AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA AUTHORIZING THE VOLUNTARY ANNEXATION OF
PARCEL "A" WHICH IS A PARCEL OF REAL PROPERTY OWNED BY
N&D HOLDING, LLC, INTO THE CORPORATE LIMITS OF THE CITY OF
DANIA BEACH, FLORIDA, PURSUANT TO SECTION 171.044, FLORIDA
STATUTES; PROVIDING A LEGAL DESCRIPTION OF THE PROPERTY
SUBJECT TO THE VOLUNTARY ANNEXATION; PROVIDING FOR
PUBLICATION OF NOTICE; PROVIDING FOR FILINGS WITH THE
APPROPRIATE GOVERNMENTAL AGENCIES; PROVIDING FOR
SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Section 171.044 Florida Statutes, a petition for a voluntary
annexation of a parcel of land has been filed with the City of Dania Beach, Florida (see
Attachment "A" incorporated by this reference), consisting of Seven Thousand Nine Hundred
Thirty Six (7,936) feet, owned by N&D Holding, LLC, which parcel is located within
unincorporated Broward County, and which parcel is located in the northeast corner of, but is not
a part of, the Fort Lauderdale-Hollywood International Airport ("Airport") parking lot known as
the Avis Budget Group Maintenance Facility (2371 SW 36 Street [also known as "Collins
Road"]) in unincorporated Broward County; and
WHEREAS, the parcel is located north of Southwest 34th Street, south of Southwest 36t'
Street, lies adjacent to Ravenswood Road, also known as Anglers Avenue, on its east side and
Southwest 241h Avenue is located to the west (all of such roadways being located in or near the
City of Dania Beach, Florida); the parcel is also generally located west of both the Airport and I-
95; and
WHEREAS, the City has determined that all owners of the subject property have
executed the petition for voluntary annexation; and
WHEREAS, the City has determined that the subject property is contiguous to the City
of Dania Beach, that it is reasonably compact, and that its annexation would not create an
enclave; and
WHEREAS, the City has determined that it is able to provide certain essential services,
such as police and fire protection,to the subject property; and
WHEREAS, the City has determined that the Petitioner is in compliance with the
pertinent annexation requirements of Chapter 171 F.S.; and
WHEREAS, the affected property owner and governmental jurisdictions have been
notified according to the laws of annexation;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. The City Commission of the City of Dania Beach, Florida, annexes,
pursuant to a voluntary annexation petition, a parcel of land legally described below, a map of
which is shown on Attachment"A", which is incorporated by this reference into this Ordinance:
LEGAL DESCRIPTION OF ANNEXED PARCEL
(ID# 5042 20 20 001 1)
A portion of Parcel "A", K.D.R. SUBDIVISION, according to the Plat thereof, as
recorded in Plat Book 98, page 28, of the Public Records of Broward County, Florida,
being more particularly described as follows:
Beginning at the Southwest corner of the aforementioned Parcel "A", thence North
01°36'32" West (basis of bearing), along the West line of the aforementioned Parcel "A",
a distance of 76.96 feet to the most Northerly Northeast corner of Parcel `B", of the
NORTHWEST FLL AIRPORT PLAT (PLAT 10), according to the Plat thereof, as
recorded in Plat Book 158, Page 20, of the Public Records of Broward County, Florida,
thence North 89°59'47" East along the Easterly projection of the North line of the
aforementioned Parcel `B", a distance of 100.15 feet to the Westerly right of any line of
Ravenswood Road, being the Point of Curvature of a non-tangent 11499.16 foot radius
curve concave Northeasterly, a radial line at said point bears South 81°05'54" West,
thence along the arc of said curve to the right, being the aforementioned Westerly right of
way line of Ravenswood Road, also being the West line of Parcel 26, as recorded in
Official Records Book 27677, Page 868, Broward County Records, through a central
angle of 00°22'26", for an arc distance of 75.04 feet to the most Easterly Northeast
corner of the aforementioned Parcel `B"; thence South 88°31'40" West, along the South
line of the aforementioned Parcel "A", a distance of 109.88 feet to the Point of
Beginning. Said described parcel containing 7,936 square feet,more or less.
Section 2. The subject parcel to be annexed shall maintain its present Broward
County land use and zoning classification until such time as the City amends its Comprehensive
Plan and Future Land Use Map to include the annexed parcel.
Section 3. Within seven (7) days after the adoption of this Ordinance, the City Clerk
shall file a certified copy of this Ordinance with the Broward County Clerk of the Court, with the
Broward County Administrator, and with the Florida Department of State.
Section 4. That all ordinances or parts of ordinances and all resolutions or parts of
resolutions in conflict with this Ordinance, are repealed to the extent of such conflict.

Section S. That if any section, clause, or provision of this Ordinance is for any reason
held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect
the validity of the remaining portions of this Ordinance.
Section 6. That this Ordinance shall take effect immediately upon its passage and
adoption.

This firm represents N & D Holding, Inc. a Florida corporation ("Owner") who is
petitioning the City of Dania Beach ("City") to annex a portion of Owner's land located in
unincorporated Broward County. Accordingly, we submit this Opinion of Title ("Opinion") as
requested by the City.
With the understanding that this Opinion is furnished to the City as an inducement for the
petition to annex land located on the real property hereinafter described,it is hereby certified that
I have examined the Public Records of Broward County, Florida covering from the beginning to
June 6, 2016 at 6:00 a.m. inclusive, of the following described real property; and I recognize that
the City is relying on this Opinion with regard to the acceptance of a petition for annexation.
The real property is legally described on Exhibit"A" attached hereto and incorporated herein by
reference (the"Property").
The undersigned, William S. Kramer, a partner with Brinkley Morgan, an attorney at law
licensed in the State of Florida and an authorized agent of Fidelity National Title Insurance
Company, a title insurance company duly licensed in the State of Florida, does hereby certify to
the City that I have examined the title to the Property and find the title to said Property is vested
in N & D Holding Inc., a Florida corporation with no mortgages of record not satisfied or
released of record or otherwise terminated by law. Further, I have examined the corporate
