RESOLUTION NO. 2017-006 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,APPROVING THE SITE PLAN(SP-18-16)SUBMITTED BY BIAGI CONSULTING ENGINEERS ON BEHALF OF THE PROPERTY OWNER, ALEX NICHOLS, FOR PROPERTY LOCATED AT 3001 SOUTHWEST 26 TERRACE IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A,"A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City Code of Ordinances,Chapter 28,the"Land Development Code"(the "LDC"),Part 6,entitled"Development Review Procedures and Requirements,"Article 635,entitled "Site Plans" of the City Code of Ordinances (the "City Code") states that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, the Applicant, Biagi Consulting Engineers, on behalf of the owner, Alex Nichols,is requesting site plan approval to permit 23,561 square feet of warehouse space and 3,164 square feet of office space (SP-18-16) as referenced in Exhibit `B" for property located at 4430 Southwest 32 Avenue in the City of Dania Beach,Florida(the"City")as legally described in Exhibit "A,"which is made part of and incorporated into this Resolution by this reference; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS,the City Commission finds that the approval of the proposed Site Plan(SP- 18- 16) is consistent with the City's Code And Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct,and they are made a part of and incorporated into this Resolution by this reference. Section 2. Pursuant to Chapter 28 "Land Development Regulations," Part 6 "Development Review Procedures and Requirements,"Article 635 "Site Plans,"the following Site Plan (SP-18-16), attached as Exhibit `B," which is made a part of and incorporated into this Resolution by this reference,is approved subject to the following conditions which must be satisfied prior to issuance of a building permit unless a different timeframe is specified within a specific condition(references to Sections are to those in the LDC): 1. SIGNS: Provide copy of all signs for compliance review. 2nd time requested. • Per Section 505-120(B) address sign is required. Provide details on plans. • Per Section 505-120(0)the proposed building identification sign entitled"Runway Lakes"is not permitted. Only one (1) sign per tenant is permitted. Revise accordingly or request a variance. Must address this code provision through redesign,or submittal of an application for a variance. A variance request requires submittal of an application,an application fee of $2,300.00 for each requested variance, and a written justification statement addressing the variance criteria identified in Sec. 625-40 of the City's LDR's. Must be addressed with next submittal. • Identify proposed location of monument sign on site plan. OR Provide note on plans stating, "All signage to be under separate review and permitting." (Zoning). 2. Must provide latest revised set of plans on disk prior to going to public hearing(Zoning). 3. Must identify the proposed use on the site plan drawing and in the parking calculations table (Zoning). 4. Color rendering of west elevation does not match floor plans shown with colored east elevation, see location of loading bay. Revise accordingly. 2nd time requested(Zoning). 5. Building elevations missing from 4d' submittal (Zoning). 6. Provide a Fire Protection Plan with the following information only on that plan: a. Water Supply Information as follows: i.All existing and proposed water main sizes—Please provide additional fire hydrant and waters supply details for the surrounding area of the project(approximately 2—3 blocks or the three closest adjacent hydrants). WATER MAINS FOR THIS PROJECT MAY NEED TO BE LOOPED (BSO FIRE). 7. Proof of Water Supply&Fire Flow Demand as follows: a. There is a conflict between the newly submitted Application for Approval of Fire Protection Water Supply Design and the existing Fire Flow Demand Calculations. The existing calculations indicate a 1,913 gpm demand while the newly submitted Application indicates 1,000 gpm. Please clarify and submit documents that match(BSO Fire). 8. Additional Fire Department Access Information as follows: a. Fire Department Access Routes During Construction— Please provide at permit (BSO Fire). 9. Additional Water Supply Information as follows: a. Locations of all Post Indicating Valves or Underground Gate Valves, Double Detector Check Valves, etc. —Please provide at permit(BSO Fire). 10. Address Detail—Please provide at permit(BSO Fire). 11. Provide recorded documentation of all existing drainage and utility easements. Submitted documents(letter dated 7/28/16 from James F. Biagi,PE and copy of Plat Book 158 page 2)do 2 RESOLUTION#2017-006 confirm that easement restriction exists on the drainage and utility easement.That being the case, easement areas should be excluded from any permanent development(Engineering). 12. In compliance with Article 805 of the City Code of Ordinances, applicant shall provide a projection of water demand, and sewage and solid waste generation in tabular format (Engineering). 13. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal (Engineering). Section 3. Pursuant to Section 635-100 "Expiration of Site Plans" of the Land Development Code,the Site Plan(SP-18-16) shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan,within eighteen(18)months from the date of this Resolution. Section 4. That the issuance of a development permit by a municipality does not in any way create any right on the part of an applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on January 24, 2017.
