RESOLUTION NO. 2017-046 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA,APPROVING THE SITE PLAN(SP-99-16),VARIANCES (VA-37-17; VA-38-17; VA-39-17) AND A DESIGN VARIATION (OT-40-17) SUBMITTED BY ART AND ARCHITECTURE, INC., ON BEHALF OF THE PROPERTY OWNER 500 DANIA BEACH,LLC,FOR PROPERTY LOCATED AT 500 E. DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA,AS LEGALLY DESCRIBED IN EXHIBIT"A",A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City Code of Ordinances,Chapter 28,entitled"Land Development Code" (the"LDC"),of Part 6,entitled"Development Review Procedures and Requirements",Article 635, entitled"Site Plans"of Section 635-20(A),provides that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Art and Architecture, Inc. on behalf of the owner, 500 Dania,LLC, (the "Applicant")has requested site plan approval for the proposed construction of a new 4,190 square foot restaurant to be located at 500 E. Dania Beach Boulevard,in the City of Dania Beach,Florida, as legally described in Exhibit "A", a copy of which is made a part of and incorporated into this Resolution by this reference; and WHEREAS,Chapter 28,Part 3,entitled, "Special Zoning Districts,"of Subpart 1,entitled, "Community Redevelopment Area("CRA")Form-Based Zoning District"of Article 301,entitled, "Legal and Administrative Provisions" of Section 301-50, entitled, "Variations In Design; Procedures For Review Of Design Variations",provides that the City Commission is authorized to approve design variations within certain districts,if they are consistent with the intent of that section in lieu of the variance process provided for in Article 625, entitled, "Variances", of the LDC; and WHEREAS,the Applicant has requested a design variation(OT-40-17)from Section 510-30 (H) of the LDC to provide a reduced glass fagade area; and WHEREAS,the Applicant has requested a design variation(OT-40-17)from Section 510-40 (A) of the LDC to provide no palm clusters on the ends of landscape buffers; and WHEREAS,the applicant has requested that the City Commission waive the required cross- access and cross-parking easement as required by Section 306-10 (C) of the LDC; and WHEREAS, pursuant to Section 301-50 (c)(1) of the LDC, the above referenced design variations shall be considered as part of the proposed site plan (SP-99-16); and WHEREAS, Chapter 28, Part 6, entitled "Development Review Procedures and Requirements"of Article 625 entitled,"Variances"provides that the City Commission is authorized to approve variances if they are consistent with the criteria identified in Section 625-40, entitled "Variance review criteria, City action" of the LDC; and WHEREAS,the Applicant has requested a variance(VA-38-17)to provide a stacking area of twenty(20)feet between a property line and the entrance to a parking stall where Section 265-110 (C) of the LDC requires twenty-five (25) feet; and WHEREAS, the Applicant has requested a variance (VA-37-17) to provide no landscape buffer around a dumpster where Section 275-170(B)of the LDC requires a landscape buffer that is at least thirty(30) inches in height; and WHEREAS, the Applicant has requested a variance (VA-39-17) to provide only 1,400 square feet of vehicular-use-area landscaping where Section 275-100(B)of the LDC requires 2,300 square feet; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS,the City Commission finds that the approval of the proposed site plan(SP-99- 16), design variations (OT-40-17), and variances (VA-38-17, VA-37-17; VA-39-17) is consistent with the City's LDC and Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct, and they are made a specific part of this Resolution. Section 2. That pursuant to Chapter 28,entitled,"Land Development Regulations",Part 6, entitled, "Development Review Procedures and Requirements", the following Site Plan (SP-99-16), design variations (OT-40-17) and Variances (VA-37-17; VA-38-17; VA-39-17) attached as composite Exhibit`B,"are approved subject to compliance with the following conditions(references to Sections are those appearing in the LDC): 2 RESOLUTION#2017-046 1. This development is subject to the flood provisions of Chapter 12 of the City Code and the Florida Building Code. (FLOOD) 2. Project (addition to existing Pre-FIRM structure) will require substantial improvement determination.In order to facilitate review and determination,please provide elevation certificate, in NAVD 88,which clearly indicates that structure is compliant with current floodplain management regulations.If structure does not meet current elevation requirement,determination will be made by comparing job cost to market value for the structure for this improvement and any improvements made to the structure within the two years prior to the building permit apply date. (FLOOD) 3. Sheet SP.01 and other sheets in the plan set shall be provided in NAVD 88.(FLOOD) 4. Verify the latest Broward County Trafficways Plan for required right of way dedication, if applicable. Needs signoff from Broward County for right of way dedication. (ENGINEERING) 5. Deficiencies were identified on your plan during our plan review process. The Applicant shall provide the following: Minimum Radio Signal Strength for Fire Department Communications subject to review and approval. (FIRE) 6. The Applicant shall provide a letter from the Broward County Planning Council indicating whether the subject property must be platted or replatted. (PLANNING) 7. Payment of a RAC Transportation Mitigation Impact Fee in the amount of$212.60 shall be required prior to issuance of a building permit. (PLANNING) 8. All signs are not part of the Site Plan Approval and shall be submitted,reviewed and permitted separately. (PLANNING) 9. The proximity to the airport will require FAABCAD and FDOT review and approval. (PLANNING) Section 3. That pursuant to Section 635-100 "Expiration of Site Plans" of the Land Development Code, the site plan (SP-99-16) and design variation (OT-40-17) approvals shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the site plan,within eighteen (18)months from the date of this Resolution. Section 4. That pursuant to Section 625-50 "Expiration of Variances" of the Land Development Code,the variances(VA-37-17;VA-38-17;VA-39-17)approval shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the site plan, within eighteen (18) months from the date of this Resolution. Section 5. