HomeMy WebLinkAboutR-2017-063 Trion Site Plan Modification (SP-03-15MOD) RESOLUTION NO.2017-063 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN MODIFICATION (SP-03- 15MOD), SUBMITTED BY 4 N. FEDERAL DANIA, LLC, FOR PROPERTY LOCATED ON THE NORTHEAST CORNER OF FEDERAL HIGHWAY AND DANIA BEACH BOULEVARD IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED AS EXHIBIT "A," A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONDITIONS; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,the City Code of Ordinances,Chapter 28,entitled"Land Development Code" (the"LDC"),of Part 6,entitled"Development Review Procedures and Requirements,"Article 635, entitled "Site Plans," states that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, 4 N. Federal Dania, LLC ("Applicant") is requesting Site Plan Modification approval to remove 6,052 square feet of commercial use and to allow the construction of an additional fourteen(14)dwelling units for a total of three-hundred(300)dwelling units to be located on the northeast corner of Federal Highway and Dania Beach Boulevard in the City of Dania Beach, Florida, as legally described in Exhibit"A"; and WHEREAS,the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the proposed Site Plan Modification(SP-03-15MOD)is consistent with the requirements of the Code and will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives and policies of the Comprehensive Plan; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,FLORIDA: Section 1. That the foregoing"WHEREAS"clauses are ratified and confirmed as being true and correct,and they are made a part of and incorporated into this Resolution by this reference. Section 2. That pursuant to Chapter 28"Land Development Code,"Part 6"Development Review Procedures and Requirements," Article 635 "Site Plan," the following Site Plan Modification(SP-03-15MOD),attached as Exhibit`B"which is made apart of and incorporated into this Resolution by reference, is approved. Section 3. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. FFE of area defined as "Leasing" should be consistent on Sheets SP-1, SF-1, A101 and A109 (Flood Plan Review). 2. Provide drawing file (dog or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal (City Engineer). 3. Based on meeting held on June 6, 2017 between and among Dev Motvani (Developer), Marc LaFerrier (Community Development) and Ronnie Navarro (Public Services), all underground utilities (water and sewer)and other road improvements on NE 1 St Avenue between East Dania Beach Blvd and NW 1"Street and portion of NE 1 St Court shall be upgraded at developer's cost subject to a developer's agreement with the City of Dania Beach(City Engineer). 4. Park Impact Fee: per Section 805-110 & Reso. No. 2014-071, $1,364.00 per multifamily dwelling (300 X 1364 = $409,200) must be paid prior to issuance of a building permit (Planning). 5. RAC TRAFFIC IMPACT MITIGATION: Provide an analysis, signed and sealed by a certified engineer, identifying the amount of RAC mitigation for traffic impact due based on resolution No.2014-049 which established a rate of$21.26 per p.m.peak hour trip.Provide updated traffic report identifying the PM Peak hours of trips so impact fee can be calculated with new unit/retail numbers (Planning). 6. Per Section 305-50 (H), Performance Bonds. "Participants in the voluntary green building program, at the time of building permit application, shall post a performance bond, letter of credit, or other form of surety approved by the City Attorney, in the amount described by the regulations (Planning). 7. SUSTAINABLE BUILDING PRACTICES: Per Section 305-50(F) Provide "Project site and engineering plans that clearly detail all green building measures which are intended to qualify for incentive."(Planning). 8. Must provide unity of title unifying all lots,prior to issuance of a building permit(Planning) 9. The developer shall enter into an Agreement with the City to ensure the compliance of the pocket park with Articles 305 and 312 of Chapter 28 of the Dania Beach City Code in a form acceptable to the City Attorney. Such Agreement shall provide for ongoing maintenance of the park by the developer and ensure continuous public access to the pocket park from dawn to dusk 365 days of the year,except during declared states of emergency and shall be recorded in the public records 2 RESOLUTION#2017-063 at the expense of the developer prior to the issuance of a building permit for the Site Plan (Planning). 10. Provide a deed restriction identifying all areas(yoga room,clubroom,coffee lounge,etc.)of the eastern building is for the exclusive use of the residents of that building and not meant for the public as no parking is provided for those uses (Planning). 11. Applicant must obtain a statement from the City Engineer saying that the traffic study/statement submitted by the applicant is complete and accepted prior to public hearing (Planning). 12. For all projects resulting in buildout of the site, such that construction staging cannot occur on site, must obtain Staging Plan approval by the Community Development Director prior to issuance of a building permit. The Staging Plan must include,but is not limited to, location of equipment and material during construction(Planning). 13. For all projects resulting in buildout of the site, such that construction staging cannot occur on site, the applicant must obtain Maintenance of Traffic Plan approval by the City Engineer for period of construction prior to issuance of a building permit(Planning). 14. Please e-mail resolution and legal description for development approval in word format to cchurchkdaniabeachfl.gov four(4)weeks prior to public hearing (Planning). 15. The applicant is encouraged to contact neighbors adjacent to, as well as condominiums and neighborhood associations located within 300 feet of the development site, to advise of this project. Please provide acknowledgement and/or documentation of any public outreach (Planning). Section 4. That such application must be reviewed by Broward County Aviation Department. That pursuant to LDC Section 635-100 "Expiration of Site Plans,"the Site Plan(SP-03-15MOD)shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan,within eighteen(18) months from the date of this Resolution. Section 6. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency,and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. 3 RESOLUTION#2017-063 Section 7. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 8.
