Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Tamara James Vice-Mayor: Bill Harris Commissioners: Chickie Brandimarte Bobbie H. Grace Marco A. Salvino, Sr. City Manager: Robert Baldwin City Attorney: Thomas Ansbro City Clerk: Louise Stilson 2. Moment of Silence and Pledge of Allegiance Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Black History Month—Commissioner Grace Commissioner Grace invited children from the Dancing for a Purpose group to speak about African American Commissioners and Mayors in Dania Beach. Commissioner Salvino presented an award to the City of Dania Beach on behalf of the Prestige Club. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Janet Colbert, 4605 SW 27 Terrace, thanked the Commission for adopting the opioid resolution on the Consent Agenda. Thomas Baker, 151 N Beach Road, addressed the dog policy at the Dania Beach marina, and noted patrons were recently informed via a letter that dogs have been banned. Commissioner Salvino questioned the change in policy. City Manager Baldwin requested Mark Felicetty address the issue. Mark Felicetty, Director of Parks and Recreation, confirmed the letter came from the City; no one has been asked to leave the marina, only to leave their dogs at home. The problem has become a nuisance and health hazard in the last few months with our lifeguards stepping in waste. Commissioner Brandimarte questioned if the contracts contained a clause that no dogs were allowed. Colin Donnelly, Assistant City Manager, explained Westrec's role as the marina manager and noted the system put in place to accommodate dogs is no longer working for them. Not every rule and regulation is in the lease; we rely on Westrec to provide expertise to us. Also, regular beachgoers see marina dogs and the notion that this is now a dog beach proliferates. This is unfair to the lifeguards who are not there to constantly monitor a dog situation. Vice-Mayor Harris noted the problem is the dog owners, not the dogs. He thinks we should defer this for 30 days to look at the issue and come to some resolution as to what the policy should be. Commissioner Salvino noted Westrec should monitor if the owners are living aboard the boats, there needs to be rules set and included in the contract, and ample notice should be given. Jim Lanigan, Dania City Marina, Slip E-1, who also lives in Lake Placid, Florida, addressed the dog policy at the marina. He noted marina dogs are not at the beach, it is other dogs; the marina manager needs to address the issue with individual dog owners. Frank Debesa, 1601 E Hawthorne Circle, Hollywood, spoke of the dog policy at the marina and said he is not aware of any issues there; however, the general public parks their cars and walks their dogs onto the beach. Richard Judge, 115 NW 4 Avenue, asked for code enforcement relief, he feels like he is being singled out. Gerald Clark, 13604 New Acadia Lane, Upper Marlboro, Maryland, said he owns property on 5tn Court, and thanked the City for installing solar lights, speed humps and speed limit signs. He addressed traffic coming down 5th Court and indicated the problem is due to the timing of traffic lights at Phippen and Stirling Roads. Minutes of Regular Meeting 2 Dania Beach City Commission Tuesday,February 28,2017—7:00 p.m. James Bowers, 9720 SW 12 Street, Pembroke Pines, President of Attucks Alumni Association, spoke of drug use and sales on Ely Boulevard, across from Attucks Middle School. He asked for increased police patrol in the area. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, provided a synopsis on recent criminal activity and crime prevention. City Manager Baldwin provided a memo as an update on what the City is doing to try to deter the activity that is happening at Smith's Store and other convenience stores, which is attached to and incorporated into these minutes. Sean Brown, Battalion Chief, BSO Fire Rescue, was present to answer questions. 7. The Commission discussed the pros and cons of the ordinance. Vice-Mayor Harris and Commissioner Salvino spoke in support of the ordinance and Mayor James, Commissioner Brandimarte and Commissioner Grace spoke against it. (Continued from 211 412 0 1 7) City Attorney Ansbro read the title of Resolution#2017-010. Corinne Lajoie, Principal City Planner, described the requested site plan modification. Mayor James opened the Public Hearing. Seeing as there was no one to speak in favor or opposition, she closed the Public Hearing. Manny Synalovski, representing the applicant, noted 18 homes have been constructed and 13 are in the planning stages; this will be a positive amenity for the community. Commissioner Grace motioned to adopt Resolution #2017-010; seconded by Commissioner Salvino. Discussion and Possible Action There were no discussion items on this agenda. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte had no comments. 11.2 Commissioner Grace Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,February 28,2017—7:00 p.m. Commissioner Grace noted she has received several calls from people in the NW neighborhood about the code enforcement officials. She read a letter which she provided to the Clerk for inclusion into the minutes. Commissioner Grace would like to bring back Government Day to the City. 11.3 Commissioner Salvino Commissioner Salvino spoke of the new Oasis project and asked that Hollywood be contacted in order to work with them to incorporate the entire street (JA Ely Boulevard). City Manager Baldwin clarified this is proposed but is not scheduled for the upcoming Oasis project. 11.4 Vice-Mayor Harris Vice-Mayor Harris addressed the City Charitable Donation Policy. He motioned to not give any more money away until the Commission has a chance to review the policy; seconded by Commissioner Grace. Commissioner Brandimarte noted the Commission does not make the decision on the donations; it is a staff committee. City Manager Baldwin noted in his opinion, it is a political decision, not staff responsibility. He added that the current year's donations have already been determined. Vice-Mayor Harris motioned to come up with a new charitable committee for the next budget year or all of the donations totaling $35,000.00 have to be approved by the Commission; seconded by Commissioner Grace. Commissioner Brandimarte said she does not want the Commission to make the decision. Commissioner Salvino suggested discussing this at a workshop. He also does not want the Commission to make the decision. Vice-Mayor Harris motioned to workshop charitable donations for the future budget year to determine the need at that time; seconded by Commissioner Grace. Mayor James spoke of the Greater Mt. Zion AME church's 108t' anniversary. Mayor James reminded everyone of the typing program being offered at Frost and CW Thomas Parks. 