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7. There is a requirement that the building Elevations facing the streets comply with Arterial Commercial Design Standards by having clear glass windows that must be installed on the Street elevations of the building at a lit from 30" to 96"AFG. Because of the layout of the kitchen, freezer,cooler and bathrooms the 51h Street elevation can have no viewing windows on the first floor. Mitigating circumstances are as follows: 1. We understand that the purpose of this code is to provide natural lighting into the building. The customer service spaces are two story height,so we have glass on both the first and second floor of the building to let natural light into the building. For the Dania Beach Boulevard Elevation,we have provided first floor glazing from 12"AFG to 120"AFG'but still do not meet the requirements, as our building is two stories high,which skews the equation,we have provided 7 clear glass and opaque windows on the second floor totaling 49 s.f.to the facade. The customer service spaces are two story height,so we have glass on both the first and second floor of the building to let natural light into the building. On the East Elevation of the Customer Service Area, we are providing glazing from 12"AFG to 120"AFG,however this elevation is not the Secondary Elevation as it does not face a street. The elevation is into a two story Customer Service space so natural light is let into the building. There is no glazing requirement for this facade, but we have provided 20.4%glazing on the first floor and 4%glazing into the upper part of the two story customer service area. 3. On the Fifth Street Elevation,the Required Secondary elevation, we have provided Faux windows on the first floor and clear glass windows on the Second Floor. The total glazing area is 50 sf.The total of glazing provided on this facade is 4%.The code requires 15%. This design is representative of early 20d'century architecture,which is the theme of this building. 4.There are no windows on the first floor of the South Elevation. The second floor is partially set back from the first floor. The second floor of the Customer Service Area wall is set back from the lower one story kitchen. This high wall which is part of the customer service area has windows that will allow natural light in from the South. There is no glazing requirement for this facade, but we have provided 4%glazing into the upper part of the two story customer service area. 2. That the requested variance is otherwise compatible with the surrounding land uses and would not be detrimental to the community. A. The building will be compatible with the Dania downtown area and a restaurant will be consistent with existing land uses and will not be a detriment to the area. 3. A. The building design of this structure is that of buildings constructed in the early 19' century. The themed design of the building is consistent to existing Dania Beach 19th century structures. The code requirement to have 35%and 15%of the facade in glass cannot be attained because of the height of the building verses its width. One of the intentions of having glass on retail buildings,bars and restaurants' storefronts was to allow local law enforcement a view inside the building. This additional distance provides unencumbered view of oncoming traffic for the vehicle to make the right hand turn which is the only turning option available form this driveway. 2. A.The Variance that we are requesting is otherwise compatible with the surrounding land uses. B. The request for the 20 foot variance in lieu of the 25 foot requirement does not impede the sightlines of the car leaving the site as the driver has a 250' view of oncoming traffic from the stop bar; as the driver crosses the sidewalk his sight line expands to 400 feet distance. Which would be the same sightline whether the dimension was 25' or 20'. There would be no detriment to the community as the driving pattern to exit the site remains the same C. The first car space is setback 20 feet from the Property Line. Car spaces are 18' deep. The 20 foot setback allows 2 feet clearance for the car in the first space to back out without impeding a vehicle stopped at the stop bar wanting to exit the parking lot. 3.The variance is consistent with,and in furtherance of the goals objectives and policies of the adopted Comprehensive Plan,as amended from time to time,and all other similar plans adopted by the city. A.We have provided trees and plantings in the terminal islands on both sides of the egress drive that conform to the landscaping requirement set forth for terminal islands that would be the required 25 foot depth. The existing property contains an existing structure that was a bar/restaurant. The owner could have reopened that structure in its original form. The previous structure was a gas station. The site had three egress/ingress access points.To reconfigure the structure to follow Current city and FDOT requirements the owner is incurring tremendous unforeseen costs to make a viable business on this site. The rejection of the First Submittal of this project has resulted in a total redesign of this property. As a result of the redesign to conform to FDOT and city ordinances, regulations and the like,the new proposal is for a site that will accommodate 30 car spaces as opposed to the 32 spaces proposed in the First Submittal. This 20' variance is requested so that 2 more parking spaces, located in the Northeast egress driveway area, would not be lost,reducing the total spaces to 28 cars. The rejection of this Variance would severely hinder the owners' use of this site and present a lost business opportunity to the city. Discussing with staff,there was consensus that this variance had merit. 