KERR, AICP ON BEHALF OF THE PROPERTY OWNER, GRIFFIN POINTE PARTNERS, LLLP, TO CHANGE THE LAND USE OF AN APPROXIMATELY 8.8 ACRE PARCEL OF LAND LOCATED AT 2281 GRIFFIN ROAD WITHIN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A," A COPY OF WHICH IS ATTACHED TO THIS ORDINANCE, FROM OFFICE PARK TO COMMERCIAL; PROVIDING FOR TRANSMITTAL TO THE BROWARD COUNTY PLANNING COUNCIL AND STATE AGENCIES; PROVIDING FOR ADOPTION PURSUANT TO SECTION 163.3184, FLORIDA STATUTES; REQUESTING RECERTIFICATION FROM THE BROWARD COUNTY PLANNING COUNCIL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Section 163.3184, Florida Statutes, the Applicant, Leigh Robinson Kerr & Associates, Inc./Leigh R. Kerr, AICP. on behalf of the property owner, Griffin Pointe Partners, LLLP, has applied to the City of Dania Beach, Florida(the "City"), for approval of a Future Land Use Map ("FLUM") Amendment to the City's Comprehensive Master Plan (the "Comprehensive Plan") from Office Park to Commercial on an approximately 8.8 acre parcel of land located at 2281 Griffin Road in the City of Dania Beach, Florida (the "City") as legally described in Exhibit"A"; and WHEREAS, the City Commission of the City of Dania Beach, Florida (the "City Commission") has conducted duly noticed public hearings, in accordance with Section 163.3184(11), Florida Statutes, on the proposed FLUM Amendment; and WHEREAS, staff recommended approval of the requested FLUM Amendment in its report dated March 28, 2017; and WHEREAS, the City's Planning and Zoning Board, sitting as the Local Planning Agency (the "LPA"), reviewed the requested FLUM Amendment at its March 15, 2017 meeting and voted to recommend approval of the requested FLUM Amendment; and WHEREAS, after reviewing the LPA's recommendation, the recommendation of City staff, and the comments from the public, the City Commission finds the proposed FLUM amendment to the Comprehensive Plan, attached as Exhibit "A" to this Ordinance, is in compliance with and consistent with Florida law and its adopted Comprehensive Plan. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and incorporated as the legislative intent of this Ordinance. Section 2. That pursuant to Section 163.3184, Florida Statutes, the FLUM Amendment to the Comprehensive Plan for the Property, legally described in Exhibit "A," from Office Park to Commercial is hereby approved and adopted. Section 3. That the City staff is authorized to transmit the Amendment to the Florida Department of Economic Opportunity (the "DEO") and other state agencies pursuant to the requirements of Chapter 163.3184, Florida Statutes. Section 4. That City staff is authorized to transmit an application to the Broward County Planning Council to request amendment of the Broward County Land Use Plan map and to request recertification of the City's Future Land Use Plan including the Future Land Use Plan Map. Section 5. That the provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 6. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with the provisions of this Ordinance are repealed to the extent of such conflict. Section 7. That the effective date of this Amendment shall be after the second reading and adoption of the amendment by the City Commission and, subsequently, the date a final order is issued by the Florida DEO finding the amendment to be in compliance in accordance with Chapter 163, Florida Statutes; or the date a final order is issued by the 2 ORDINANCE#2017-012 Administration Commission finding the amendment to be in compliance in accordance with Chapter 163, Florida Statutes. The area west of Ravenswood Road is served by Broward County Utilities. Broward County 201 Wastewater Facilities Plan in turn provides that wastewater from Dania Beach be treated by the City of Hollywood Wastewater Treatment Facility. Drainage Analysis 1. Provide the adopted level of service standard for the service area in which the amendment is located. The City adheres to the minimum standards of Broward County and the South Florida Water Management District and establishes the following levels of service. Road Protection Residential and primary streets crown elevation meet the minimum elevations as published on the Broward County 10 year Flood Criteria Map. Buildings The lowest floor elevation shall not be lower than the elevation published on the Broward County 100 year flood elevation map or 18 inches above the adjacent crown of road for residential and 6 inches above the adjacent crown of road for commercial/industrial. Storm Sewers Shall be designed using the Florida Department of Transportation Zone 10 rainfall curves. Flood Plain Routing Modified SCS routing method as established by the SFWMD `Basis of Review". Best Management Practice Efforts shall be utilized to use best management practice to reduce pollutants entering the groundwater. 2. Identify the drainage district and drainage systems serving the amendment area. The primary drainage system of the City of Dania Beach, as well as Broward County,is controlled by the canal and pump system of the South Florida Water Management District (SFWMD). The SFWMD maintains a canal and pump systems and controls discharge based on the capacity of the system to remove storm water. Drainage systems primarily consist of storm sewers, exfiltration trench systems and onsite retention/detention systems. Recreation and Open Space Analysis 1. Provide the adopted level of service standard for the service area in which the amendment is located and the current level of service. The adopted level of service for recreation and open space in the City is 3 acres/1,000 residents. 2. Identify the parks serving the service area in which the amendment is located including acreage and facility type, e.g. neighborhood, community or regional park.
