Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Tamara James Vice-Mayor: Bill Harris Commissioners: Chickie Brandimarte Bobbie H. Grace Marco A. Salvino, Sr. City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Moment of Silence and Pledge of Allegiance_ Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Special event request from the South Florida Regional Transportation Authority to have their annual "Rail Fun Day" on January 28, 2017 from 11:00 a.m. - 3:00 p.m., at the Tri Rail Station located at 500 Gulf Stream Way Commissioner Grace motioned to approve the Special Event request for the South Florida Regional Transportation Authority's Rail Fun Day; seconded by Commissioner Salvino. The motion carried unanimously. 4. Proclamations There were no proclamations at this meeting. Mayor James advanced Items#9.4 and#9.5. City Attorney Ansbro noted these are quasi-judicial hearings and swore-in those who would speak. He asked the Commission to disclose any communication they had regarding this matter. Vice-Mayor Harris and Mayor James noted they had communications with the applicant and residents. 9.4 RESOLUTION#2017-002 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN(SP-52-16), SUBMITTED BY DUNAY, MISKEL& BACKMAN, LLP ON BEHALF OF THE OWNER, CALM PROPERTIES, LLC, FOR PROPERTY LOCATED AT 601 EAST DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (Continued from January 10,2017) 9.5 RESOLUTION#2017-001 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE "CALM PLAT" (PL-39-16) SUBMITTED BY PULICE LAND SURVEYORS, INC., ON BEHALF OF CALM PROPERTIES, LLC, FOR PROPERTY LOCATED AT 601 EAST DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (Continued from January 10,2017) City Attorney Ansbro read the title of Resolution #2017-002 and Resolution #2017-001 because they relate to the same property; he noted the applicant is requesting a continuance until the February 14, 2017 City Commission meeting. Bonnie Miskel of Dunay Miskel & Backman LLP, representing the applicant, noted she had a presentation for tonight; however, they are still reviewing and making plans for revisions to the proposed development. She requested a postponement until the next City Commission meeting. Commissioner Brandimarte commented this is the third time the residents have appeared and no action is taken on this item. Attorney Miskel responded they have a plan that is compliant with code, however they are trying to work with the community. Mayor James opened the Public Hearings. Douglas Edwards, 75 Gulfstream Road, #300, requested the other members of the community come to the podium. He requested the Commission motion for a mandatory workshop to resolve the issues. City Attorney Ansbro responded this matter does not lend itself to that type of meeting. He noted input from the public is not taken at a workshop. Rick Romero, 75 Gulfstream Road, #106B, said they were trying to meet with the attorney, however there needs to be public input because the public is unaware of development in the City. Commissioner Grace noted that Attorney Miskel is willing to meet and talk to the residents. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,January 24,2017—7:00 p.m. Constanting Manos, 75 Gulfstream Road, #214, wished that Attorney Miskel had met with them weeks ago. He noted they are not against development, but they do not want to have a 14-story building near their neighborhood. They are agreeable to 7 floors, and they are willing to negotiate and be reasonable. Linda Barber, 75 Gulfstream Road, #305, indicated this has been going on for eight months, and nothing came from the one meeting they had with the attorney's representative. Rob Davis, 75 Gulfstream Road, #104B, complained about the notice he received from the City because it did not show the Sea Oaks community. He also complained that this is the only notice he has received in four years. Peter Parella, 85 Gulfstream Road, #110, said politics is a dirty business and he is concerned as to how the developer was willing to present nearly $6 million for a project that has not been confirmed. Tom Smitha, 85 Gulfstream Road, #212A, stressed how important this decision is to the City, and felt there are better ways to do it as it will have big consequences after the vote is taken. Ryan Stone, 501 E Dania Beach Boulevard, #1-H, expressed his concerns with the height of the proposed building, and other possible developments in the area. Rick Romero spoke about the RAC. Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public Hearings. Commissioner Grace motioned to continue Resolution #2017-002 and Resolution #2017-001 until the February 14, 2017 City Commission meeting at 7:00 p.m.; seconded by Commissioner Brandimarte. Citizen Comments Pat Wright, 4391 SW 34 Lane, expressed her concerns with the 150-unit development approved for SW 32"d Avenue. She wants the Commissioners to take responsibility to fight for a stop light either on 33`d or 34t'Avenues. Vice-Mayor Harris noted he will obtain information from the MPO as to what the plan is for that area. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,January 24,2017—7:00 p.m. Anthony Amos, 101 SE 3rd Avenue, addressed Items #10.2 and #10.3 on the agenda. He noted he is opposed to selling alcohol on the beach. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, spoke of recent burglaries and arrests in the City. He noted Deputy Weir was in a vehicle accident today, but she will be okay. Vice-Mayor Harris noted the residents behind his office would like additional patrols at night. Sean Brown, Battalion Chief, BSO Fire Rescue, was available to answer questions. 7. Public Hearings and Site Plans City Attorney Ansbro advised the remaining items were quasi-judicial hearings and swore-in those who would speak. Corinne Lajoie, Principal City Planner, provided an overview of the vacation request and site plan. Mayor James opened the Public Hearings. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearings. Commissioner Grace motioned to adopt Ordinance #2017-002, on second reading; seconded by Commissioner Salvino. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Harris Yes Commissioner Grace Yes Mayor James Yes Commissioner Salvino Yes 9.3 RESOLUTION#2017-007 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SUBMITTAL OF AN APPLICATION BY BK STERLING INVESTMENT,LLC FOR THE VACATION OF A PORTION OF RIGHT OF WAY LOCATED ADJACENT TO 1800 STIRLING ROAD, DANIA BEACH, FLORIDA,PURSUANT TO A REQUEST FOR A WAIVER FROM THE REQUIREMENTS FOR A NEW PLAT SUBMISSION AND APPROVAL; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Discussion and Possible Action 10.1 2017 Legislative Agenda—City Manager Baldwin City Manager Baldwin reviewed the information that was provided in the agenda packet. The information will be provided to Ron Book so he can lobby for the City in Tallahassee. Commissioner Grace requested Vice-Mayor Harris obtain additional information from the Broward League of Cities. 10.2 Hours of Alcoholic Beverage Sales—Commissioner Salvino Minutes of Regular Meeting Dania Beach City Commission Tuesday,January 24,2017—7:00 p.m. Commissioner Salvino asked the Commission to consider modifying the City's regulations to allow sale of alcohol on Sunday mornings for restaurants and stores to coincide with the City of Hollywood. Commissioner Grace spoke of the convenience stores on NW 1st Street, and said she is against allowing Sunday morning alcohol sales at stores, but does not object to restaurants being allowed to do so. Commissioner Brandimarte noted she has not been contacted by anyone to change the hours. Commissioner Salvino spoke of our loss of alcohol sales to Hollywood, and asked the City Manager to bring two different ordinances to the Commission to vote upon. The Commission needs to look at the convenience this change would bring to the residents of the City. Mayor James noted they have an issue in the NW section with drug addicts and alcoholics; she felt we would be opening up a Pandora's Box by allowing this on Sunday, and she opposes it. Vice-Mayor Harris agreed that market conditions are changing, and the enforcement should be in the hands of the establishments. In a free market economy, it should be available everywhere. City Manager Baldwin noted we are trying to deal with the problem that needs to be addressed in certain areas. Commissioner Grace noted she is not against drinking, but it needs to be done orderly. Vice-Mayor Harris said the ordinance should specify conditions for compliance. City Attorney Ansbro addressed on premise and off premise consumption, and noted he will draw up two separate ordinances for Commission review. 10.3 Food and Beverage Service on the Beach—Mayor James Mayor James noted the beaches in Israel are very clean and controlled, with restaurants and concessions. She indicated a controlled area on the beach should be available for service for both the Quarterdeck and Dania Beach Grill. Commissioner Salvino noted he does not have a problem with this, but does not understand Mayor James' contradiction with the neighborhoods. The restaurants should be responsible for having a lifeguard on duty and cleaning up the trash. Allowing this would also provide additional revenue for the City. Vice-Mayor Harris agreed with Commissioner Salvino regarding making the restaurants responsible. Commissioner Brandimarte noted alcohol is forbidden on Fort Lauderdale and Hollywood beaches. She also addressed the trash on the beach and problems we would have with Spring Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,January 24,2017—7:00 p.m. Break. If we like this idea that much, we should renegotiate with the Quarterdeck to make them responsible for the lifeguard and clean-up of the beach that they will be using. She emphasized that not everyone drinks nor wants to expose their children to drinking. She reiterated her concern with bringing Spring Breakers here and the resulting crime rate, as well as damage to the beach. Commissioner Grace noted she has to be cautious about what she said about the stores because we need to be conformative throughout the City about what we do. She questioned how we control the atmosphere of alcohol on the beach. Commissioner Salvino explained the difference is the element of the beach. Mayor James requested an ordinance be drafted. City Attorney Ansbro responded it would not be an ordinance. We would need to discuss the possibility with the two restaurants and renegotiate the terms of their agreements. City Manager Baldwin noted the current code would require an ordinance change. Betty Sokol, 609 NW 10 Street, commented the sign at the beach says no alcoholic beverages allowed. She questioned how it could be allowed at the restaurants' locations but not along the entire beach, and added she thinks it is a terrible idea. Anthony Amos, 101 SE 3rd Avenue, questioned the liability issue, and noted he does not think it will work here. He is concerned that alcohol will be on both ends of the beach. Charlotte Sloboda, 2905 Lakeshore Drive, spoke in favor of the proposal. Vice-Mayor Harris agreed with Ms. Sloboda. He felt we should do this on a trial basis, make the restaurants accountable for it, and see how it goes. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte congratulated the MLK Committee for the event. 11.2 Commissioner Grace Commissioner Grace noted she will have an open mind when discussing Items #10.2 and #10.3 when they come back to the Commission. 11.3 Commissioner Salvino Commissioner Salvino complimented the MLK Committee for the event. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,January 24,2017—7:00 p.m. 11.4 Vice-Mayor Harris Vice-Mayor Harris had no comments. 11.5 Mayor James Mayor James spoke about re-branding the City; we need to change the culture of who we are and what we stand for, and we need a new motto. She felt we should bring in a marketing company and should promote why people need to come here and stay here. She even supports getting a new logo. She added the City Manager will be reaching out to the Commission for participation in promotion activities. Mayor James stated our Parks & Recreation has great facilities that are underutilized and we need to do a study to see what we can do with them. She felt our parks are boring, and we have so much more to offer to our residents. Mayor James addressed the MLK event and noted she is concerned with the direction the event is going. We need to have more interaction with our schools and businesses relative to the parade and route. She felt the event needs better planning and the City needs to be more involved. She added she spoke with staff and there were problems with the MLK Committee submitting paperwork. If the City cannot be more hands on with the money we are giving to an organization to put on the events for the City, then we should run the events ourselves. Peter Parella, 85 Gulfstream Road, #110, apologized for his earlier comments. 12. Appointments 12.1 Airport Advisory Board Commissioner Brandimarte appointed: William Prescott Commissioner Salvino appointed: Chris Christianson, Dean Harley, and Richard Ramcharitar Mayor James appointed: Douglas Hasty and Karen Harrington 12.2 Education Advisory Board—no appointments 12.3 General Employees Pension Board—no appointments 12.4 Grant Advisory Board Commissioner Salvino suggested we do away with the board; Commissioner Brandimarte agreed. Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,January 24,2017—7:00 p.m. Pat Wright, 4391 SW 34th Lane, member of the Grant Advisory Board, noted they are trying to do a website, but without much success, and she is in favor of dissolving the board. Vice-Mayor Harris motioned to suspend the Grant Advisory Board; seconded by Commissioner Brandimarte. The motion carried unanimously. 12.5 Green Advisory Board Commissioner Brandimarte appointed: Carol Stokrocki 12.6 Marine Advisory Board Commissioner Grace appointed: Gregory Galyo Commissioner Salvino appointed: Glenn Harrington Vice-Mayor Harris appointed: Peggy McKenna and Sheldon Snyder Mayor James appointed: Ryan Stone 12.7 Parks, Recreation and Community Affairs Advisory Board Commissioner Brandimarte appointed: Jimmie Peterman Commissioner Salvino appointed: Samantha Christianson 12.8 Planning&Zoning Board Commissioner Salvino appointed: Kenya Peterman 12.9 Police &Fire Pension Board—no appointments Commissioner Grace motioned to approve the appointments; seconded by Commissioner Brandimarte. The motion carried unanimously. 13. Administrative Reports 13.1 City Manager City Manager Baldwin noted we have been working with BSO and Code to work together as multijurisdictional teams; we are approaching this as a task force doing inspections under one team. City Manager Baldwin spoke of the ongoing problems with Uber drivers. Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,January 24,2017—7:00 p.m. City Manager Baldwin noted the Mayor and Vice-Mayor are interested in branding; ideas from discussions will be brought to the Commission to come up with a plan. City Manager Baldwin gave an update of the COPS and LETF grants. He noted he asked the Fire Department to give him a recommendation on the SAFER Grant for the upcoming budget. City Manager Baldwin noted he will meet individually with Commissioners for input on Phase II of the beach redevelopment plan; a consultant will then modify the plan. City Manager Baldwin said the State of the City address and Oasis video would be updated with the new Mayor and Vice-Mayor. City Manager Baldwin added we are going to apply to the FLC for a municipal achievement award for the Oasis program. 13.2 City Attorney City Attorney Ansbro had no comments. 13.3 City Clerk-Reminders Tuesday, February 14, 2017—6:00 p.m. CRA Board Meeting Tuesday, February 14, 2017—7:00 p.m. City Commission Meeting Tuesday, February 28, 2017—7:00 p.m. City Commission Meeting 14.