5. The variance presented is the minimum variance that is necessary to afford relief to the petitioner,while preserving the character,health,safety and welfare of the community. A. The 20 foot setback in lieu of the required 25' setback is the minimum distance that the petitioner requires to accommodate the proposed 2 cars spaces and allow for a 2 foot clearance between cars backing out of the first spaces and the car stopped at the stopped bar. In a worst case scenario,the 2' clear space could be reduced further, since a car at the stop bar is a temporary position and most cars are less than 18' long. 2 I B.The petitioner is providing the same amount of landscaping for the 20' deep island as would be provided for the 25' island. In order to provide for an interior dumpster area that makes for easy access and egress for the sanitation truck and a short distance for the kitchen crew to load the dumpster,the Site plan utilizes the diagonal design dumpster pickup area to accommodate the trucks ability to pickup trash onsite,without backing into street traffic and to accommodate the internal turning radius for fire trucks that may have entered into the site from Dania Beach Boulevard.The constraints of available land for the screening of the dumpster area has resulted in the Request for a Variance for the amount and type of landscaping elements required and the dimensional constraints imposed the geometrical shape of the planting area.. Our site plan mitigates these circumstances as follows: 1. We are providing 30"ht.hedge material and ferns to infill the space between the driveway curbing and the dumpster enclosure wall. 2 We are intending to cover the three sides of the dumpster enclosure wall with a wire mesh system to support clinging vines to grow upon and use the wire frame for support. The use of the vines will soften the appearance of the enclosure,while the hedges will give a 3-D depth of field appearance. 3. Per Section 51040 our site plan will provide a 3 palms with a ht.of 13'to be planted on the NE planting bed on the back and side of the dumpster walls. 1 2.That the requested variance is otherwise compatible with the surrounding land uses and would not be detrimental to the community. The variance presented is the minimum variance that is necessary to afford relief to the petitioner,while preserving the character,health,safety and welfare of the community. A. Relocating the dumpster area to another location on the site would cause traffic congestion between the truck and vehicles. In its present proposed location the truck has easy and direct entrance to the trash area without hindering movement of parked vehicles or vehicles traversing the site.All sanitation truck activities are j relegated to the interior of the site.The kitchen staff has easy access to the dumpster area without moving trash containers across the parking lot. This dumpster arrangement provides the least disruption to health safety and welfare concerns to the staff and the community. The Total Cost of the Variance Request#2 is$2,300.00. However our site plan cannot meet the 10' perimeter Buffer area landscaping required on the East and South Property lines.Relief from the 10' wide landscape buffer has been granted by the City to other parcels in the past through mitigation. Mitigating circumstances are as follows: 1. Currently there is a 4' ht concrete block wall that straddles the property lines. The wall is in disrepair. Our Site Plan proposes to repair and/or reconstruct the affected components of the wall. The wall will be stuccoed and painted to soften its harsh appearance. 2. Our Site Plan proposes to provide a strip of landscaping approximately 5'to 7' along the interior of the wall,in lieu of the 10' requirement. The Site Plan also provides that a 2' wide strip of asphalt pavement not be placed under the front portion of the vehicle parking spaces,abutting the landscape Buffer. This additional green strip will decrease the impervious areas from a 3' to 5' deficiency to a V to 3' deficiency of impervious area. Dania Beach Boulevard is a six-lane divided state arterial roadway with a posted speed limit of 40 mph. The majority of traffic is expected to use Dania Beach Boulevard to access the site. A copy of the site plan is included in Attachment B. We used traffic data that was collected at the intersection of Gulfstream Road and Dania Beach Boulevard on November 1, 2016 to analyze the peak-hour capacity of Dania Beach Boulevard. A peak season adjustment factor from the Florida Department of Transportation was applied to convert the data into peak-season data and applied a three percent growth rate to develop 2018 background traffic volumes, Although the historical growth rate on Dania Beach Boulevard is less than one percent, we applied a three percent compound growth rate to account for any approved but un-built projects. We also included traffic from the Dania Beach Residences project that was recently approved by the city. The traffic data used to develop the 2018 volumes is included in Attachment C. The vehicle trips that will be generated by the proposed restaurant were added to the 2018 background volumes to develop total 2018 total traffic volumes. We presumed a 70 percent west and 30 percent east directional distribution from the site. We did not assign traffic to SE 5`'Avenue to provide a conservative analysis for Dania Beach Boulevard. Table 2 summarizes the results of the analysis and indicates that Dania Beach Boulevard will operate at LOS C in 2018 with this project's impacts. The net-new peak-hour trips generated by this development (12 AM; 10 PM) are less than one-half percent of the capacity of Dania Beach Boulevard and should therefore be considered insignificant because it is less than one percent.
