Federal Highway RESOLUTION NO.2016-077 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-127-15) AND VARIANCES (VA-55-16 AND VA-56-16) SUBMITTED BY DANIA SQUARE INVESTMENT GROUP, LLC, FOR PROPERTY LOCATED AT 1301 SOUTH FEDERAL HIGHWAY, IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City Code of Ordinances,Chapter 28,entitled"Land Development Code" (the"LDC"),of Part 6,entitled"Development Review Procedures and Requirements,"Article 635, entitled "Site Plans," states that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Dania Square Investment Group, LLC, the Applicant, is requesting site plan approval to allow the construction of a new one story commercial strip center to be located at 1301 South Federal Highway Federal Highway in the City of Dania Beach, Florida; and WHEREAS,Chapter 28,Part 6 of the LDC,Article 625,entitled"Variances",Section 625- 40 states that the City Commission may grant a variance based on its determination that an applicant has demonstrated that the criteria identified in the LDC have been satisfied; and WHEREAS,the Applicant has requested to provide one terminal peninsula of 10'-0"wide instead of two which are required in the central parking spaces at the parking lot to maximize the parking use as established in Section 275-100 (D); and WHEREAS, the Applicant has requested permission to not provide, as required in LDC Section 275-100(c),the intermediate peninsula between no more than 12 continuous parking stalls along the same parking aisle so as to maximize the parking lot and to comply with the parking zoning requirements; and WHEREAS, the Applicant has requested to provide zero (0) feet of landscaping for the Vehicle Use Area to the building walls to maximize use of the parking lot, when five (5) feet is otherwise required per LDC Section 275-100(E); and WHEREAS, the Applicant has requested relief from use of the parking requirements described in Section 303-80 that requires that parking must be 30' from secondary streets;to comply with the parking spaces required by the LDC and to maximize the parking lot, the Applicant is proposing a distance at the north side of the project , nearest to the parking corner up to the secondary street of 29'-5 1/4" and a distance at the project's south side of 29'-3 7/8"; the LDC requires 30 feet in both cases; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct,and they are made a part of and incorporated into this Resolution by this reference. Section 2. Pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements,"Article 635 "Site Plan,"the following Site Plan (SP-127- 15), a copy of which is attached and made a part of and incorporated into this Resolution by reference, is approved. Section 3. Pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements,"Article 625"Variances,"the following Variance application (VA-42-16) is approved consistent with the Site Plan provided in Exhibit`B". Section 4. The approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. APPLICATION: (All code references are to the LDC) Confirm application was properly completed, signed, and proper application fee was paid. Per Section 635-50, must provide the following: • J — The location and dimensions of proposed setback lines, from new property line after dedication; • S — size and height of proposed signs, including building signage details shown on plan elevation and method of illumination; • W—Type and location of mail receptacles; • Y—The following computations: 0 4—Area devoted to vehicular use areas (roadways, aisles,parking)and percentage; 0 6—Lot coverage by roofed structures and percentage; 2. PLATTING:Provide letter from Broward County identifying whether this property needs to be platted or replatted. 2nd time requested. 3. RIGHT-OF-WAY: Identify if R-O-W dedication is required. Provide measurement of all three roads to determine if additional ROW is needed. Based on information shown on survey,a 6' ROW dedication is needed for Federal Highway. Identify location on dedication and resulting new west property line on Sheet DRC-2. 2 RESOLUTION#2016-077 4. The proximity to the airport will require FAABCAD review and approval. Contact William Castillo,Airport Planner with Broward County Aviation Department,located at 2200 SW 45 Street, Suite 101, Dania Beach, FL 33315, ((54) 359-6100. 2nd time requested. 5. Provide minimum bicycle parking requirements identified in Sections 265-51 and 307-30. Bike spaces provided are required to be equal to 10% of the required automobile spaces. Provide calculation and identify location on site plan.Location of bicycle parking must be on property, current location appears to be in newly dedicated ROW. Clarify. 6. RAC TRAFFIC IMPACT MITIGATION: Provide an analysis, signed and sealed by a certified engineer, identifying the amount of RA mitigation for traffic impact due based on City Resolution No.2014-049 which established a rate of$21.26 per p.m.peak hour trip.Per Traffic Impact Study prepared by Thomas A. Hall the number of PM peak hour trips is 178. Based on a County impact fee of$3,784.28 that is due (21.26 X 178 = $3,784.28). This amount is due prior to issuance of a building permit. 