Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Tamara James Vice-Mayor: Bill Harris Commissioners: Chickie Brandimarte Bobbie H. Grace Marco A. Salvino, Sr. City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Special Event Request from The Field Irish Pub and Eatery for their annual St. Patrick's Day Celebration to be held on March 17, 2017 from 11:00 a.m. - 11:00 p.m. The applicant is also requesting a road closure on Griffin Road, temporary signage, fence, and BSO Detail. Commissioner Grace motioned to approve the Special Event request for The Field's St. Patrick's Day Celebration; seconded by Commissioner Brandimarte. The motion carried unanimously. 3.2 Special Event Request from the Community Redevelopment Agency for the "Dania Beach 2017 Arts and Seafood Celebration", to be held on April 8-9, 2017, at Frost Park from 11:00 a.m. - 8:00 p.m. on Saturday and from 11:00 a.m. - 6:00 p.m. on Sunday. The applicant is requesting BSO Police and Fire Services, and road closures for Fronton Boulevard from N.E. 2°d Street to N.E. Is' Street. Commissioner Grace motioned to approve the Special Event request for the 2017 Arts and Seafood Celebration; seconded by Commissioner Brandimarte. The motion carried unanimously. 3.3 Special Event Request from the Marine Industries Association of South Florida for their "40th Annual Broward County Waterway Cleanup" to be held on March 4, 2017, from 9:00 a.m. - 1:00 p.m. This event will be held in various locations around Dania Beach such as Dania Beach Pier, Marina, Secret Woods, Harbour Towne and Dr. Von D. Mizell-Eula Johnson State Park. The applicant is requesting the following: a Special Event fee waiver of $150.00, waiver of parking fees for volunteers, and for the City to provide dumpsters for all cleanup sites. Commissioner Grace motioned to approve the Special Event request for the 40th Annual Broward County Waterway Cleanup; seconded by Vice-Mayor Harris. The motion carried unanimously. 3.4 Spoken Words—Herbert Hammer Jackson(Commissioner Grace) Herbert Hammer Jackson spoke of Black History Month. 4. Proclamations 4.1 Black History Month—Commissioner Grace Mayor James read the Black History Month Proclamation. 4.2 Greater Mt. Zion AME Church 108th Anniversary—Mayor James Mayor James read the Greater Mt. Zion AME Church 108th Anniversary Proclamation. Mayor James advanced Items#9.2 and#9.3. City Attorney Ansbro explained how quasi-judicial hearings are to be conducted. He advised the public hearing items were quasi-judicial hearings and swore-in those who would speak for all the public hearings on the agenda. (Continued from January 10,2017 and January 24,2017) Commissioner Salvino noted he spoke with residents in the past. Vice-Mayor Harris noted he spoke with residents before the election. Mayor James noted she spoke with the residents, staff and the applicant. City Attorney Ansbro read the title of Resolution #2017-002 and Resolution #2017-001 because they relate to the same property. Corinne Lajoie, Principal City Planner, provided a PowerPoint presentation of the site plan and plat requests, which presentation is attached to and incorporated into these minutes. Christina Bilenki, attorney representing the applicant, presented a PowerPoint overview of the proposed site plan and plat, which is attached to and incorporated into these minutes. John Kim, Miami Engineering, Traffic Engineer, addressed the traffic study prepared for the development. Mayor James opened the Public Hearings. Andre Park, Boca Raton, attorney representing the Sea Oaks Condominium, noted the proposed buildings are not compatible with the neighborhood, and he does not believe the Commission has enough information to make an informed decision tonight. They are going to place into the record charges against Neptune Fireworks. He asked the Commission to support the residents and vote no. Linda Barber, 75 Gulfstream Road #305, handed out more petitions and spoke against the development. Douglas Edwards, 75 Gulfstream Road#300, spoke against the development. Sandra L. MacDonald, 186 NE 6th Court, spoke against the development. Tom Smitha, 85 Gulfstream Road#212, spoke against the development. Constantine Manos, 75 Gulfstream Road#214, spoke against the development. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,February 14,2017—7:00 p.m. Liz Parella, 85 Gulfstream Road, spoke against the development. Peter Parella, 85 Gulfstream Road, spoke against the development. Megan Ninneman, 75 Gulfstream Road, spoke against the development. Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public Hearings. Commissioner Salvino motioned to adopt Resolution #2017-002; seconded by Commissioner Brandimarte. Mayor James noted she is insulted by the comments by the residents insinuating the Commission is compromising their integrity. Commissioner Brandimarte said she makes her decisions for the good of all residents in the City of Dania Beach, not a particular group. Commissioner Salvino noted this Commission is not the one that made the law, but they are the one who must follow it. He added he disagrees with the comments made by those who spoke. Citizen Comments Vivek Golikeri, 301 SE 3rd Street, requested the City adopt a policy that only holosonic speakers be used during outdoor festivals. Betty Sokol, 609 NW 1 Od' Street, commented the entrance light in Melaleuca Gardens is still out, and children were fighting in the parking garage tonight. Commissioner Brandimarte commented that the security guard was of no help in the situation. Minutes of Regular Meeting 4 Dania Beach City Commission Tuesday,February 14,2017—7:00 p.m. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, reported on recent arrests and crime trends. He noted fraud is a continuing problem in the City, and residents need to be aware. He reported that they have been working with Code Compliance and Fire to address issues around convenience stores. Commissioner Salvino would like to see a report from BSO on the calls received. Commissioner Grace wants BSO to call residents who call them and let them know if they will be late. Lieutenant Dan Suarez, BSO Fire Rescue, reported on the suspected arson to a tiki but near the Dania Beach Bar & Grill on Saturday night. The new Rescue unit for Station 17 should be in service by the end of the month. 7. City Attorney Ansbro read the title of Resolution#2017-013. Commissioner Salvino questioned the cost involved, and noted we should be aware of who we are hiring. Marc LaFerrier, Director of Community Development, explained this would be for the final design, permitting, supervision of the construction and installation of the sign; it does not include the cost of the actual sign. The County will reimburse us up to $250,000.00 for the cost of the entrance sign. He noted this sign will be difficult to get approved due to its location and the several agency approvals required, and asked that everyone be patient. (FIRST READING) City Attorney Ansbro read the title of Ordinance #2017-005. Corinne Lajoie, Planning & Zoning Manager, provided an overview of the text amendments. The Commission had questions on the tree removal/replacement ordinance changes, particularly on the effect they would have to specimen trees and trees damaged by a tenant. Marc LaFerrier, Director of Community Development, explained these changes are timely; more changes would be brought forward after a re-evaluation of the County's ordinance and a comparison made to the City's code, in order to improve on what we currently have. He noted state law only allows code enforcement to level violations to a property owner. Mayor James opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Commissioner Salvino motioned to adopt Ordinance #2017-005, on first reading; seconded by Commissioner Grace. Discussion and Possible Action There were no discussion items on this agenda. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte had no comments. 11.2 Commissioner Grace Commissioner Grace commented on upcoming Collins Elementary School events. 11.3 Commissioner Salvino Commissioner Salvino commented that perhaps we need to conduct a survey of the residents to see if they want development. If they feel that the growth is enough with the projects already approved,perhaps we need to take away some of the incentives. Mayor James said she was going to suggest an amendment to the ordinance that would give us more control over what is allowed. The language is not consistent with all the incentives and she would support changing it. Commissioner Salvino noted we should revisit it and try to figure out where we are and how far we want to build; we need a plan. 11.4 Vice-Mayor Harris Vice-Mayor Harris echoed Commissioner Salvino's comments. He felt we should tweak the incentives and include the community's input in that process. He also was taken aback by some of the comments made tonight. 11.5 Mayor James Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,February 14,2017—7:00 p.m. Mayor James spoke of her support of the residents and how she appreciates their fight. There was a general discussion on development among all the Commissioners. Mayor James commented other cities are serving alcohol on the beach, such as Margaritaville in Hollywood. There are a few in Hollywood and Ft. Lauderdale. Mayor James noted the Tamara James Foundation will be offering free typing lessons at CW Thomas Park and Frost Park. 12. Appointments 12.1 Airport Advisory Board—no appointments 12.2 Education Advisory Board—no appointments 12.3 General Employees Pension Board—no appointments 12.4 Green Advisory Board—no appointments 12.5 Marine Advisory Board—no appointments 12.6 Parks, Recreation and Community Affairs Advisory Board Commissioner Brandimarte appointed: Debra McElyea Vice-Mayor Harris appointed: Clare Frost 12.7 Police and Fire Pension Board—no appointments Commissioner Grace motioned to approve the appointments; seconded by Commissioner Brandimarte. The motion carried unanimously. 13. Administrative Reports 13.1 City Manager City Manager Baldwin noted the Commission wants to move forward with burying FPL lines at the beach, as well as renovating the south marina bathroom. Both will be brought forward for a formal decision. City Manager Baldwin also noted BSO applied for another SAFER Grant to provide the third paramedic for Station 1. Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,February 14,2017—7:00 p.m. City Manager Baldwin reported we did not get the COPS Grant for the two additional deputies. Chief Marks is working on a recommendation; that and funding alternatives will be brought forward to the Commission as soon as possible. City Manager Baldwin gave updates on upcoming budget discussions, State of the City video, memo for the Oasis program, and the meeting with our lobbyist/airport consultant. He distributed a memo on the Airport Interlocal Agreement, which is attached to and incorporated into these minutes, and spoke of efforts to address the Uber driver problem. Vice-Mayor Harris left the meeting at 9:50 p.m. City Manager Baldwin addressed the Commission's desire to hold a Development Workshop, and noted that the City Attorney asked that we wait until some of the development issues are done. City Manager Baldwin spoke about the upcoming 9th Annual Economic Engine Performance Report event and the state legislative agenda. 13.2 City Attorney City Attorney Ansbro requested that the Commission motion to reject the two bids received for the Southeast Drainage Project — Phase 11; both bids were over budget and the project will be revised and rebid. Commissioner Salvino asked if we could go back to the $9 million bid if bids were rejected now and subsequent bids were more. City Manager Baldwin explained that to stay within budget, we will have to redesign the bid and probably do it in two phases. He addressed Commissioner Salvino's question about borrowing money to make up the difference, and noted staff also thinks we may get better pricing if this is rebid. Commissioner Salvino said he would like to get a better understanding before the bids are rejected, and we have time to rebid later. Additionally, he does not understand why we do not borrow money on capital improvements when we have the opportunity to pay it back. Commissioner Brandimarte motioned to reject the two bids received for the Southeast Drainage Project — Phase II; seconded by Commissioner Salvino. The motion carried on the following 4-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Harris Absent Commissioner Grace Yes Mayor James Yes Commissioner Salvino Yes Minutes of Regular Meeting 11 Dania Beach City Commission Tuesday,February 14,2017—7:00 p.m. Commissioner Grace asked for clarification on how many Commission votes are necessary to terminate department heads and the City Manager. City Attorney Ansbro noted the City Manager is the only person with power over department heads; individual Commissioners can tell the City Manager how they feel. Commissioner Grace asked if an item can be placed on the next agenda to discuss whether or not the Commission is happy with the performance of the department heads and the City Manager by vote of confidence or no confidence. City Manager Baldwin noted the Commission can evaluate and make decisions about the City Manager any time of their choosing; department heads are done by the City Manager. Commissioner Brandimarte thinks if any Commissioners have a complaint about a department head's performance, they should voice their opinion and provide an example as to why they are not doing a good job. A case should be documented on a person and you should not arbitrarily say that you do not want them. Commissioner Salvino questioned if there is a performance evaluation sheet to use for the City Manager. City Manager Baldwin noted managers are typically evaluated in terms of their performance,tied to a raise or termination. A performance evaluation sheet is not common. Ary o The project will generate City, County impact fees, including Fire, Police, Administrative, and Parks and Recreation, which are paid prior to issuance of a building permit. 3 o The City's Park &Recreation fee is $1,364.00 per dwelling unit; therefore, $491,040 is required to be paid prior to issuance of a building permit (based on 360 units). k E' o The LDC, in Section 309-10, entitled Complete Streets, requires the construction of of certain street improvements (i.e. waste cans, benches, pedestrian lighting)or payment-in-lieu of construction. o The City Engineer has stated that the traffic study submitted for this project by Langan Engineering and Environmental Services has been accepted and deemed complete based on agreed scope and methodology for a Traffic Impact Study (TIS). o The traffic study indicates that the project traffic will not cause the adjacent roadways to exceed the adopted Level of Services (LOS) standard B. Height/DensityIncentive h o The applicant is utilizing the Public Parking Incentive which provides for the x# additional height and density for the project. (ORDINANCE#2012-019) G:\Agenda\PUBLIC SPEAKING FORM.doc INTEROFFICE MEMORANDUM CITY OF DANIA BEACH TO: Robert Baldwin, City Manager FROM: Marc LaFerrier, AICP, Director of Community Developet DATE: February 10, 2017 SUBJECT: AIRPORT INTERLOCAL AGREEMENT—Status Report This document has been prepared to provide a summary and update on the implementation of certain provisions in the City/County Airport Interlocal