HomeMy WebLinkAboutR-2017-011 I-595 Business Center Plat Note Amendment (DR-112-16) RESOLUTION NO. 2017-011 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING A PLAT NOTE AMENDMENT TO THE ISGETTE'S RUNWAY PLAT (DR-112-16) SUBMITTED BY MSG DANIA BEACH, LLC, FOR PROPERTY LOCATED ON THE EAST SIDE OF SW 30 AVENUE, THE SOUTH SIDE OF INTERSTATE 595 AND NORTH OF SW 36 STREET IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A"; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the boundary Plat known as "Isgette's Runway" was approved by the Broward County Planning Council on September 23, 1992; and, WHEREAS, pursuant to Chapter 28, "Land Development Code," Part 6, "Development Review Procedures And Requirements," Article 640, "Plats", of the City Code of Ordinances (the "City Code"), MSG Dania Beach, LLC (the "Applicant"), has submitted an application (DR- 112-16) to the City of Dania Beach, Florida (the "City"), for approval of a Plat Note Amendment attached as Exhibit `B," for property legally described in Exhibit "A"„ both Exhibits are made a part of and are incorporated into this Resolution by this reference; and WHEREAS, the Applicant is requesting to amend the Plat Note, as follows: FROM: Parcel A-1 (see attached legal description) is restricted to 60,000 square feet of office use, Parcel A-2 (see attached legal description) is restricted to 100,000 square feet of office use and 100,000 square feet of technical vocational school use, and remainder of Parcel A will be industrial use. This serves as notification of potential aircraft over flight and noise impacts on this property due to its close proximity to the Fort Lauderdale-Hollywood International Airport and is not eligible for noise mitigation. TO: Parcel A-1 (see attached legal description) is restricted to 60,000 square feet of office use, Parcel A-2 (see attached legal description) is restricted to 150,000 square feet of industrial use. The remainder of Parcel A is restricted industrial use. Industrial uses on Parcel A-2 may have a maximum of thirty percent (30%) ancillary office/commercial use or a maximum of fifty percent (50%) ancillary office use upon satisfaction of impact/concurrency fees. This serves as notification of potential aircraft over flight and noise impacts on this property due to its close proximity to the Fort Lauderdale-Hollywood International Airport and is not eligible for noise mitigation; and WHEREAS, Broward County requires that the City concur with the proposed Plat Note Amendment prior to a review by the Broward County Commission; and WHEREAS, the City Commission finds that the approval of the proposed Plat Note Amendment complies with the City Code and will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That the Plat Note Amendment (DR-112-16) which changes the restrictive note on the "Isgette's Runway" Plat to read as specified above, to also provide for 60,000 square feet of office use on Parcel A-1 and as otherwise provided in the attached Exhibit `B," a copy of which is made a part of and incorporated into this Resolution by this reference is accepted and approved. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. 2 RESOLUTION#2017-011 Section 4. That this Resolution shall be in force and take effect immediately upon its passage and adoption.
