Call to Order/Roll Call Mayor James called the meeting to order at 7:00 p.m. Present: Mayor: Tamara James Vice-Mayor: Bill Harris Commissioners: Chickie Brandimarte Bobbie H. Grace Marco A. Salvino, Sr. City Manager: Robert Baldwin City Attorney: Thomas Ansbro Deputy City Clerk: Tom Schneider 2. Moment of Silence and Pledge of Allegiance, Mayor James called for a moment of silence followed by the Pledge of Allegiance to the United States Flag. 3. Presentations and Special Event Approvals 3.1 Legislative Session Report by Ron Book City Attorney Ansbro noted Mr. Book was unable to attend tonight's meeting. 3.2 Special Event Request from American Legion Post 209 to hold a "Veteran Memorial Day Honoring Fallen Veterans" at C.W. Thomas Park on May 29, 2017, from 9:30 a.m. — 1:30 p.m. Commissioner Grace asked if staff would be available at the park, and why the memo from the Commander and the application in the agenda packet conflict regarding the event. Mark Felicetty, Director of Parks and Recreation, noted nothing was requested of the City, and the ceremony and dining would be at the American Legion facility. They needed a flat surface in the park to play patriotic music and have a gathering; the indoor facility will not be utilized. Commissioner Grace motioned to approve the Special Event request for the Veteran Memorial Day Honoring Fallen Veterans; seconded by Commissioner Brandimarte. The motion carried unanimously. 4. Proclamations There were no proclamations at this meeting. 5. Citizen Comments Michael Sartin, 746 SW 3 Street, commented on Attorney Mele's remarks at a past meeting about Sycamore trees and noted certain varieties do not grow here. He felt we need a botanist or arborist representing the City's interests, and noted he had previously provided the Commission with information on developing arbor commissions. 6. Public Safety Reports Captain Daniel Marks, BSO Chief of Police, reported on recent criminal activity in the City. Eric Busenbarrick, BSO Fire Marshall, was available to answer questions. 7. Consent Agenda 7.1 Minutes: Approve Minutes of May 9, 2017 City Commission Meeting 7.2 Travel Requests: None Resolutions 7.3 RESOLUTION#2017-047 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE EXPENDITURE OF FUNDS FOR SERVICES RELATED TO ENVIRONMENTAL PERMITS FROM THE CHAPPELL GROUP, INC. Bids and Requests for Proposals There were no proposals on this agenda. 9. Public Hearings and Site Plans City Attorney Ansbro advised Item 9.1 and 9.2 were quasi-judicial hearings and swore-in those who would speak. He asked the Commission to disclose any communication they had on these matters. Mayor James and Commissioner Brandimarte noted they had spoken with the developer and residents. 9.1 ORDINANCE#2017-004 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING THE FUTURE LAND USE PLAN MAP (LU-121-15) OF THE DANIA BEACH COMPREHENSIVE PLAN PURSUANT TO A REQUEST SUBMITTED BY GREENSPOON MARDER, P.A./DENNIS MELE, ESQ. (FIRST READING) City Attorney Ansbro read the title of Ordinance#2017-004. Corinne Lajoie, Principal City Planner, gave an overview of the land use amendment for Stellar Homes. She noted the Planning and Zoning Board did not recommend approval because of concerns raised by residents at the meeting. Attorney Dennis Mele, representing the applicant, presented a PowerPoint presentation on the development, which is attached to and incorporated into these minutes. He addressed the changes made since this item was considered by the Planning and Zoning Board. Alicia Lewis, on behalf of the applicant, described the community outreach undertaken to address neighborhood concerns and the commitments made to alleviate those concerns. Attorney Mele noted the developer would be entering into agreements with nearby neighborhoods for the proposed improvements. He continued the presentation and reviewed traffic calming measures they have committed to making. Minutes of Regular Meeting 3 Dania Beach City Commission Tuesday,May 23,2017—7:00 p.m. Mayor James opened the Public Hearing. Jacob Thaller, 2500 SW 55 Street, spoke in favor of the project. Leslie Kevles, 3011 W Marina Drive, said many of the residents of the Estates of Fort Lauderdale have met several times with the developer's representatives and they support the proj ect. Commissioner Grace noted she was initially opposed to this development, but now favors it because of the community