7. Per Section 309-10(C)(1) Construct sidewalk and on-street parking and provide and install street furniture(including,but not limited to,benches,transit shelter,street lights,waste bins, and bike racks or lockers) for ALL street frontage abutting the property line at the development site,pursuant to the specification approved by the City Commission in the CRA Redevelopment Plan. See attachments.Identify location and width of sidewalks on site plan. Only 2 benches provided on Federal Highway. Provide additional furniture on sidewalks along with decorative trash cans. 2nd time requested. 8. The proposed site is comprised of 4 separate folios.Provide unity of title prior to issuance of a building permit. 9. Per Section 265-20(D) off-site parallel parking dimensions must be 8 feet X 23 feet; only 8 feet X 20 feet proposed. Revise accordingly. 10. Parallel parking including shifting of the road alignment(based on the existing 40 foot right of way)is subject to further traffic engineering review at the time right of way use permit is applied for,pending other guidelines and regulations that may then be in place. 11. Road reconstruction and parallel parking design shall be subject to detailed engineering review(ADA compliance, sign visibility,paving,grading and drainage)at the time right of way use permit is applied for. 12. All incidental works within the City's right of way shall be the sole financial responsibility of the Developer 13. Proposed watermain upgrade and extension shall be"donated"to the City with a bill of sale at the end of the project, subject to Public Services acceptance of the work. 3 RESOLUTION 42016-077 14. A tree survey has been submitted. Trees No. 1 to 7 are specimen size trees proposed to be removed, please provide the dollar value of specimen trees calculated in accordance with section 825-140 of the Dania Beach Code (See definition of specimen tree under Sec. 825- 50). 15. Existing vegetation is proposed to be removed. Please add a note to the Landscape Plan or Tree Survey indicating that tree removal activities will not be conducted without first securing a tree removal license with the City of Dania Beach,and indicate how the mitigation for the removal of these trees will be accomplished(either planting on site or contributing to the Tree Trust Fund). 16. Provide a table of data indicating required and provided quantities of landscape material, including the corresponding code requirement, gross and net acreage, number of trees to remain(if any), and square footage of vehicular use area. 17. Incorporate the attached City of Dania Beach Standard Landscape Plan Notes to the Landscape Plan. 18. A Pavement Marking Plan demonstrating all the following: a. All turning radii (demonstrated)—Please dimension all radii (inside and outside for all turns) b. Fire Lane locations and striping detail (demonstrated)—Please see sheet the orange high-lighted areas below and add striping and signage for these locations in accordance with the requirements listed in the supplemental information below, following these comments. c. Drive Aisle widths (demonstrated) & Vertical Clearances (noted)—Please identify the travel direction for the "U" shaped drive isle seen in the picture above d. Fire Department Apparatus Access Road locations and dimensions - demonstrate or note on the plan how they will be marked and delineated on site - Complied e. "NO PARKING" sign locations and sign details demonstrated—Please provide f. A note or detail identifying the design load for surface compaction of all non-paved roadways and Fire Department Access Roads or both(where applicable)—N/A g. Building Accessibility- Complied h. Load Limits for Bridges and Grading for significant changes in elevation(if applicable) —N/A i. Fire Department Access Routes During Construction—Provide at Permit 19. A set of Civil Plans indicating the following: a. All existing and proposed water main sizes—Please check with Public Works. All new installations are to be a minimum of 8". b. Statement of verification from the design professional of record, on official company letterhead, that the proposed water main sizing, fire hydrant spacing, and fire hydrant locations, are in compliance with the Broward County Land Use Code and the Florida Fire Prevention Code. (This document shall bear the seal and signature of the engineer). 5 RESOLUTION#2016-077 26. Fire Flow Demand Calculations Signed and Sealed by Licensed Engineer—Please provide 27. A completed Application for the Approval of the Fire Protection Water Supply Design (See the last page of this document)—Please provide 28. Statement of verification from the design professional of record, on official company letterhead,that the proposed water main sizing, fire hydrant spacing, and fire hydrant locations, are in compliance with the Broward County Land Use Code and the Florida Fire Prevention Code. (This document shall bear the seal and signature of the engineer). Section 5. That such application must be reviewed by Broward County Aviation Department. Pursuant to LDC Section 635-100"Expiration of Site Plans,"Section 625-50 "Expiration of variances,"the Site Plan(SP-127-15),Variance(VA-55-16 and VA-56-16)approvals shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan,within eighteen(18)months from the date of this Resolution. Section 7. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 8. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. 6 RESOLUTION#2016-077 Section 9.
