DANIA BEACH CITY COMMISSION
TUESDAY, APRIL 25, 2017 - 7:00 P.M.
1. Call to Order/Roll Call
Mayor James called the meeting to order at 7:00 p.m.

2. Moment of Silence and Pledge of Allegiance
Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United
States Flag.
3. Presentations and Special Event Approvals
3.1 Marty Kiar, Property Appraiser- Vice-Mayor Harris
Marty Kiar, Broward County Property Appraiser, gave an overview of the functions of the
Property Appraisers office and reviewed a handout he provided to the Commission, a copy of
which is attached to and incorporated in these minutes.
3.2 FPL Presentation on new Power Plant- Mayor James
Ben Wesley and Matt Valley of FPL, gave an overview of the power plant on the west side of
Dania Beach that FPL plans to repower and modernize, to be named Dania Beach Clean Energy
Center. Jackie Kingston, FPL, provided a PowerPoint presentation on the proposed plant, which
is attached to and incorporated in these minutes.
3.3 Presentation of City's Comprehensive Annual Financial Report for Fiscal Year 2016
by HCT Certified Public Accountants and Consultants, LLC
Harvey Covington, HCT Accountants, provided a PowerPoint presentation of the FY 2015-2016
budget, which was included in the agenda packet.
3.4 Recognition of Eleanna Hurst, Collins Elementary School, winner of the Broward
County Public Schools 2017 Caliber Award for Teacher of the Year- Mayor James &
Commissioner Grace
The Commission presented an award to Eleanna Hurst, Collins Elementary School, in
recognition of her winning the 2017 Caliber Award for Teacher of the Year.
4. Proclamations
There were no proclamations at this meeting.
Commissioner Grace introduced Regeline Sabbat, a second year law student, who she is
mentoring in preparation for running for public office in Tampa, Florida.
5. Citizen Comments
Dr. Tia Major, 613 SW 12th Avenue, spoke of the Broward Reads initiative in Broward County,
and requested space in Dania Beach for her non-profit organization to implement program
services here.
Michael Sartin, 746 SW 3 Street, spoke about the need to make tree removal easier in the City,
particularly for non-native species.
Shawn DeRosa, 408 SE 5a' Street, addressed flooding of 401 Sheridan Plaza, segregation of I-95
express lanes from Dania Beach residents, paving in the southeast section, and code enforcement
issues.
City Manager Baldwin noted he distributed a report to the Commission tonight regarding the
flooding issue, which is attached to and incorporated in these minutes.
6. Public Safety Reports
Lt. Anthony Demarco, BSO, reported on recent criminal activity in the City.
Sean Brown, Battalion Chief, BSO Fire Rescue, introduced Eric Busenbarrick, BSO Fire
Marshall, who recognized FF/PM Laura Kiess, Lt. Miguel Perez, FF/PM/Inspector Richard
Johnson and Lieutenant Dan Suarez for their quick actions taken in rendering medical assistance
to an elderly woman at the Arts & Seafood Celebration.

closed and the site would be properly maintained.

City Attorney Ansbro read the title of Ordinance 42017-012 and Ordinance #2017-013, as they
relate to the same property.
Corinne Lajoie, Principal City Planner, provided an overview of the amendment to the Future
Land Use Map and proposed rezoning change for Griffin Pointe.
Attorney Dennis Mele, representing the applicant, displayed an aerial photograph, and briefly
addressed the requests. He noted access concerns expressed at the last meeting will be addressed
at the time a plat amendment and site plan are brought forward. Prior to that time, they will meet
with the neighbors to make sure they understand the access.

Mayor James opened the Public Hearings.
Ben Levy, 4521 SW 25t' Avenue, spoke in opposition to the requests due to the situation with
the traffic, and felt a traffic light should be installed at Griffin Road for the commercial traffic
entering and exiting the site.
Fred Elson, 2295 SW 45"' Street, spoke against the zoning request and about traffic and safety
concerns in his neighborhood.
Melissa Verley, 2295 SW 45t' Street, expressed opposition to the development due to increased
traffic in the neighborhood.
Attorney Mele addressed the request for a traffic light on Griffin Road, improvements to the
roadway,traffic, and access.
Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public
Hearings.