outreach that occurred and subsequent changes made by the developer. Jamie, Vice-President of the homeowners association, spoke in favor of the project. Carmen DePaula, 2787 SW 54 Street, spoke in support of the project. Cathy Borgese, 5592 SW 28ffi Terrace, favored the project because of the changes to the original plan that will be made by the developer. Orlando Valez spoke in favor of the project. Charlotte Sloboda, 2905 Lakeshore Drive, noted the neighborhood is pleased about the meetings the developer held with them and they support the project. Louise Velo, 5512 Lagoon Drive, said she agrees with the project, but the Estates of Fort Lauderdale POA has not met nor come to an agreement with the developer. Their meeting is scheduled for June 8t' and she would like the Commission to hold the vote until they have an agreement in writing. Attorney Mele noted the agreement between the developer and the POA is a private agreement; they will follow up to complete the agreement and there is no reason to hold up the vote. Charlotte Sloboda, 2905 Lakeshore Drive, responded to Ms. Velo's comments. Isaac, 5771 Park Road, Vice-President of Twin Lakes, spoke in favor of the project, and asked if the developer could take care of the property now as it is an eyesore. Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public Hearing. Commissioner Grace motioned to adopt Ordinance #2017-004, as amended to 197 units, on first reading; seconded by Commissioner Brandimarte. Minutes of Regular Meeting 5 Dania Beach City Commission Tuesday,May 23,2017—7:00 p.m. Commissioner Salvino motioned to adopt Ordinance #2017-018, on first reading; seconded by Commissioner Grace. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Harris Yes Commissioner Grace Yes Mayor James Yes Commissioner Salvino Yes 9.4 ORDINANCE#2017-019 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, TO AMEND CHAPTER 28 OF THE "LAND DEVELOPMENT CODE", OF THE CITY'S CODE OF ORDINANCES BY AMENDING PART 3 "SPECIAL ZONING DISTRICTS," SUBPART I "COMMUNITY REDEVELOPMENT AREA (CRA) FORM-BASED ZONING DISTRICTS," ARTICLE 305 "INCENTIVES" TO MODIFY THE APPLICABILITY AND REGULATIONS OF INCENTIVES AND RELOCATE INCENTIVES FOR PUBLIC PARKS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) City Attorney Ansbro read the title of Ordinance #2017-019. Corinne Lajoie, Principal City Planner, described the proposed code changes to incentives. Mayor James opened the Public Hearing. Commissioner Salvino felt the timeframe for notification to the developers of the changes was not long enough; perhaps it should be a year. He also felt that with giving the Commission the decision that is not set in an ordinance, it affords them the opportunity of doing favors. He would not like to be in a position where somebody makes an accusation against him that he took something for voting for a project. City Attorney Ansbro responded he worked with special counsel to change the timeframe to one year and if the property is sold within that year, the new owner would have six months to avail themselves of the current incentives. Commissioner Salvino said regardless of whether the Commission does this, the governor has extended the building of projects due to mosquitoes and the Commission cannot override state law. City Attorney Ansbro explained governor-ordered proclamations extending already approved projects. James White, Weiss Serota, special land use counsel, addressed the executive orders issued by the governor over the past several months. Current development orders have an expiration date; executive orders extend the expiration date a set amount of time. Additionally, there is a statutory provision that gives an additional six months beyond the timeframe specified in the executive order. Minutes of Regular Meeting 6 Dania Beach City Commission Tuesday,May 23,2017—7:00 p.m. Commissioner Salvino noted his main opposition to this amendment stems from the fact that a prior Commission built these incentives in and it has done what it is supposed to do; we have put this out there and now we will be taking it away. Commissioner Brandimarte said she is not comfortable because of the change of two words. She commented we were striving for growth and to be business friendly; with this text change, there will be a lot of arguments when developers come before the Commission. Somebody will always be opposed to something they