HomeMy WebLinkAboutR-2017-012 I-595 Business Site Plan (SP-113-16) RESOLUTION NO. 2017-012 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-113-16) AS SUBMITTED BY MSG 1-595, LLC, ON BEHALF OF THE PROPERTY OWNER, PANTROPIC POWER, INC., FOR PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF SW 30 AVENUE, THE SOUTH SIDE OF INTERSTATE 595 AND NORTH OF SW 36 STREET IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A"; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Chapter 28, the "Land Development Code" (the "LDC"), Part 6, entitled "Development Review Procedures and Requirements," Article 635, entitled "Site Plans" of the City Code of Ordinances (the "City Code") provides that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, MSG I-595 LLC (the "Applicant") is requesting site plan approval for the proposed construction of a 150,000 square foot warehouse development (SP-113-16) as referenced in Exhibit `B," for property generally located on the east side of SW 30ffi Avenue, the south side of Interstate 595 and north of SW 36t' Street in the City of Dania Beach, Florida (the "City"), as legally described in Exhibit "A", which Exhibit is attached and made a part of and incorporated into this Resolution by this reference; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the proposed Site Plan (SP- 113-16) is consistent with the City's Land Development Code and Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That pursuant to Chapter 28 "Land Development Regulations," Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plans," the following Site Plan (SP-113-16), attached as Exhibit `B," which is made a part of and incorporated into this Resolution by this reference, is approved subject to compliance with the following conditions which must be satisfied prior to issuance of a building permit unless a different timeframe is specified within a specific condition (references to Sections are to those in the LDC): 1. Provide a traffic study conducted after the opening of Ravenswood Road (also known as Anglers Avenue) prior to the issuance of a Certificate of Occupancy. 4"' time requested. 2. Provide line of sight study on landscape plans indicating how the height and thickness of the landscaping will shield the outdoor storage and fleet parking from view by the on-coming traffic on SW 30 Avenue. 3. Per the Broward County Trafficways Plan, a minimum right-of-way width of 94' is required on SW 30 Avenue. Provide right-of-way dedication to meet this requirement 4. Indicate new property line on plans. 5. Per Sec. 265-50 (64), office space is to be included in the warehouse area for parking calculations. The applicable parking ratio is 1:1000. 150,000 sf requires 150 parking spaces. Revise cover sheet to reflect the accurate parking count that is required for the site. 6. Per Sec. 270-20, indicate locations, dimensions, and quantity of loading spaces on plans. 7. Per Section 505-100 (N) only 1 wall sign is permitted per tenant. Revise plans. 8. A monument sign may not be located off-premise. Revise plans to remove the sign located on the SW property line. 9. Per Section 270-20, indicate location and dimensions of each loading space on the site plan. 10. Provide colored elevations. 11. Previous comment still applies. Note that the response letter provided with the submittal states that tamarind trees have been added but no tamarind trees are labeled/located on plans. Replace most of the proposed gumbo limbos with another species. 40 gumbo limbos is an unacceptably large amount of the same species. (LANDSCAPE) 12. There is an overabundance of certain trees within the City of Dania Beach. These species have higher maintenance requirements, poor performance during storm 2 RESOLUTION#2017-012 events, and are prone to pest issues. In order to diversify the City's canopy, alternative tree species are recommended for installation. Common acceptable substitutions for these tree species include: wild tamarind (Lysiloma latisiliquum), paradise tree (Simarouba glauca), red maple (Acer rubrum), bald cypress (Taxodium distichum), blolly (Guapira discolor), lancewood (Nectandra coriacea), and sycamore (Plantanus occidentalis). These trees have been observed to be well adapted to the urban forest environment. Previous comment still applies. Indicate with a symbol of callout which trees onsite have been moved from terminal islands to a different planting location. (LANDSCAPE) 14. Terminal islands do not meet Sec. 275-100 requirement of two Category 1 trees. If there is not sufficient room within the islands to meet this requirement, indicate the alternative planting location on the plans. (LANDSCAPE) 15. Complete the mitigation table on sheet TD-2.2. List total canopy proposed for removal (in square feet) and how the canopy will be mitigated. Note that canopy being removed must be mitigated at a rate of 150%. (LANDSCAPE) 16. Please provide the following Additional Fire Department Access Information as follows: a. "NO PARKING" signs in front of each fire hydrant. (FIRE) b. Fire Department Access Routes During Construction - WILL PROVIDE AT PERMIT (FIRE) 17. Provide an egress plan demonstrating and dimensioning all common paths of travel and travel distances to all exits within the buildings, structures or both. WILL PROVIDE AT PERMIT (FIRE) 18. Address the following comments on the submitted traffic study: a. Driveway for both the existing building (Marina Mile) and the new proposed 1-595 Business Center is shared, need statement of total generated traffic from this combined site, not just on proposed development. (CITY ENGINEER) 3 RESOLUTION#2017-012 b. Traffic impact on the following intersections would need to be evaluated to determine deterioration of level of service, if any: (CITY ENGINEER) i. SW 30th Avenue and Marina Mile Boulevard ii. Project driveway and SW 30th Avenue iii. SW 30th Avenue and SW 36th Street c. Since anticipated peak traffic (AM peak) is greater than 100 trips, a full traffic impact study would need to be provided per ITE Recommended Practice, 2010. (CITY ENGINEER) d. Please submit proposed scope and methodology, in writing, for review, signoff or both, before proceeding. (CITY ENGINEER) e. Proposed ingress/egress and offsite development refer to SW 30th Avenue, a collector road, under the jurisdiction of the City of Hollywood and Broward County Highway Engineering and Traffic Engineering Division trafficways. Please coordinate separately with these agencies and copy this Department of any correspondence and agreements with them. Final signoff by the City of Dania Beach on proposed driveway connection on SW 30th Avenue is contingent on approvals from these agencies. (CITY ENGINEER) f. Show anticipated vehicles per day for each driveway connection on the civil site plan. (CITY ENGINEER) g. Show sight distance analysis using FDOT Index No. 546 at proposed driveway on SW 30th Avenue. This needs to be shown on the civil and landscape plans. (CITY ENGINEER) 19. Provide copy of pre- and post-development stormwater management and drainage calculations. More specifically identify and provide the following information: 10- year, 25-year and 100-year, 24 hour and 72 hour flood stage elevations. Data provided in the stormwater management calculations do not agree with the overall site data (13.88 acres vs 10.77 acres). On the other hand, survey shows 16.5 acres. Please revisit calculations. (CITY ENGINEER) 20. Proposed grading and drainage plan shall be based on the stormwater management calculations. (CITY ENGINEER) 4 RESOLUTION#2017-012 21. Per City Code of Ordinances (Article 415 — Sidewalks and Swales), Owner is responsible for sidewalks and swale improvements within the road right-of- way. (CITY ENGINEER) 22. In compliance with Article 805 of the City Code of Ordinances, applicant shall provide a projection water demand, and sewage and solid waste generation in tabular format. (CITY ENGINEER) 23. Provide drawing file (dwg or dgn disk) of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal. (CITY ENGINEER) Section 3. That pursuant to Section 635-100 "Expiration of Site Plans" of the Land Development Code, the Site Plan (SP-52-16) approval shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen (18) months from the date of this Resolution. Section 4. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 5. That such application must be reviewed by Broward County Aviation Department. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. 5 RESOLUTION#2017-012 Section 7.
