RESOLUTION NO. 2017-010 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,APPROVING THE SITE PLAN MODIFICATION(SP-37-03 MOD A) SUBMITTED BY FOREST VIEW ESTATES, LLC, FOR PROPERTY LOCATED AT 3517 FOREST VIEW CIRCLE,IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City Code of Ordinances,Chapter 28,entitled"Land Development Code" (the"LDC"),of Part 6,entitled"Development Review Procedures and Requirements,"Article 635- 80, entitled "Site Plan Modification or Deviations," states that site plan modification approval is required as a condition to the issuance of a building permit; and WHEREAS,Forest View Estates,LLC,the Applicant,is requesting site plan modification approval to allow the construction of a new private community facility (recreational use) to be located at 3517 Forest View Circle in the City of Dania Beach, Florida; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct,and they are made a part of and incorporated into this Resolution by this reference. Section 2. That pursuant to Chapter 28"Land Development Code,"Part 6"Development Review Procedures and Requirements,"Article 635-80"Site Plan Modification or Deviations,"the following Site Plan (SP-37-03 MOD A), a copy of which is attached and made a part of and incorporated into this Resolution by reference, is approved. Section 3. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. The application must be reviewed by the Broward County Aviation Department. The point of contact is William Castillo, Airport Planner, located at 220 SW 45 Street, Suite 101, Dania Beach, Florida, 33312, (954) 359-6100. 2. Submit a final plat drawing as recorded with the Broward County Clerk's Office prior to issuance of a building permit. 3. Provide Park Impact Fee prior to issuance of a building permit. Section 4. That the issuance of a development permit by a municipality does not in any way create any right on the part of an applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. That this Resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on February 28, 2017.
