Dania Beach Blvd. as Described in Exhibit ''A'' RESOLUTION NO. 2017-001 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,APPROVING THE"CALM PLAT"(PL-39-16)SUBMITTED BY PULICE LAND SURVEYORS,INC.,ON BEHALF OF CALM PROPERTIES, LLC,FOR PROPERTY LOCATED AT 601 EAST DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,pursuant to Chapter 28 of the Code of Ordinances of the City of Dania Beach (the "Code"), which chapter contains the City Land Development Code (the "LDC"), pursuant to Part 6, "Development Review Procedures and Requirements",Article 640 "Plats", it is stated that since June 4, 1953,no principal building may be constructed on any lot unless a plat including the lot has been approved by both the City Commission and County Commission, and recorded in the official records of Broward County; and WHEREAS, Pulice Land Surveyors, Inc., on behalf of Calm Properties, LLC (the "Applicant"), is requesting plat approval (PL-39-16), for property legally described in attached Exhibit"A",which is made a part of and is incorporated into this Resolution by this reference; and WHEREAS,the"Calm Plat"(PL-39-16),is restricted to 360 high-rise residential units and twelve thousand(12,000)square feet of commercial use and no free standing or drive-through bank facilities are permitted without the approval of the Broward County Commission; and WHEREAS, on February 28, 2016, the City's Development Review Committee (the "DRC"), which includes representatives from the Broward Sheriffs Office, Broward Fire Department,Public Services Department,the City's landscape consultant and the Planning Division staff, reviewed the plat for compliance with all applicable regulations; and WHEREAS, staff recommends approval of the plat for the mixed use project; and WHEREAS,the City Commission conducted a duly noticed public hearing in accordance with Article 640 of the LDC; and WHEREAS,the City Commission finds that the approval of the proposed plat will protect the public health, safety and welfare of residents of the City, and furthers the purposes, goals, objectives and policies of the City's Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct, and they are made a specific part of this Resolution. Section 2. That the application for the "Calm Plat" (PL-39-16), a copy of which is attached as composite Exhibit`B",which is made a part of and incorporated into this Resolution by this reference, is approved subject to the conditions referenced in Section 3. Section 3. The approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. Per Broward County's Development Review Report,dedicate a right-of-way for a westbound right turn lane on Dania Beach Boulevard(SR A-1-A)at the east 24-foot opening with 135 feet of storage and 50 feet of transition. 2. Provide an 8-foot wide by 14-foot long bus shelter easement on Dania Beach Boulevard(SR A-1-A) commencing 150 feet east of the west plat limit and continuing east for 14 feet. 3. Dedicate a 2-foot wide by 40-foot long paved bus landing pad (8-foot total expanded sidewalk)on Dania Beach Boulevard(SR A-1-A)commencing 150 feet east of the west plat limit and continuing east for 40 feet. 4. Amend the note on the plat to identify the restriction of 360 residential units consistent with the approved Site Plan. Section 4. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 5.
