ORDINANCE NO. 2017-002 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA APPROVING THE PUBLIC DRAINAGE EASEMENT VACATION REQUEST (VC-103-16) MADE BY JUSTIN S. FIORILLI, ESQ., ON BEHALF OF THE PROPERTY OWNER, ALEX NICHOLS, FOR PROPERTY LOCATED AT 3001 SOUTHWEST 26 TERRACE WITHIN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Chapter 28, entitled, "Land Development Code" of Part 6, entitled, "Development Review Procedures And Requirements" of Article 655, entitled, "Vacations Of Right-Of-Way" of the City Code of Ordinances (the "City Code"), Justin S. Fiorilli, Esq., (the "Applicant"), on behalf of the property owner, Alex Nichols, has applied to the City of Dania Beach (the "City") for approval to vacate a 146 linear foot portion of a twenty(20) foot wide public drainage easement on property located at 3001 Southwest 26t` Terrace, as legally described in Exhibit"A" (the"Drainage Easement") (VC-103-16); and WHEREAS, the City Planning and Zoning Board held a duly advertised public hearing on November 16, 2016 and recommended approval of the proposed vacation of the Drainage Easement; and WHEREAS, staff recommended approval of the proposed vacation of the Drainage Easement in its report dated December 13, 2016; and WHEREAS, the City Commission of Dania Beach (the "City Commission") conducted two (2) duly noticed public hearings in accordance with law; and WHEREAS, the City Commission finds that granting the requested vacation of the Drainage Easement will not adversely affect access to neighboring properties and will not be detrimental to the public health, safety and welfare; and WHEREAS, the City Commission finds that the portion of the Drainage Easement subject to this vacation is no longer needed as a public drainage easement, and that it is in the best interest of the City to grant the request to vacate a portion of the Drainage Easement; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. The foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a specific part of this Ordinance. Section 2. Pursuant to Chapter 28, entitled, "Land Development Code" of Part 6, entitled, "Development Review Procedures and Requirements" of Article 655, entitled, "Vacations Of Right-Of-Way" of the City Code, the requested vacation of the Drainage Easement(VC-103-16), as shown in the attached Exhibit"A," is approved. Section 3. If any clause, section, sentence or phrase of this Ordinance is for any reason held unconstitutional or invalid by a competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Section 4. All ordinances or parts of ordinances, resolutions or parts of resolutions in conflict with this Ordinance are repealed to the extent of such conflict. Section 5. This Ordinance shall be in force and take effective immediately upon its passage and adoption. PASSED on first reading on December 13, 2016. It is my opinion that the easement was characterized incorrectly when it was platted in year 1994. The water runoff from the Marina Mile Business Park does not pass over the subject easement or over the property at 3001 SW 26 Terrace.The topography of the area shows that the drainage from the Marina Mile property flows South,West of the 3001 SW 26 Terrace property,and into the lake. Vacating the drainage easement will have no effect on the Marina Mile Business Park, nor on the lake bordering the Business Park. Additionally, the 3001 SW 26 Terrace property, as is the Marina Mile Business Park, is designed to use exflltration trenches as its drainage system to store and infiltrate any runoff. Therefore,vacating the easement will not cause water to build up on either property. Mr.Alex Nichols will be responsible, logistically and monetarily,for executing the vacation of the drainage easement.
