal City Planner, described the plat request. Mayor James asked if the plat includes widening of the street, and Principal City Planner Lajoie answered in the affirmative. She noted sidewalks would be required on each property as they are developed. Mayor James opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Vice-Mayor Harris motioned to adopt Resolution #2016-168; seconded by Commissioner Salvino. Discussion and Possible Action There were no discussion items on this agenda. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte commented on the tree lighting ceremony and wished everyone happy holidays. Commissioner Brandimarte said that while the property where Walmart is located is private property, she feels we owe the businesses there some protection against flooding as many are inaccessible when it occurs. Something needs to be done with the landlord. Mark LaFerrier, Director of Community Development, reviewed the memo provided to the Commission by City Manager Baldwin, a copy of which is attached to and incorporated in these minutes. He addressed the conditions of the new Notice of Violation to be issued soon, and noted we will know the results in 3-4 months; a report will be provided to the Commission. 11.2 Commissioner Grace Commissioner Grace reminded everyone children will be out of school for the holidays and to be cautious. She spoke of St. Ruth's Hope for the Holiday event where she and Mayor James received an award for community service. She wished everyone a happy holiday. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,December 13,2016—7:00 p.m. 11.3 Commissioner Salvino Commissioner Salvino had no comments. 11.4 Vice-Mayor Harris Vice-Mayor Harris introduced a film crew that was recording tonight's meeting, and are working on an historical film project about the City of Dania Beach. 11.5 Mayor James Mayor James spoke of a recent teen summit hosted by Royalty, Inc. and the fundraiser at the I.T. Parker Community Center. Mayor James asked when the pier camera will be fixed. City Manager Baldwin noted he would follow up. Mayor James commended the Lions Club for doing a great job year round. Clive Taylor spoke of the Annual Motorcycle Show, at the request of the Commission. 12. Appointments 12.1 Airport Advisory Board—no appointments 12.2 Creative Arts Council Advisory Board Vice-Mayor Harris appointed: Emmanual George 12.3 Education Advisory Board—no appointments 12.4 General Employees Pension Board—no appointments City Attorney Ansbro noted he researched this board and the Police & Fire Pension Board regarding whether or not the ordinances can be changed to remove Commissioners from serving. He will change the ordinance to instead include a Finance Department representative, and a Commission representative need not be appointed at this meeting. 12.5 Grant Advisory Board—no appointments 12.6 Green Advisory Board—no appointments 12.7 Marine Advisory Board Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,December 13,2016—7:00 p.m. Commissioner Grace appointed: Ron Brozic Commissioner Salvino appointed: Joe White Mayor James appointed: Linda Barber 12.8 Nuisance Abatement Board Commissioner Salvino motioned to suspend the Nuisance Abatement Board until needed; seconded by Commissioner Brandimarte. The motion carried unanimously. 12.9 Parks, Recreation and Community Affairs Advisory Board Commissioner Salvino appointed: Lori Lewellen 12.10 Planning &Zoning Board The Commission appointed: Jason Wilson and Dr. Quin Robertson as Alternate members 12.11 Police &Fire Pension Board—no appointments 12.12 Broward League of Cities The Commission appointed: Vice-Mayor Harris as Director, Commissioner Grace as First Alternate, and Commissioner Salvino as Second Alternate Commissioner Grace motioned to approve the appointments; seconded by Vice-Mayor Harris. The motion carried unanimously. 13. Administrative Reports 13.1 City Manager City Manager Baldwin reviewed the memo he distributed to the Commission regarding proposed changes to solar light locations, a copy of which is attached to and incorporated in these minutes. He noted several locations already approved will not work and he would like Commission direction regarding the six proposed options for alternate locations. Commissioner Grace said she has an alternate location in the 200 block of NW 8a'Avenue. The Commission agreed to the six proposed locations and Commissioner Grace's addition. To this date 18 have been successfully installed. Eight of those were not able to be installed due to conflicts with underground utilities and one due to an objection from an adjacent property owner. MEMORANDUM DATE: December 12, 2016 TO: Robert Baldwin, City Manager FROM: Marc LaFerrier, AICP, Director of Community Develop SUBJECT: Drainage Concerns at 401 E Sheridan Street The above-mentioned site was developed in 1991 and has been the subject of isolated and limited on-site drainage concerns in the past. On-site flooding has been intermittent and isolated to the southeast parking area adjacent to the store fronts and restaurants. The rehabilitation of the former Publix store for the new Neighborhood Walmart store included a new drainage system for the Walmart parking area with connections to the existing storm-water infrastructure for the remainder of the site including aforementioned parking area as well as the access driveway on the west side of the site. The applicable site development and building codes require the property owners retain all rainwater on- site with approved methods and infrastructure. The recent citizen's complaint is regarding drainage problems at the southeastern parking area and the western access driveway, however the drainage concerns submitted do not document frequency or duration of the flooding. The frequency and duration of flooding are critical factors in determining adequate drainage for a site. The subject property was previously issued a Notice of Violation (NOV) on December 4, 2015 for inadequate maintenance and repair of the storm-water infrastructure. Subsequently, the Engineer of Record for the Walmart project included the existing drainage infrastructure in their site improvement plans for the Walmart project. Storm water plans are approved by Broward County and also reviewed and permitted by the City. The approved drainage calculation and plans designed by the Engineer of Record for Walmart indicated adequate drainage for the entire site. The NOV was closed September 19, 2016 with approval of the final site inspection for the Walmart project. At this time, staff will monitor the site for post-storm conditions to observe any flooding issues. Furthermore, staff will issue a new NOV specifically for the maintenance and repair of the existing drainage infrastructure for southeastern shops and restaurants and the western access driveway. Further enforcement action may result in additional drainage infrastructure repairs and/or improvements.
