A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AUTHORIZING THE EXPENDITURE OF FUNDS BY
PUBLIC SERVICES DEPARTMENT FOR SERVICES PURCHASED FROM
CHEN MOORE AND ASSOCIATES FOR PROFESSIONAL ENGINEERING
SERVICES FOR FISCAL YEAR 2016-2017 ENDING SEPTEMBER 30, 2017,
THAT EXCEED AN ANNUAL VENDOR TOTAL AMOUNT OF TWENTY
FIVE THOUSAND DOLLARS ($25,000.00); AUTHORIZING SUCH
PURCHASES MADE WITHIN CITY DEPARTMENTS' APPROVED
ANNUAL BUDGET APPROPRIATIONS; PROVIDING FOR CONFLICTS;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Charter of the City of Dania Beach, Part I1I, Article 3, Section 4,
Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and
materials for the City government in amounts in excess of the established monetary threshold
without competitive bidding and without advertisement for bids if he is authorized to do so in
advance by a resolution adopted by the City Commission; and
WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10,
"Monetary thresholds for certain purchases and payment disbursement authorizations", subsection
(a), sets the monetary threshold at Twenty Five Thousand Dollars ($25,000.00) for a vendor for
each fiscal year; and
WHEREAS, the Public Services Department will purchase engineering services from
Chen Moore and Associates ("CMA") during the fiscal year, which services for various
engineering services may exceed the annual Twenty Five Thousand Dollars ($25,000.00) City
threshold for a single vendor and,therefore, City Commission approval is required; and
WHEREAS, CMA was chosen as one of fifteen firms designated as an approved
engineering consultant by the City Commission on October 25, 2016 and formally approved by
RFQ 16-004 under Resolution No. 2016-142; and
WHEREAS, the Public Services Department is seeking approval to exceed Twenty Five
Thousand Dollars ($25,000.00) for any necessary future services for Fiscal Year 2016-2017
provided funding is available and appropriated in the current budget year and made in accordance
with the City of Dania Beach Purchasing Policy for each fiscal year;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the above "WHEREAS" clauses are ratified and confirmed, and they
are made a part of and incorporated into this Resolution by this reference.
Section 2. That the City Commission authorizes professional services by CMA
exceeding the annual amount of Twenty Five Thousand Dollars ($25,000.00) purchase threshold
for a single vendor.
Section 3. That all Department purchases shall be subject to and made within the
respective Departments' approved level of their respective annual budget appropriations and in
accordance with the City of Dania Beach Purchasing Policy for each fiscal year.
Section 4. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 5. That this Resolution shall become effective upon its passage and adoption.

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AMENDING SECTION 2-84, ENTITLED "POWERS OF
SPECIAL MAGISTRATE", OF ARTICLE IV, ENTITLED "CODE
ENFORCEMENT", CHAPTER 2, ENTITLED "ADMINISTRATION", OF THE
CITY CODE OF ORDINANCES, TO AUTHORIZE CODE COMPLIANCE
SPECIAL MAGISTRATES TO ABATE OR MITIGATE FINES ASSOCIATED
WITH CODE VIOLATIONS RESULTING IN LIENS; PROVIDING FOR
CONFLICTS, FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA:
Section 1. That Article IV, entitled "Code Enforcement" of Chapter 2, entitled
"Administration", and specifically Section 2-84, "Powers of Special Magistrate", of the City
Code of Ordinances, is amended as follows:
Sec. 2-84.—Powers of the special magistrate.
The magistrate shall have the power to:
Hear requests for abatement or mitigation of fines associated with Code
Compliance liens and maygrant, reduce, abate or mitigate accrued fines subject to a lien.
Section 2. That if any section, clause, sentence or phrase of this Ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this Ordinance.
Section 3. That all ordinances or parts of ordinances and all resolutions or parts of
resolutions in conflict with this Ordinance, are repealed to the extent of such conflict.
Section 4. That this Ordinance shall take effect on immediately following City
Commission adoption.

ENTITLED "PENSIONS AND RETIREMENT", OF THE CITY CODE OF
ORDINANCES, TO DELETE A PROVISION DESIGNATING A CITY
ELECTED OFFICIAL TO SERVE AS A RETIREMENT BOARD MEMBER
ON THE GENERAL EMPLOYEES' PENSION BOARD AND DESIGNATING
THE DIRECTOR OF THE CITY FINANCE DEPARTMENT OR DESIGNEE

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA:
Section 1. That Article III, entitled "Employees' Retirement Plan and Trust" of
Chapter 18, entitled "Pensions and Retirement", and specifically Section 18-29.9, "Board of
Trustees—Plan Administration" of the City Code of Ordinances, is amended to read as follows:
Sec. 18-29.9. -Board of trustees—Plan administration.
(a) The board of trustees shall serve as trustee of the trust created as part of the plan. The
board shall be vested with full legal title to the trust and assets theree of such plan.
(b) The board of trustees shall be the plan administrator and as such shall be charged with the
general administration and responsibility for the proper operation of the retirement plan
and trust and for making effective the provisions of this article. The board of trustees
shall consist of five (5)persons as follows:
(1) One member of the ee *- i seleeted by the eenunis „, Director of the
City Finance Department or designee of the Director, which designee is employ
in such Department; and
Section 2. That Article I, entitled "In General" of Chapter 2, entitled
"Administration", and specifically Section 2-1.5, "Commissioner to Serve on Board of Trustees
of City Police and Firefighters Retirement System", of the City Code of Ordinances, is amended
to delete the following section in its entirety and to note that such Section is to be identified as
"reserved" as follows:
Sec. 2-1.5. Reserved.- Commissioner to serve on board of trustees-of-eity polieaaa

Section 3. That Article I, entitled "In General" of Chapter 2, entitled
"Administration", and specifically Section 2-9, "Department of Finance Created; Duties" of the
City Code of Ordinances, is amended to read as follows:
Sec. 2-9. -Department of finance created; duties.
(c) Duties. The finance director shall perform the following duties:

(17) Serve, or appoint a designee employed in the Finance Department to serve, as an
ex officio duty, on the board of trustees for the Employees' Retirement Plan and
Trust.
Section 4. That if any section, clause, sentence or phrase of this Ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this Ordinance.
Section 5. That all ordinances or parts of ordinances and all resolutions or parts of
resolutions in conflict with this Ordinance, are repealed to the extent of such conflict.
Section 6. That this Ordinance shall take effect immediately following City
Commission adoption.
