HomeMy WebLinkAboutR-2017-030 Whispering Oaks Site Plan (SP-111-16) RESOLUTION NO. 2017-030 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE WHISPERING OAKS SITE PLAN (SP-I I 1-16) SUBMITTED BY THB ISLES, INC. FOR PROPERTY LOCATED AT APPROXIMATELY 4900 SW 25TH AVENUE IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A"; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 28, Part 6 of the Dania Beach Land Development Code (the "LDC"), Article 635, entitled "Site Plans", and Section 105-220 "PRD-1 District Supplemental Regulations (PRD-1)," provides that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, LDC Article 105-220 "PRD-1 District Supplemental Regulations (PRD- 1)," provides that "Development within the re-designated PRD-1 districts shall be deemed to be fully conforming with the code, pursuant to the approved site development plans and agreements made part ofthe respective rezoning ordinances"; and WHEREAS, THB Isles, Inc. (the "Applicant") is requesting site plan approval to permit 36 detached single family units on Lots 1-36; and a private recreational area and water management area on Parcel B, within the City of Dania Beach, Florida(the "City"); and WHEREAS, the Whispering Oaks site plan application (SP-111-16) has been reviewed for compliance with Article 105-220; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the Site Plan (SP-111-16) will protect the health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. The foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. Pursuant to Chapter 28, Part 6 of the Dania Beach Land Development Code (the "LDC"), Article 635 "Site Plans," and Section 105-220 "PRD-1 District Supplemental Regulations (PRD-1)," the Whispering Oaks Site Plan (SP-111-16), attached as Exhibit "B" which is made a part of and incorporated into this Resolution by reference, is approved. Section 3. The approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. Once a tree survey is completed, provide all information required by Sec. 275-80 including a tree disposition plan and table. Indicate all existing trees on plans with disposition. Note that if any canopy is to be removed, mitigation is required to replace removed canopy at a rate of 150%. If any canopy is proposed to be removed, provide a mitigation calculations table on the site plan. 2. The proximity to the airport will require FAA review and approval per BCAD letter dated January 1, 2017. 3. PARK IMPACT FEE: Per Section 805-110 & Resolution No. 2014-071 $1,825 per single family dwelling unit must be paid resulting in $65,700 (36 X 1,825)prior to issuance of a building permit. 4. Per Public Services Director,provide a Developers Agreement regarding payment of maintenance fees for the proposed linear park to be approved as to form by the City Attorney prior to recordation in Broward County Public Records. Must provide copy of recorded easement prior to issuance of a building permit. 5. Per Article 250, provide updated wildlife report and provide proof of compliance with Broward County wildlife protection measures prior to issuance of a building permit. 6. Per Section 105-220 "Provisions shall be made to assure that common areas and facilities that are to be jointly utilized by project residents shall be maintained in a continuous and satisfactory manner and without expense to the city. Such assurance may be provided by the requirement of homeowner association memberships for the purpose of holding joint title to, and assessing monthly maintenance fees for, such areas and facilities. Other methods may be acceptable if they satisfactorily provide for the proper and continuous payment of taxes, expenses and maintenance without any part of such charges being incurred by the city. The agreement incorporating such provisions shall be reviewed by the city attorney as to form and legal sufficiency, and recorded." Provide documentation satisfying this requirement prior to issuance of a building permit. 7. Applicant has met with representatives from Tropical Acres Steak House (property owner) with regard to the dedication of additional right-of-way for SW 25t'Avenue. The Applicant and the restaurant property owner are working on an agreement where Tropical 2 RESOLUTION#2017-030 Acres Steak House would dedicate right of way for SW 25th Avenue in exchange for the applicant widening SW 25th Avenue and making certain parking lot improvements for the restaurant. If this agreement is executed by the applicant and the owner of the restaurant property, and if the applicant receives all required permits and approvals from the applicable governmental agencies, the applicant will make the improvements substantially as shown on the attached exhibit. If this Agreement is not finalized or if the applicant cannot receive the required permits, the improvements to SW 25th Avenue and the improvements to the restaurant parking lot will not be required. Section 4. That pursuant to Section 635-100 "Expiration of Site Plans" of the LDC, the Site Plan (SP-I I1-16) approval shall automatically expire and become null and void unless the applicant files complete building permit applications with construction drawings for all improvements shown on the site plan within eighteen (18) months from the date of site plan approval, and the permits remain valid until a certificate of occupancy or its equivalent is issued for the improvement, unless an extension is granted in accordance with this Section. Section 5. That such application must be reviewed by the Broward County Aviation Department. That issuance of a development permit by a municipality does not in any way create any right on the part of an applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. Section 7. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. 3 RESOLUTION 92017-030 Section 8.
