HomeMy WebLinkAboutR-2017-067 Approves Change Order Number Four (4) in the Amount of $13,282,50 to be Paid to MBR Construction, Inc. for the Dania Beach Ocean Park Revitilization Phase 1 Construction Project RESOLUTION NO. 2017-067 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO APPROVE CHANGE ORDER NUMBER FOUR (4) IN THE AMOUNT OF THIRTEEN THOUSAND TWO HUNDRED EIGHTY TWO DOLLARS AND FIFTY CENTS ($13,282.50) TO BE PAID TO MBR CONSTRUCTION, INC. IN CONNECTION WITH THE DANIA BEACH OCEAN PARK REVITALIZATION PHASE I CONSTRUCTION PROJECT; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Ocean Park Revitalization Project- Phase I was approved for the construction and design of beach improvements; and WHEREAS, the City Commission awarded a bid to MBR Construction, Inc. for One Million Four Hundred Fifty Nine Thousand Eight Hundred Thirty Five Dollars ($1,459,835.00) on November 10, 2015,pursuant to Resolution 2015-137; and WHEREAS, the City Commission approved Change Order Number One (1) in the amount of Sixty Six Thousand One Hundred Seven Dollars and Fifty Cents ($66,107.50) on June 28, 2016,pursuant to Resolution No. 2016-087; and WHEREAS, on February 28, 2017, Change Orders Number Two (2) and Three (3) were approved by the City Manager in the total amount of Twenty Four Thousand Seven Hundred Twenty Four Dollars and Seventy Five Cents ($24,724.75) for additional work related to a beach pump system and beach crossovers; and WHEREAS, due to the beach erosion on the south side of the beach area, Change Order Number Four (4) in the amount of Thirteen Thousand Two Hundred Eighty Two Dollars and Fifty Cents ($13,282.50) is requested to be paid to MBR Construction, Inc., to include the cost of installing one (1) bollard at the Quarterdeck Restaurant, stair extensions, steps and ipe wooden gates for Crossovers Number Four (4) and Five (5), a copy of which change order is attached as Exhibit "A", (and it is made a part of and is incorporated into this Resolution by this reference), bringing the total contract amount to be paid to MBR Construction, Inc. to One Million Five Hundred Sixty Three Thousand Nine Hundred Forty Nine Dollars and Seventy Five Cents ($1,563,949.75); and WHEREAS, Change Order Number Four (4) requires approval by the City Commission, as net change orders allowed by the City Manager are limited to $25,000.00 and funding approval is required; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "Whereas" clauses are ratified and confirmed as being true and correct, and they are made a specific part of and incorporated into this Resolution by this reference. Section 2. That that the City Commission approves Change Order Number Four (4) applicable to the Dania Beach Park Revitalization Phase I Project with payment to be made to MBR Construction Inc., in the amount of Thirteen Thousand Two Hundred Eighty Two Dollars and Fifty Cents ($13,282.50), and the City Manager and City Officials are authorized to execute it. Section 3. That funding appropriations for this project are available through the Capital Projects fund Beach Revitalization Project Phase I Account Number 301-72-59-572-62- 10. Section 4. That all resolutions or part of Resolutions in conflict with any of the provisions of this Resolution are repealed to the extent of such conflict. Section 5. That this Resolution shall become effective immediately upon its passage and adoption. PASSED AND ADOPTED on June 27, 2017.
