HomeMy WebLinkAboutR-2017-002 Calm Site Plan (SP-52-16) RESOLUTION NO. 2017-002 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,APPROVING THE SITE PLAN(SP-52-16),SUBMITTED BY DUNAY, MISKEL&BACKMAN,LLP ON BEHALF OF THE OWNER, CALM PROPERTIES,LLC,FOR PROPERTY LOCATED AT 601 EAST DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT"A", A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,pursuant to Chapter 28,the"Land Development Code" (the"LDC"), Part 6, entitled"Development Review Procedures and Requirements,"Article 635,entitled"Site Plans"of the City Code of Ordinances (the "City Code") provides that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS,Dunay,Miskel&Backman,LLP on behalf of the owner,Calm Properties,LLC (the "Applicant"), is requesting site plan approval for the proposed construction of a new fourteen (14) story(360 units) multifamily residential development, and sixty-nine hundred(6,900) square feet of commercial development(SP-52-16)as referenced in Exhibit`B,"for property located at 601 East Dania Beach Boulevard in the City of Dania Beach,Florida(the"City"),as legally described in Exhibit "A", a copy of which is made a part of and incorporated into this Resolution by this reference; and WHEREAS,pursuant to Chapter 28,Part 3 "Special Zoning District,"Article 305,entitled "Incentives,"the Applicant has utilized Section 305-60"Provide Public Parking"as the incentive to obtain increased density, height and stories; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS,the City Commission finds that the approval of the proposed Site Plan(SP-52- 16) is consistent with the City's Land Development Code and Comprehensive Plan; NOW, THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct,and they are made a part of and incorporated into this Resolution by this reference. Section 2. That pursuant to Chapter 28 "Land Development Regulations," Part 6 "Development Review Procedures and Requirements,"Article 635"Site Plans," the following Site Plan (SP-52-16),attached as Exhibit`B,"which is made a part of and incorporated into this Resolution by this reference, is approved subject to compliance with the following conditions which must be satisfied prior to issuance of a building permit unless a different timeframe is specified within a specific condition(references to Sections are to those in the LDC): 1. Additional Fire Department access information needed as follows: a) Fire Lane locations and striping detail (demonstrated) b) "NO PARKING" sign locations and sign details c) Fire Department Access Routes during Construction. Must be addressed prior to issuance of permit(BSO Fire). 2. Additional Water Supply Information as follows: a) Locations of all Post Indicating Valves or Underground Gate Valves, Double Detector Check Valves, etc. Must be addressed prior to issuance of permit(BSO Fire). 3. A detail sheet accompanying the Civil Plans with the following details: b) Fire Hydrant Detail Bollard / Impact Protection Detail for Hydrants, FDC's & DDCV's Roadway Pavement Marker (RPM) Detail for Fire Hydrant Locations (Blue Reflective Markers) c) Post Indicating Valve Detail (where applicable) d) Underground Gate Valve Detail (where applicable) e) Backflow Preventer / Double Detector Check Valve (DDCV) Detail (where applicable)that identifies the DDCV as being listed for Fire Use f) Signage Detail for the Fire Department Connections (where applicable) Must be addressed prior to issuance of permit(BSO Fire). 4. Address Detail Must be provided prior to issuance of permit(BSO Fire). 5. An egress plan demonstrating and dimensioning all common paths of travel and travel distances to all exits within the buildings and/or structures. Must be addressed prior to issuance of permit(BSO Fire). 6. RAC TRAFFIC IMPACT MITIGATION: The engineering statement from Langan Engineering dated September 27, 2016 stated the project would generate 169 net new P.M. peak hour trips. The RAC Traffic Impact Mitigation fee is $26.21 per P.M. peak hour trip, 2 RESOLUTION#2017-002 therefore $3,592.94 (166 X 21.26 = 3,592.94) is required to be paid prior to issuance of a building permit. 7. Compliance with Article 309"Complete Streets Improvements"is required.Construction of improvements or payment-in-lieu of construction is required. 8. Per Resolution No.2014-071 the City's Recreation and Open Space Impact fee is$1,364.00 per multi-family dwelling unit to be paid prior to issuance of a building permit. 9. Improve Gulfstream Road to rehabilitate the entire roadway width, including resurface, pavement markings, signage, new sidewalk and new right turn lane onto Dania Beach Boulevard and any necessary transitions. ROW easement dedications to be shown on site plan and recorded in Broward County Public Record prior to issuance of a building permit. 10. All garage lights to be shielded from residential property to the north so as not to shine on,or in the direction of the neighboring property. Provide details. 11. Provide an eight (8) foot wide by fourteen (14) foot long bus shelter easement on Dania Beach Boulevard commencing 150 feet east of west plat limit and continuing east for fourteen(14) feet, per Broward County Development Review Report. 12. Provide a two(2)foot wide by forty(40)foot long paved bus landing pad(8'total expanded sidewalk) on Dania Beach Boulevard commencing 150 feet east of west plat limit & continuing east for forty feet,per Broward County Development Review Report. 13. Revise all site plans to show property line consistent with plat and civil plans. Section 3. That pursuant to Section 635-100 "Expiration of Site Plans" of the Land Development Code,the Site Plan(SP-52-16) approval shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan,within eighteen(18)months from the date of this Resolution. Section 4. Such application must be reviewed by the Broward County Aviation Department;the point of contact is William Castillo,Airport Planner,located at 220 SW 45 Street, Suite 101, Dania Beach, Florida 33312 (954)359-6100. 3 RESOLUTION#2017-002 Section 5. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7.