City Attorney Ansbro read the title of Ordinance #2017-016.
Corinne Lajoie, Principal City Planner, described the proposed text amendments. She noted the
Planning and Zoning Board failed to recommend approval of the amendment because of the
change to incentives.
City Attorney Ansbro addressed the concerns expressed at the Planning and Zoning Board. He
recommended approval on first reading, and the incentive bonuses be looked at again before
second reading at the May 23`d meeting. Responding to Commissioner Brandimarte, he clarified
that the change in the language from shall to may pertains to the granting of incentives.
Commissioner Salvino commented he does not appreciate how this came about, as it was tried
before, and he would recommend tabling this item until the Commission has discussion on it. He
objected to changing the rules on people who made major investments when the current
incentives were in place; this is playing games with the developers.
City Attorney Ansbro noted people who have already made applications and are in the process
for approvals would not be affected by the new rules.
Mayor James opened the Public Hearing.
Linda Barber, 75 Gulfstream Road, #305, thanked the Commission for looking at the possibility
of changing the incentives language and felt it is a positive step. She also felt the actual
incentives themselves need to be looked at.
Commissioner Salvino said there is a procedure to having the discussions to make changes; it is
not to change it midstream, but to create a new ordinance for after the fact. This ordinance
creates animosity on the dais and with the residents by changing the language from shall to may.
He noted if we are going to take incentives away, it should be done step by step; notice of the
timeframe in which to build something should be sent to the developers.
Mayor James noted she is clear on the intent of this ordinance regarding incentives.
Clive Taylor, 642 NE 3rd Street, spoke of the Calm project catching everyone by surprise. He
felt although state law about notification of public hearings may have been followed, certified
notices should have been sent to all affected neighbors that the development was going from
seven to 14 stories.
Patricia Faver, 200 SE 5d'Avenue, spoke in favor of changing the incentives language.
Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public
Hearing.

Commissioner Salvino noted this Commission did not make the rules regarding incentives and
the law must be followed. The incentives are in place, developers have purchased property with
them in mind, and we have to at least give them some sort of timeframe for an ordinance change.
We cannot may or shall; the rules are the rules and we need to follow them.
City Attorney Ansbro clarified the Commission has the ability to change the verb from shall to
may in this ordinance without any repercussions; it is a legislative decision the Commission as
lawmakers are entitled to do.
Mayor James noted she was not knowledgeable of the incentives until the Calm project, and she
asked the City Attorney what could be done to give the Commission more control over
incentives.
Discussion ensued regarding the current incentives ordinance and previous projects that were
approved with those incentives.
City Attorney Ansbro said the proposed change would not affect those developers who have
applications on file as they would still qualify for the incentives currently in place. He felt
maybe it is time for a development workshop, as suggested by several Commissioners, which
would give the Commission the opportunity to discuss these things. He noted the three
components to the proposed ordinance, and suggested approving it on first reading without the
incentives piece, and the other two components could go forward for second reading on May
23rd.
Commissioner Brandimarte motioned to adopt Ordinance 42017-016, on first reading,with
the incentives component removed; seconded by Vice-Mayor Harris. The motion failed on
the following 2-3 Roll Call vote:

City Attorney Ansbro read the title of Resolution#2017-025.
Corinne Lajoie, Principal City Planner, gave an overview of the site plan, and reviewed the
changes made by the applicant in response to neighborhood concerns.

Anna Riley, 4721 SW 42"d Terrace, commented they have been deceived since this item was first
heard as this property has been posted on Airbnb's website for rent on a daily basis. They
question whether the plan is for a daycare center or for room rental.
Vice-Mayor Harris suggested code enforcement check into this tomorrow.
Commissioner Grace said she had the understanding that residents' concerns were being
addressed by the applicant, and any problems can be rectified.
Mayor James commented we can approve this item as proposed and have code enforcement
follow up on the claim made by Ms. Riley.
Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public
Hearing.
Commissioner Grace motioned to adopt Resolution #2017-025; seconded by Vice-Mayor

Dennis Mele, representing the applicant, addressed concerns raised at the last meeting regarding
25th Avenue, and described how they have been working with Tropical Acres to gain road right
of way to allow for a full two-lane road. He noted they are also addressing neighborhood
concerns about trees on the development's property.

City Attorney Ansbro called for a brief recess at 9:46 p.m., after which Mayor James announced
that the meeting would need to be adjourned.
City Attorney Ansbro noted that Resolution #2017-029 and Resolution #2017-030 would be
continued until the May 9, 2017 City Commission meeting.

This item was heard at the April 6t" Magistrate Hearing. They were given 40 days to resolve the issue,then they will be
charged$200 a day until resolved. At this time no permit has been submitted to resolve this issues.

No new application for a new drainage plan was received by Public Services to address flooding issues at Walmart as
suggested below. Any permit modification related to surface water management falls under the purview of Broward
County.

Per emails below, drainage code violation issued December 14, 2016. Clearly below it says 401 Sheridan Plaza
was supposed to issue new drainage plans,modifications and permits to city by March 2nd code hearing or
fines would be issued and accrue is situation was not remedied.
Please provide records and advise what is happening with remedying this chronic flooring issue with Sheridan
plaza for Dania residents. Where's the new public records finalizing when new drainage modifications
compliance will be adhered too?

A Notice of Violation was issued to the property owner on 12/14/16. In order to comply,the
owner must provide plans, permits and modifications to the drainage system that will correct the
existing deficiencies and meet all applicable standards. It is expected that the this case will be
heard at the March 2nd Magistrate Hearing. Staff will recommend a limited and minimal amount
of time for final compliance.