Agreement and other related matters. The Broward County Aviation Division (BCAD) is the primary Broward County agency responsible for implementation of the sound mitigation programs (sound insulation, conveyance and release (CAR) and sales assistance) and other provisions of the Interlocal Agreement. It should also be noted many provisions of the Interlocal Agreement are funded and/or regulated by the Federal Aviation Administration (FAA). I. RESIDENTIAL SOUND INSULATION PROGRAM A. Summary of Program 1, Airport Settlement Agreement calls for BCAD to offer soundproofing for all eligible single family and multifamily residential units (approximately 1706 homes). Sound proofing generally involves the installation of impact resistant, sound proofing windows & doors, as well as the conversion of window mounted and insufficient A/C units to new central A/C systems. 2. BCAD is sound proofing homes in groups of approximately 200, based on location and noise contours. The homes impacted with the greatest noise closest to the airport are scheduled first. 3. Duration of time for BCAD to complete sound insulation for a home is approximately 18 months. The average duration of time for permitting and construction is 30 days. 4. Total BCAD budget for the sound insulation is $121 M. The average cost per home for sound insulation is $58K. 5. BCAD is responsible for the sound insulation program. Dania Beach has no role in the administration or implementation of the program. Dania Beach has expedited the building permit and inspection process for these permits. 1 6. Settlement Agreement provides no provision or leverage by the City to speed up soundproofing. B. Status 1. Statistics as of December 2016: a) 1858 residences are eligible to apply b) 1858 residents have been invited to participate c) 1203 homes are participating. 656 homeowners are not participating because the home are in compliance or the homeowners declined or did not respond. d) 499 units completed e) 213 homes in construction t) 500 homes in design 2. BCAD allowed owners that where sound tested and not eligible for sound insulation to be retested. Approximately 40 homeowners had their homes retested. The overall results of the retests are being evaluated by BCAD and the FAA. A final determination for sound installation of these home are pending. 3. Meetings between the City and BCAD Staff have led to BCAD's streamlining their procedures and increasing the number of homes in each group as an effort to expedite the sound insulation process. 4. Assuming full participation (i.e., every house eligible for sound insulation receives it), BCAD Amended Noise Mitigation plan projects completion of all sound insulation by late fall 2017 to winter 2018. II. SALES ASSISTANCE AND CONVEYANCE AND RELEASE(CART PROGRAMS A. Summary Sales Assistance CAR Programs 1. Only available to homeowners in the 65+ DNL contour(857 homes) 2. For the Sales Assistance Program, an eligible homeowner that wants to sell their house, then BCAD will provide up to 25% of FMV (Fair Market Value) to facilitate a sale (i.e. if buyers won't offer FMV, then BCAD will make up the difference).The sales assistance program only allows for limited participation each year(20 to 30 properties per year) 3. For the CAR program, once eligible homeowners get sound insulation, or are determined not to need sound insulation, they are eligible get a cash payment in return for a "Conveyance and Release Agreement" (i.e., a release of future claims and avigation easement). Payments are 14.4% of FMV for those receiving BCAD sound insulation, and 21.9% of FMV for those not needing sound insulation. 2 4. BCAD's budget for Sales Assistance and CAR programs are $73M B. Status: 1. BCAD has drafted procedure manuals for both programs, The FAA has approved the manuals and the program began in Spring 20016. 2. BCAD began implementation the Sales Assistance and CAR program began in spring 2016. 3. 496 homeowners have been invited to the programs and 320 applications have been approved or in the process III. Other Provisions in the Airport Interlocal Agreement A. Summary and Status 1. Voluntary night closures for the south runway: commercial flights on the runway will not be allowed from 10pm to 5am, with the following exceptions: • As necessary as determined by the pilots or control tower • During construction or maintenance activity of the north runway; for emergency, efficiency or safety reasons determined by pilots, the control tower or Airport Director. Status: The Airport Director has stated the airtines, FAA and control tower have agreed with the voluntary night closures with the noted exceptions. 2. Part 150 Noise Study: A Part 150 Noise Study has commenced in November 2016. This study will include actual noise and flight data that may assist future flight operations (years 2017 to 2022) and noise mitigation programs for noise reductions if needed. Status: The study process includes representative from the City on the Technical Advisory Committee and Steering Committee, five (5) public workshops, newsletters and public hearings. Completion of study and recommendations are planned for SummeriFall 2019. 