RESOLUTION NO. 2017-062 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING THE SITE PLAN(SP-035-17),VARIANCES (VA-49-17,VA-50-17,VA-66-17),EXCEPTIONS FROM DESIGN STANDARDS (OT-48-17), AND SPECIAL EXCEPTION (SE-51-17) APPLICATIONS SUBMITTED BY GRIFFIN POINTE PARTNERS, LLLP FOR PROPERTY LOCATED AT 2281 GRIFFIN ROAD IN THE CITY OF DANIA BEACH, FLORIDA,AS LEGALLY DESCRIBED IN EXHIBIT A,A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City Code of Ordinances,Chapter 28,entitled,"Land Development Code" ("LDC") of Part 6, entitled, "Development Review Procedures and Requirements,"of Article 635, entitled,"Site Plans"of Section 635-20(A),provides that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, Griffin Pointe Partners, LLLP ("Applicant"), is requesting approval of a site plan, special exception, exception from design standards, and three (3) variances for the redevelopment of the property located at 2281 Griffin Road in the City of Dania Beach,Florida,as legally described in Exhibit"A",a copy of which is made a part of and incorporated into this Resolution by this reference; and WHEREAS,the Applicant is requesting Site Plan approval to permit the future development and construction pursuant to and consistent with the attached Site Plan provided as Exhibit`B"; and WHEREAS,Part 6 of the LDC,Article 625,entitled"Variances",Section 625-40 states that the City Commission may grant a variance based on its determination that the Applicant has demonstrated that the criteria identified in the LDC have been satisfied; and WHEREAS,the Applicant has requested a Variance to waive eleven(11)parking spaces as otherwise required pursuant to Section 265-50(D)(64) of the LDC (VA-49-17); and WHEREAS, the Applicant has requested a Variance to provide 30' east side setback as otherwise required pursuant to Section 205-10(C) of the LDC (VA-50-17); and WHEREAS, the Applicant has requested a Variance in order to provide for ten (10) intermediate landscape peninsulas under the required 8-foot width as well as providing five(5)rows of parking that exceed the twelve (12) parking stall per parking aisle maximum, as otherwise required pursuant to Section 275-100(C) of the LDC (VA-66-17); and WHEREAS,Part 5 of the LDC,Article 510,entitled"Principal Arterial Commercial Design Standards, "Section 510-20(C)provides that the City Commission may approve exceptions to this article as conditions to a site plan approval based upon its determination that the petitioner has demonstrated that the criteria identified in the LDC have been satisfied; and WHEREAS,the Applicant has requested an exception from the arterial commercial design standards required pursuant to Section 510-30(D) and Section 510-30(G) of the LDC(OT-48-17); and WHEREAS, pursuant to Section 310-30(D), 510-30(G), 510-30(H), and 510-30(I) of the LDC,the above referenced exceptions shall be considered as part of the proposed Site Plan(SP-35- 17); and WHEREAS,Article 630 of the LDC,entitled"Special Exception Uses",states that the City Commission may grant a special exception based upon its determination that the petitioner has demonstrated that the criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant has requested a Special Exception to permit warehouse use pursuant to Section 110-10 of the LDC (SE-51-17); and WHEREAS,the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS,the City Commission finds that the approval of the Site Plan(SP-035-17),and Variances(VA-49-17), (VA-50-17),(VA-66-17), Special Exception(SE-51-17), and Exception to Design Standards(OT-48-17)will protect the health,safety,and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That pursuant to Chapter 28"Land Development Code,"Part 6"Development Review Procedures and Requirements,"Article 635 "Site Plan,"the following Site Plan(SP-035- 2 RESOLUTION#2017-062 17), attached as Exhibit `B" which is made a part of and incorporated into this Resolution by reference, is approved subject to the conditions specified in Section 6 of this Resolution. Section 3. That pursuant to Chapter 28"Land Development Code,"Part 6"Development Review Procedures and Requirements," Article 625 "Variances," the following Variance applications (VA-49-17,VA-50-17, and VA-66-17) are approved consistent with the attached Site plan provided in Exhibit`B". Section 4. That pursuant to Chapter 28"Land Development Code,"Part 6"Development Review Procedures and Requirements," Article 630 "Special Exception uses,"the application for Special Exception use (SE-51-17) is approved consistent with the attached Site Plan provided in Exhibit`B". Section 5. That pursuant to Chapter 28"Land Development Code,"Part 5"Signage and Design Regulations,"Article 510"Principal Arterial Commercial Design Standards,"the following Exceptions to Design Standards application(OT-48-17)is approved consistent with the attached Site Plan provided in Exhibit`B". Section 6. The approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. The proximity to the airport will require FAA/BCAD/FDOT review and approval. Contact William Castillo, Airport Planner with Broward County Aviation Department, located at 2200 SW 45 Street, Suite 101,Dania Beach,FL 33315,(954)359-6100.Contact Greg Jones, Airspace and Land Use Manager in FDOT at 850-414-4502 or at gregjonesgdot.state.fl.us. 2. The applicant is encouraged to contact neighbors adjacent to,as well as condominiums and neighborhood associations located within 300 feet of the development site,to advise of this property. Please provide acknowledgement and/or documentation of any public outreach. 3. Per Section 205-10 maximum height allowed = 3 stories/40'. Revise Site Data table on Sheet Al.1. 4. Per Section 655-40(B)applicant will have to provide proof of compliance with this section of the LDC. Section 7. That failure to adhere to the terms and conditions of approval above shall be considered a violation of the City Code and persons found violating the conditions shall be subject to the penalties prescribed by the City Code, including but not limited to, the revocation of the approvals granted by this Resolution. The Applicant understands and acknowledges that it must 3 RESOLUTION#2017-062 comply with all other applicable requirements of the City before it may commence construction or operation, and this Resolution may be revoked by the City Commission at any time upon a determination that Applicant is not in compliance with the City Code. Section 8. That pursuant to LDC Section 635-100 "Expiration of Site Plans," Section 630-70 "Expiration of special exceptions,"and Section 625-50"Expiration of variances",the Site Plan (SP-036-17), Variances (VA-49-17, VA-50-17, and VA-66-17), Exceptions to Design Standards(OT-48-17) and Special Exception(SE-51-17)approvals shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen(18)months from the date of this Resolution. Section 9. That such application must be reviewed by the Broward County Aviation Department. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 11. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 12. That this Resolution shall be in force and take effect immediately upon its passage and adoption.