12. City Manager Baldwin also noted we are still dealing with the airport and Uber drivers. There was discussion on airport construction and parking issues. Thank you for taking my call a few weeks ago about the problems many of us are having with a very abusive code department. I remember seeing you on TV in a commission meeting talking about not liking bullies. Marc LeFerrier breeds a hostile culture in Dania where some of the code people are valued for being unnecessarily aggressive, intrusive and abusive in their power because they can. Without going into much detail, Marc LeFerrier and Ricky Ali have cost me two homes which were to be used for my retirement and my entire life savings. Mr. Ali again, just cost me an entire day's pay when he came over to harass me and got very aggressive again. I had to call the police and wait 2 1/2 hours for a response, but when they did come, I filed a report. I will call the police again and will do so every time he confronts me inappropriately or involves himself with my 90 year old mother. Mr. Ali visits my home several times a week and tries to engage me in altercations. My neighbors all say the same thing. "He's after you and it's wrong." I have had to call the police on Mr. Ali twice and have case numbers as well as reports by the police. Mr. Ali likes to tell the neighbors that he has some kind of mixed martial arts degree which he uses as a threat. There is no reason to tell residents that kind of thing. He likes to wait for me to leave my home and if I happen to return to grab something I've forgotten, there he is. On one occasion, he approached my 90 year old mother when she was sitting on the porch and marched her across the street to my two homes that are now gone as a result of codes inappropriate actions. He complained to her about petty issues and had her so upset I had to come home and lose another day at work. My mother suffers from hip issues, a deformed leg and memory problems and Mr. Ali only complicates those problems and puts her at greater risk for injury and more confusion when all she wants is to sit on her porch and enjoy the day. He has no business talking to her about anything related to me and my property, but does so because of his abusive character. Mr. Ali writes tickets on my work van not because there is a genuine issue, but because he likes to inconvenience me forcing me to go to court. I called the police on him after he wrote a ticket on my van saying it was inoperable. When the police arrived, I started the vehicle and demonstrated that it was not "inoperable." Since Mr. Ali never shows up in court, it's no inconvenience to him and each time, the judge throws the case out. This is a very personal thing for him now and Mr. Ali continues to abuse his power by intentionally bothering me for trivial things to annoy me while he fails to address the real issues in this neighborhood, especially regarding people who have inappropriate connection with the city. When Lupo was here, there was at least an attempt to work with the residents here in a fair and pleasant manner. Now since LeFerrier has a team of bullies, it's a daily harassment that shouldn't be. I don't know what the city thinks they have here in my neighborhood, but it's not Sunny Isles here. We deal with home invasions, murders, drug dealers, prostitutes, very long wait times for the police to respond to calls and code that intentionally turns a blind eye to the real offenders in the neighborhood like it's a game while they torture the people they don't like. There is never any peace in the neighborhood until 5pm when code goes home or on Sunday. The aggressive code department has neighbors fighting with each other as you saw in the plywood sign that a neighbor put up recently. I work in virtually all the cities in Broward county, and no city has as many code people in the streets all day harassing the residents like this. I hope you're genuine about not tolerating bullies, cause you have a whole code department of them run by Marc LeFerrier who sends out code employees to harass individuals because they can and it's very abusive. I've been here in the same location for over 50 years and it's never been this bad. There are just too many code people for such a small city and while there are good ones like Warren, most are not and I'm tired of having to deal with a very aggressive abuser and his boss on a daily basis. Thank you, Sincerely, Frank Belle r� IP Edo gig �lr +� ..rt t• February 28, 2017 Convenience Store Task Force • Various convenience stores throughout the City will be inspected as a continuation and expansion of the required annual fire safety inspections in an effort to improve the property maintenance and public safety conditions of convenience stores in our neighborhoods. • The initial group of stores were recently inspected. Subsequently additional stored will be inspected. Various Codes and laws will be utilized for these inspections: — Building Codes — Fire Safety Codes — Zoning Codes — Alcoholic Beverage and Tobacco Laws — Commercial and Civil Codes — Health and Agricultural Codes — Property Maintenance Codes — Specific States and County Codes Applicable to Convenience Stores — ADA Regulations • The nearby vacant properties in the vicinity of the convenience store are also inspected for the property maintenance, trespassing lighting, security and nuisances. • Inspections and enforcement with State ABT is being coordinated by BSO. • On February 24, 2017 key staff from the BSO Police and Fire, Building and Code Compliance Divisions inspected the first group of convenience stores at the following locations: — Happy Family: 45 NE 5th Ave. — Smith Store: 701 SW 12th Ave. — 7-Eleven: 205 E. Dania Beach Blvd. — Two Quick: 348 SW 13th St. In summary, the inspections at these properties revealed numerous violations of property maintenance, fire safety, building code and ADA regulations.