3. Mobile Home Park Acquisition: The mobile homes cannot receive sound insulation. BCAD pursued voluntary acquisition of the Ocean Waterway Park on Old Griffin Road and the Sheldon Mobile Home Park on West Griffin Road. Status: BCAD did not purchase the above-mentioned mobile home parks and has ceased negotiations with park owners. 4. No Agreement to Purchase Noise Impacted Property: BCAD is not required to use eminent domain to purchase any properties for airport compatibility or noise mitigation. BCAD may reconsider this matter if the Part 150 Study identifies incompatible land uses and a need to purchase properties such for acquisition is eligible for Federal funding. Status:Pending the results of Part 150 Study. 3 5. Escheated Properties: Several properties in the City are owned by Broward County as a result of tax liens, code enforcement fines, unclaimed properties etc. These properties are small and primarily located in the Northwest portion of the City. Status: Transfer ownership to the City has been completed. The City is in the process of ensuring clear title and appraising the property for surplus or future public use. 6. Plats 7 and 8: The City sought lost property tax revenues for the BCAD owned parcels lying within areas known as Plats 7 and 8 (west of 1-95, south of 1-595). Status: The BCAD and the FAA cannot fund payment to the City for tax revenue losses. The sale of plat 7 is in BCADIFAA process for private development. 7. Trails End Site: The property located at the SW comer of Griffin Road and US1 is in the County's jurisdiction and is owned by BCAD. Following completion of the south runway the County will seek input from the City regarding the plans and future use of the property. Status: The site is currently being used by BCAD for material storage and project management in staging for other construction projects at the airport through 2018. 8. Taylor Lane Drainage: Drainage problems in this area may have been $450K in the form of in-kind services (earthwork) to assist storm water management services. Status: BCAD's work on Taylor Lane has been completed. The City is in the process of completing the additional drainage work and final paving for fall 2017. 9. City Entrance sign at Griffin Road and US1: The existing entranceway at Griffin/US1 is being modified for additional roadway travel lanes in connection with the airport expansion. The County has agreed to pay the City up to $250K to reimburse the City's cost to design, construct and landscape a new entranceway feature at the intersection. Status: The City has contracted with architect Anthony Abbate to design a new entranceway feature. Construction of the new sign will be completed by a City contractor. 10. Melaleuca Neighborhood Wall Maintenance: The wall is located in a FDOT right-of-way in un-incorporated Broward County. The County has agreed to maintain the landscaping and irrigation on the north and south sides of the wall, as well as the landscaping on Griffin Road. FDOT will maintain the wall. IV. Other Relevant Airport Matters (but not included in the Interlocal Agreement) A. CRA Loan Repayment Revision: The County agreed to amend four loan documents (totaling $5.3 million) given to the City and the Dania Beach 4 Community Redevelopment Agency extending the interest free period from five to eight years; delaying the start of loan repayments by three years; and extending the loan term by three years. The City previously had estimated that it would need to make payments of $1.1 million over three years starting in 2015. The extension of the loan repayment date also will give the City additional time to reach certain redevelopment benchmarks, which if reached, will result in all or a portion of the $5.3 million in loans converting to grants (i.e., no loan repayment i l required). Status: This extension expires in 2018. B. FLL Master Plan: The FLL Master Plan process commences in November 2016. This study will examine all of the County owned and other properties at the airport and in the vicinity of the airport to determine the need for future airport uses and facilities as well as the most appropriate airport compatible uses and for related capital facilities (buildings, roads, utilities, etc.). Status: The study process includes representative from the City a Technical Advisory Committee and the Policy Advisory Committee, public meetings and hearing newsletters and stakeholder meetings. The completion of the Master Plan is anticipated for winter 2019. C. "Uber" Parking Lot and Activity: Uber, Lyft and other transportation drivers serving the airport has caused concern and disruption for residents and business owners. These issues are permitting related to illegal/unsafe parking and congestion of vehicles. Status. City staff has been working with Broward County to identify the related problems and solutions. For example, the County and City are looking into a designated parking lot for the drivers and specific guidelines for enforcement of their activities. In the meantime, City parking staff and BSO will prioritize and increase enforcement of certain types of related illegal activities.