do not want. We also have a Planning and Zoning Board to guide the Commission. It is not business friendly to change from shall to may; the text is fine as it is. Mayor James confirmed that the word may has always been in the park incentives language. Even if shall is changed to may in the other incentives, the Commission could still award them, but she does not want to be bound to do so. As Commissioners, we do not always listen to the residents. She noted she wants to be business friendly and resident friendly, as well. Linda Barber, 75 Gulfstream Road, said it should be about the residents first, but agrees the City has to grow. The Commission should have the ability to make the determination on awarding incentives. Clive Taylor, 642 N 6 h Street, felt the Commission should have discretion in awarding incentives, although he questions the need for them. Seeing as there was no one else to speak in favor or opposition, Mayor James closed the Public Hearing. Mayor James motioned to adopt Ordinance #2017-019, on first reading, as amended with the City Attorney's tweak to the timeframe; seconded by Commissioner Grace. Discussion and Possible Action 10.1 CGI Communications - Mayor James Mayor James reviewed the Community Video Program information that was included in the agenda packet and felt it would be a great benefit to the City. Commissioner Grace motioned to move forward with the program; seconded by Commissioner Salvino. The motion carried on the following 5-0 Roll Call vote: Commissioner Brandimarte Yes Vice-Mayor Harris Yes Minutes of Regular Meeting 7 Dania Beach City Commission Tuesday,May 23,2017—7:00 p.m. Commissioner Grace Yes Mayor James Yes Commissioner Salvino Yes 10.2 Discussion of Class and Pay Analysis - Mayor James Mayor James noted she had asked for employee salary reports for the last four years, and said she is concerned and upset about the numbers. She has met with staff to discuss the numbers and questioned if the Commission is aware of the salary increases they have been approving through the budget. She noted the number of employees and total salaries in the Finance Department, and one employee received$33,000.00 in raises since 2014. Commissioner Grace said the Commission approves the budget with the recommendation given by the City Manager, but they have not pulled out the salaries. In looking at the sheet she received, she felt we should have a study on the raises, on how many people there are in each department, why the pay scale is different in some departments, and why we have so many assistants. This needs to be discussed before we approve or disapprove the next budget because there are things we probably will not be able to afford with getting more police officers and firemen. Commissioner Brandimarte said she is uncomfortable second guessing previous Commissioners, who set the policy on salaries; at the time they were right, perhaps not now. She agreed we should have a survey and then change the policy on salaries. Mayor James said words are brought to the Commission to approve, not the numbers. When the Commission approves someone to go to a new position, they do not know the pay increase involved. She does not think the Commission feels anyone is irreplaceable to the point that they have to be given an extra $15,000.00 just to stay here. The words do not translate into numbers and it is very deceiving. City Manager Baldwin noted when the Commission approves the budget, they approve the pay policy and the class and pay specifications. The administration takes the Commission's policy and administers it; he has been told for eight years that the policy in place has been administered fairly. He suggested if the Commission does not like the policy, they should change it. Mayor James noted there will be changes and this is not personal for her. Commissioner Salvino said he believes the City Manager is supposed to make sure the raises are given out according to the position; in his own business, sometimes he gives bonuses or raises because he does not want an employee to leave. He is bothered more by the retirement packages than the pay scale, and questioned what we can do with the pension. Discussion ensued about the old pension plan. City Manager Baldwin addressed the old pension system and the change to the Florida Retirement System. He noted not much can be done with the old pension system. Minutes of Regular Meeting 8 Dania Beach City Commission Tuesday,May 23,2017—7:00 p.m. Vice-Mayor Harris said the salary reports were astounding because some people are making so much money, which is coming out of the taxpayers' pockets. We need a total review of the payroll and compensation system. We also need to look at what the pension will cost us in a few years and see if there is some kind of a buyout. He is concerned about how the rate of pay justifies the work being done. He questioned how much revenue we are taking in that justifies the number of employees and amount of salaries in the Finance Department. Commissioner Grace concurred and noted this may not be the forum to address and correct this; perhaps a workshop setting so we can overhaul everything. If it is out of whack, we need to put it back in place. She added the Commission never got the figures and they approved it as an overall budget item. This is different than the private sector because it is taxpayers' money we are dealing with. City Manager Baldwin asked if the Commission wanted a class and pay study done, which would cost between$20-30,000.00. Commissioner Brandimarte reiterated she is upset about the second guessing of past Commissions. Commission consensus was to do a class and pay study. 11. Commission Comments 11.1 Commissioner Brandimarte Commissioner Brandimarte had no comments. 11.2 Commissioner Grace Commissioner Grace spoke about the All School Reunion at Collins Elementary School, and upcoming community events. Commissioner Grace spoke of a meeting last night about the Dania Beach CAN program and the 40 new homes to be built on Sistrunk for first-time home buyers. She noted OIC talked about offering training in Dania Beach for new jobs at no charge. Commissioner Grace gave a petition for speed humps from residents on NW 13t'Avenue to Brad Kaine, Public Services Director. 11.3 Commissioner Salvino Commissioner Salvino noted he attended the AMO Maritime Day and the All School Reunion. 11.4 Vice-Mayor Harris Minutes of Regular Meeting 9 Dania Beach City Commission Tuesday,May 23,2017—7:00 p.m. Vice-Mayor Harris commented we need to keep an eye on Dania Beach Bar and Grill to be sure they are current. Vice-Mayor Harris questioned the status of the bus stop designs. Assistant City Manager Donnelly said they should be ready for the next meeting Vice-Mayor Harris reported that the manager of the BP Station at 7th and Federal Highway said Code enforcement went there to check the bathroom and questioned why they would do this. Vice-Mayor Harris requested staffing information, such as open positions and continuing education meetings for department directors. Vice-Mayor Harris noted he is still working on the 3-way stop sign for Bryan Road and NW 1st Vice-Mayor Harris questioned the status of larger public hearing notice signs. City Manager Baldwin said they are being redesigned. Vice-Mayor Harris noted Hemingway Bistro is not complying with the sign code as they still have a banner. Marc LaFerrier responded they have been cited. Vice-Mayor Harris also noted he did not get a BTR report he requested two weeks ago. Commissioner Brandimarte said we are not addressing the most important issues such as the union contract and police and fire departments budget items; instead we are asking for reports and such. 11.5 Mayor James Mayor James spoke of the Collins reunion event. 12. Appointments 12.1 Airport Advisory Board—no appointments After a brief discussion, the Commission consensus was to amend the resolution establishing the board to reduce the membership to 11 members. Commissioner Grace appointed Charles Murphy to replace Tykia Funchess on the Planning and Zoning Board. 12.2 Creative Arts Council Advisory Board Commissioner Salvino appointed: Rich Aube 12.3 General Employees Pension Board Minutes of Regular Meeting 10 Dania Beach City Commission Tuesday,May 23,2017—7:00 p.m. The Commission appointed: Adam Segal, Assistant Finance Director 12.4 Police and Fire Pension Board—no appointments Commissioner Grace motioned to approve the appointments; seconded by Commissioner Brandimarte. The motion carried unanimously. 13. Administrative Reports 13.1 City Manager City Manager Baldwin noted he distributed the appraisal for Olsen Middle School, which came in at $870,000.00, and he will send a copy to the School board. We want them to give us the property and we would pay to demolish it.
